Peter Rodrigues
Re: Vacancy on Pickering Council
Peter Rodrigues appeared before Council and noted his concerns with an
appointment to the vacant Regional Councillor, Ward 1 seat. He felt that the
position should be filled by a by-election, stating there was no justification for an
appointment. He stated there should be criteria in place for appointments, such as
soliciting applications. He stated that comparisons with other municipalities
showed that by-elections had been done during this same time of year.

Recommendation:
1. That pursuant to Section 262(1) of the Municipal Act, 2001, the Council of the
Corporation of the City of Pickering declared the office of Regional Councillor,
Ward 1 as vacant at a meeting of Council held on October 26, 2015;
2. That Council fill the vacant seat of the office of Regional Councillor, Ward 1
by appointing Kevin Ashe, City Councillor, Ward 1 to the office of Regional
Councillor, Ward 1;
3. That a by-law to appoint Kevin Ashe to fill the vacancy in the office of
Regional Councillor, Ward 1, be enacted;
4. That Council nominate Kevin Ashe to the Toronto and Region Conservation
Authority to represent the City of Pickering and the City Clerk notify the
Region.of Durham of the nomination;
5. That Council fill the vacant seat of the City Councillor, Ward 1 by by-election;
6. That a by-law to require a by-election to fill the vacancy in the office of City
Councillor, Ward 1 be brought forward at the next meeting of Council to be
held on November 16, 2015; and
7. That the City Clerk be given authority to give effect thereto.
Carried Later in the Meeting
Mayor Ryan asked Councillor Ashe if he accepted the nomination. Councillor
Ashe confirmed his acceptance. .
Councillor Ashe noted that he had a conflict of interest regarding the motion to
appoint him to the vacant seat of Regional Councillor, Ward 1 and stated that he
would not take part in the discussion or vote on the matter.
A discussion period ensued regarding the pros and cons as well as the timing of
a by-election. The cost effectiveness of doing an appointment was discussed,
as it was felt that Councillor Ashe's experience and qualifications for the Regional
Councillor, Ward 1 position warranted the appointment, and would also avoid the
cost of potentially holding two by-elections.

That the motion be divided and that recommendations 1, 2, 3 and 4 be voted on
first and then recommendations 5, 6, and 7 so that Councillor Ashe could vote on
the recommendations regarding a by-election.

(IX) Other Business

Council Chambers
1. The City Clerk requested Councillor Ashe take the Oath of Office by reading
and signing the Declaration of Office. The City Clerk declared Councillor
Ashe to be the newly appointed Regional Councillor, Ward 1.
(IV) Confirmatory By-law
By-law Number 7452/15
Councillor Johnson seconded by Councillor McLean moved for leave to introduce
a By-law of the City of Pickering to confirm those proceedings of the Council of
The Corporation of the City of Pickering at its Special Meeting of Council of
November 2, 2015.
