Kerr Mrs. C. Scorer - 66- '-' ALSO PRESENT Mrs. P. Healey, Acting Secretary-Treasurer Mr. Jeffrey G. Cole, Planner The Meeting convened at 7:00 p.m. in the Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES No matters arising from the minutes. 2. ADOPTION OF MINUTES Moved by Mrs. C. Scorer, seconded by Mrs. D. Kerr and carried unanimously - That the minutes of the 12th meeting of the Committee of Adjustment held September 23, 1992 be adopted. 3. PICA 66/92 - W. Tollett & R. Crust Part of Lot 24, Plan 12 (Part 3, 40R-12495) Also known as 5069 Wixon Street, Claremont Town of Pickering The applicants request relief from the provisions of Zoning By-law 3037, Section 8.2.1 of the By-law to permit the establishment of a 0.8 metre south side yard width whereas the ,-,. By-law requires that a dwelling provide minimum side yard widths of 1.8 metres. Approval of this variance application is required in order to obtain a building permit for the construction of a second-storey deck. Mr. Tollett was present to represent the application. No further representation was present in favour of or in objection to the application. The Acting Secretary-Treasurer outlined comments received from the Planning Department and Durham Regional Health Services. Mr. Tollett indicated that if he reduced the balcony by 0.8 metres, he would be left with a two-foot balcony. Mr. Puterbough asked why the balcony had been built without a building permit. Mr. Tollett said that his partner had started building before he got a building permit and was finished building before it was inspected. '-' DECISION: Moved by Mr. M. Puterbough, seconded by Mrs. D. Kerr and carried unanimously that - this application, P /CA 66/92 by W. Tollett and R. Crust, be APPROVED on the grounds that the requested variance is minor in nature, desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan and Section 8.2.1 of Zoning By-law 3037 subject to the following condition: I. That this variance apply only to the uncovered second-storey deck as generally outlined in this application. ~ . - 67- 4. P /CA 67/92 - C. Barrand Lot 20, Plan 40M-1482 Also known as 5046 William Street, Claremont Town of Pickering The applicant requests relief from the provisions of Zoning By-law 3037, as amended by Section 5.18(e) of By-law 2325/86, to permit the continuance of a maximum height of 4.6 metres for the accessory structure on the subject property whereas the By-law limits the height of accessory structures in any residential zone to a maximum of 3.5 metres. ..... Approval of this variance application is required in order to bring the subject property into compliance with the provisions of the By-law. Mr. Barrand and Ms. E. Vousden were present to represent the application. No further representation was present in favour of or in objection to the application. The Acting Secretary Treasurer outlined comments received from the Planning Department and Durham Regional Health Services. A letter in objection to the application was received from Egon Weidenborner, 5044 William Street, Claremont. Mr. Barrand stated that he had tried to blend the shed in with the farm across the road and that it would be finished in board and batten, identical to his house, in an effort to maintain the century appearance of the area. Mr. Puterbough asked about the possibility of relocating or decreasing the height of the shed in view of the objection stated by the neighbour to the south. Mr. Barrand replied that it was not possible to move the shed further back on his property, due to the location of the septic bed and the conservation area at the back of his property, but it would be possible to lower the height of the shed. DECISION: Moved by Mrs. C. Scorer, seconded by Mr. M. Puterbough and carried unanimously that - this application, P /CA 67/92 by C. Barrand, as outlined, be REFUSED on the grounds that the requested variance is major in nature, undesirable for the appropriate development of the lands in that the accessory structure is not architecturally ~ co-ordinated to the house and the height is not necessary as there is ample opportunity to conform to the By-law, also the shed is very visible and detrimental to the landscape, and not in keeping with the general intent and purpose of Section 5.18(e) of By-law 3037. 5. ADJOURNMENT MOTION: Moved by Mr. M. Puterbough, seconded by Mrs. C.
