HomeMy WebLinkAboutBy-law 5567/99THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 5 5 6 7/9 9 Being a By-law to provide for the imposition of fines for the contravention of various by-laws of The Corporation of the Town of Pickering. WHEREAS, Section 320 of the Municipal Act, R.S.O. 1990, c.M. 45, as amended, provides that by-laws may be passed by the Councils of all municipalities for providing that any person who contravenes any by-law of the Council passed under the authority of the Municipal Act is guilty of an offence; WHEREAS, Section 61 of the Provincial Offences Act, R.S.O. 1990, c.P. 33, as amended, provides that except where otherwise expressly provided by by-law, every person who is convicted of an offence is liable to a fine of not more than $5,000.00; WHEREAS, the Council of The Corporation of the Town of Picketing considers it desirable to amend, the fine provisions of certain by-laws in accordance with the provisions of the Municipal Act and the Provincial Offences Act; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: That the sections, subsections or clauses of the by-laws set out in Schedule "A" to this By-law be repealed and the following substituted therefore: "Every person who contravenes any provisions of this By-law is guilty of an offence and liable upon conviction to a penalty provided for under the Provincial Offences Act, as amended". 2. The By-laws set out in Schedule "B" to this By-law shall be amended to include the following: "Every person who contravenes any provisions of this By-law is guilty of an offence and liable upon conviction to a penalty provided for under the Provincial Offences Act, as amended".
