Scorer ALSO PRESENT Mrs. Eva McDougall, Secretary-Treasurer Mr. Jeffrey Cole, Planner The Meeting convened at 7:00 p.m. in the Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Mr. Puterbough, seconded by Mrs. Kerr and carried unanimously - That the minutes of the 5th meeting of the Committee of Adjustment held Wednesday, March 17, 1993 be adopted. -- 3. PICA 24/93 - Gleed Motor Holdings Ltd. Part of Lot 30, Range 3, B.F.C. Also known as 555 - 599 Kingston Road Town of Pickering The applicant requests relief from the provisions of Zoning By-law 3036, as amended by Zoning By-laws 3177/89 and 3255/89 to permit the following: (a) Section 5(1)(b)(viii)(A) to permit the establishment of open storage for marine vehicles (boats) on the subject property, whereas the by-law does not permit open storage in any yard. (b) Section 5(1)(b)(viii)(B) to permit the establishment of outdoor display of marine vehicles (boats) on the subject property, whereas the by-law does not permit display except the display of automobiles or trucks in association with a vehicle sales or rental establishment in any yard. Section 5(1)(b)(ix)(D) to permit the establishment of a gravel surface parking area, whereas the by-law requires that all parking areas shall be surfaces with brick, asphalt or concrete, or any combination thereof. (c) --- Approval of this application is required in order that a temporary marine vehicles .sales facility (boat sales) with outdoor display and storage may be permitted on the subject property until October 31, 1993. The Secretary-Treasurer outlined comments received from the Town of Pickering Planning Department, the Ministry of Transportation, and Landtactix Inc., the property owner to the east of the subject property, which the Committee had before them. The Secretary-Treasurer noted that no comments were received from the Durham Region Health Unit. The Secretary-Treasurer noted that there were changes made to the report to the Secretary-Treasurer from Jeffrey G. Cole, Planner, Town of Pickering Planning Department, dated April 2, 1993, which were noted as follows: '-' - 27 - Page 2, Section 6., paragraph 3, first line: "approval" removed and "endorsement" inserted; Page 3, (4) first line: "the approval of' removed and after the word "plan" inserted "as generally shown at tonight's meeting"; Page 3, (4) third line: after the word " obtained " inserted "and related site works not completed"; Page 3, (5) first line: "approval" removed and the word "endorsement" inserted. Mr. Don Gleed, the owner of Gleed Motor Holdings Ltd., was present to represent the application. Mr. David Page, the agent, was also present to represent the applIcation. No further representation was present in favour or in objection to the application. Mr. Page stated that he contacted Ms. Lisa Cole of the Ministry of Transportation, and that he is aware permits would have to be obtained for the site from the Ministry. Mr. Page noted he contacted Mr. S. Vokes, Director of Public Works for the Town of Pickering, regarding the grading and stormwater runoff for the site and could foresee no problems. Mr. Bhuta asked if the company intended to do any landscaping on the subject property. Mr. Page replied that they did not intend to landscape at the present time, but they did intend to generally clean up the site. Mrs. Scorer asked if temporary lighting for the property would be installed. Mr. Page indicated that lighting would be installed in a couple of locations. Mrs. Scorer asked if any fences would be installed. Mr. Page indicated that no fencing would occur on-site at present. Mr. Page stated that the market for selling boats is in the spring and the company wished to take advantage of the market. Mr. Page indicated that an application was submitted to the Town of Pickering in June of 1993 for multiple uses on the site such as retail, food use, gasoline/retail and a dealership. Mr. Puterbough asked if they were fully aware that if the variance was granted that it would ....... expire on October 31, 1993. Mr. Page indicated that they fully understood the variance was only temporary. Mr. Bhuta inquired where the parking area on the site would be located. Mr. Page noted the parking area would be mainly in front of the sales trailer. Mr. Bhuta inquired about the dust that would occur from the traffic. Mr. Page indicated that they intended to install fresh gravel on the site, and that there would not be any dust from the gravel. Mr. Page stated that there was no rationale to install permanent pavement at this time since they would probably have to remove most of the pavement. Mrs. Scorer inquired if the applicant was happy with the entrance to the site. Mr. Page stated that they were agreeable to the entrance to the site, and they had to meet the Ministry of Transportation standards for the site. Ms. Archer inquired as to the positioning of the access off Highway No.2. Mr. Page replied that the Ministry of Transportation indicated that the site would have two access points; one jointly with Landtactix Inc., the property owner to the east, and the other access as shown on the site plan. DECISION: Moved by Mr. Bhuta, and seconded by Mrs. Kerr, and carried unanimously that- this application, P /CA 24/93 by Gleed Motor Holdings Ltd., as outlined, be APPROVED on the grounds that the variances are minor in nature, appropriate for the desirable development of the land, and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan, and Sections 5(1)(b )(viii)(A), 5(1)(b )(viii)(B) and 5(1)(b)(ix)(D) of Zoning By-law 3036 as amended by By-law 3177/89 and By-law 3255/89, subject to the following conditions: ..... - 28 - (1) That the approval of the variances to permit the open storage and outdoor display of marine vehicles on a gravel surface parking area shall expire on October 31st, 1993. That any outdoor storage or open display of marine vehicles on the property as a result of this variance shall be removed by October 31st, 1993. That the granting of these variances at this time for the stated purpose shall not be construed as precedent for any similar minor variance applicatIOn at a future date (particularly this application and applicant); '-' (4) That the approval of the site plan be subject to the final approval of matters under the jurisdiction of the Ministry of Transportation and the Town Department of Public Works, and if such approvals are not obtained by May 21st, 1993, the variances shall become null and void. (2) (3) (5) That the approval of the site plan related to these variances shall expire on October 31st, 1993, and it shall not be construed as precedent for any site plan for a similar development at a future date. 4.
