Room ofthe Pickering Civic Complex on Wednesday, June 14, 1995. PRESENT: Mr. J. C. Young, Chairperson Mr. S. Smith Mr. P. White ALSO PRESENT: Mr. J. Cole, Assistant Secretary-Treasurer Mrs. P. Healey, Planning Department The meeting convened at 7:00 p.m. in the Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES '-' MOTION: Moved by Mr. Smith, seconded by Mr. White and carried unanimously- That the adoption of the minutes of the 7th meeting of the Committee of Adjustment held May 24, 1995, be deferred to the meeting of July 4, 1995. 3. PICA 34/95 - Hamann Enterprises Ltd. Part of Lots 13 and 14, Concession 8 (Southwest corner of Regional Road No.5 and Sideline 12) (Deferred from meeting of May 24, 1995) The applicant requests relief from the provisions of Section 6.2.1 of By-law 3037 to permit: (a) a minimum lot frontage of 43.04 metres; whereas the By-law requires a minimum frontage of 60 metres; (b) a lot area of 0.54 hectares; whereas the By-law requires a minimum lot area of 0.8 hectares; and (c) a minimum rear yard of 8.84 metres; whereas the By-law requires a minimum rear yard depth of 12 metres. -... Approval of this variance is required to bring the proposed retained parcel subject of Land Division Application (LD 137/95) into compliance with the provisions of the Zoning By-law. DECISION: Moved by Mr. White and seconded by Mr. Smith and carried unanimously that - this application, PICA 34/95, by Hamann Enterprises Ltd., as outlined, be REFUSED, as there was no representation at the meeting and this application had previously been deferred from the meeting of May 24,1995. 4. PICA 38/95 - V. Wai-Ping Part Lot 66, Plan 1051 Also known as 1838 Appleview Road The applicant requests relief from the provisions of Section 5.18(d) of Zoning By-law 3036 to permit the establishment of a 1.37 metre north side yard width; whereas the By-law requires that a dwelling with an attached garage provide minimum side yard widths of 1.8 metres. -- Approval of this variance application is required in order to obtain a building permit for a proposed attached garage at the north side of the existing dwelling on the lot. The Assistant Secretary-Treasurer outlined comments received from the Town of Pickering Planning Department. Mr. A. Westcott, agent, and Ms. V. Wai-Ping, applicant, were present to represent the application. No further representation was present in favour of or in objection to the application DECISION: Moved by Mr. Smith and seconded by Mr. White and carried unanimously that - this application, PICA 38/95, by V. Wai-Ping, as outlined, be APPROVED, on the grounds that the variance is minor in nature, appropriate for the desirable development of the land, and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan, and Section 5.18(d) of Zoning By-law 3036, subject to the following condition: 1. That the north side yard width variance apply only to the existing dwelling with the addition as generally identified on the plan submitted with this application. -- 5. PICA 39/95- B. Corcoran Lot 150, Plan M-1057 Also known as 1839 Shadybrook Drive The applicant requests relief from the provisions of Section 5. (as outlined in Schedule B) of amending By-laws 4407/73 and 113/74 to Zoning By-law 3036, to permit the establishment of a 0.9 metre south side yard width; whereas the By-law requires requires that a dwelling provide minimum side yard widths of 1.2 metres. Approval of this variance application is required in order to obtain a building permit for a proposed addition to expand the kitchen on the southeast corner of dwelling. The Assistant Secretary-Treasurer outlined comments received from the Town of Pickering Planning Department. Mr. B. Corcoran was present to represent the application. No further representation was present in favour of or in objection to the application. DECISION: Moved by Mr. White and seconded by Mr. Smith and carried unanimously '-' that - this application, PICA 39/95, by B. Corcoran, as outlined, be APPROVED on the grounds that the variance is minor in nature, appropriate for the desirable development of the land, and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering, District Plan, and. Section 5. (as outlined in Schedule B) of amending By-laws 4407/73 and 113/74 to Zoning By-law 3036, subject to the following condition: 1. That the south side yard width variance apply only to the existing dwelling with the addition as generally identified on the plan submitted with this application. 43 6. PICA 40/95 - G. K. Langlois Part of Lots 123 and 124, Plan 331 Also known as 720 Hillview Crescent The applicant requests relief from the provisions of Section 10.2.3 of By-law 2511 to permit the establishment of a rear yard depth of 3.96 metres; whereas the By-law requires that a dwelling provide a minimum 7.5 metre rear yard depth. .... Approval of this variance application is required in order to obtain a building permit for a proposed sunroon addition to the rear of the existing dwelling on the lot. The Assistant Secretary-Treasurer outlined comments received from the Town of Pickering Planning Department. Mr. G. Langlois was present to represent the application. Mr. I. Smythe, 724 Hillview Cresent was present to discuss the application. Mr. Smythe presented the Committee with a letter of objection from Ms. A. M. Muir, 716 Hillview Crescent. Mr. Langlois mentioned that the addition would conform with the rest of the house, would have the same cladding, and that the work would be done by professionals. Mr. Smythe expressed concern about large construction equipment being brought in which would necessitate removal of the fence, thereby allowing children access to the construction area. Mr. Langlois indicated that this construction would not require any large equipment. Some discussion took place regarding the content of Ms. Muir's letter and the build up of ice on the road during the winter. DECISION: Moved by Mr. White and seconded by Mr. Smith and carried unanimously that - "W' this application, PICA 40/95, by G. K. Langlois, as outlined, be APPROVED on the grounds that the variance is minor in nature, appropriate for the desirable development of the land, and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering, District Plan, and Section 10.2.3 of Zoning By-law 2511, subject to the following conditions: 1. That the rear yard depth variance apply only to the existing dwelling with the sunroom addition as generally identified on the plan submitted with this application. 2. That, through the issuance of a building permit for the sunroom addition, the Town ensure adequate fencing be maintained throughout the building period. 7. PICA 41/95 - Steel Valley Group Block 22, Plan 40M-1365 Also known as 1105 Finch Avenue The applicant requests relief from the provisions of Section 5.(3)(a) of amending By-laws 1521/82 and 2495/87 to Zoning By-law 3036 to permit the establishment of a mail boxes etc. facility, which would include mail boxes for rent, courier service, photocopying and ........ parcelling; whereas the amending By-laws permit neighbourhood stores, personal service shops and professional offices. Approval of this variance application is required in order to allow a mail boxes etc. facility operation on the site. A mail boxes etc. facility is not a use which is expressly permitted by the zoning by-law; the applicant requests that the definition of neighbourhood stores, personal service shops or professional offices be interpreted to permit a mail boxes etc. facility. The property is currently subject of a rezoning application to permit additional uses on the subject property. 44 .... '-' -- This application, PICA 41/95 - Steel Valley Group, was WITHDRAWN at the request of the applicant. 8.
