MATTERS ARISING AND ADOPTION OF MINUTES - MOTION: Moved by Bill Utton seconded by Marie Billinger There were no matters arising from the minutes. The minutes of the 2nd meeting of the Committee of Adjustment held Wednesday, February 1,2006, be adopted. CARRIED UNANIMOUSLY 2. ADOPTION OF AGENDA MOTION: Moved by Marie Billinger seconded by Bill Utton That the agenda for the Wednesday, February 22,2006 meeting be adopted. CARRIED UNANIMOUSLY 11 3. (Tabled at the February 1, 2006 meeting) PICA 06/06 to PICA 23/06 - 2047729 Ontario Inc. 1355 Altona Road (Part of Lot 1 & 2, Plan 228) City of Pickering MOTION: Moved by Bill Utton seconded by Marie Billinger That PICA 06/06 to PICA 23/06 - 2047729 Ontario Inc. be lifted from the table. CARRIED UNANIMOUSLY The applicant requests relief from the provIsions of Zoning By-law 3036, as amended by By-law 2658/88, to permit the development of 18 freehold townhouse dwelling units on the subject property. The proposed development is comprised of lots that will front onto a private condominium road; whereas the by-law requires all lots to provide frontage on an opened public street maintained at public expense. The applicant also requests that the lot frontage, lot area, front yard depth, rear yard depth, side yard width, flankage side yard width, and lot coverage of some or all of the lots be reduced; whereas the by-law requires minimum andlor maximum zoning requirements to be met as shown on the chart below. - The applicant requests approval of these variances in order to satisfy conditions of Draft Plan Approval, Site Plan Approval and in order to obtain building permits in the future for the subject property. Written comments were received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Written comments were also received from the Toronto and Region Conservation Authority with no objections. John Perdue, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. Correspondence was received from John Perdue requesting the applications be tabled to revise the applications to add a variance for the rear yard setback. MOTION: Moved by David Johnson seconded by Bill Utton That application PICA 06/06 to PICA 23/06 by 2047729 Ontario Inc., be TABLED as requested by the applicant to allow time to make revisions to the applications and recirculation of Notice. CARRIED UNANIMOUSLY 13 Eric Newton joined meeting at 7:05 pm 4. PICA 24/06 - Jesse Gray 699 - 703 Front Road (Part of Lot 55, Plan M-90) City of Pickering The applicant requests relief from the provisions of Zoning By-law 2511, to permit the existing dwelling to remain on a lot that is proposed to be divided into three lots providing an insufficient front yard depth of 0.0 metre to a covered front porch (existing condition) and an insufficient north side yard width of 0.7 metre; whereas the By-law requires a minimum front yard depth of 7.5 metres and a minimum side yard width of 1.5 metres in this instance. The applicant requests approval of the variance for insufficient north side yard width in association with Land Severance applications recently submitted to the Land Division Committee to sever two residential parcels from the subject property (Region of Durham File LD 271/05 and LD 272/05). The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Chief Building Official expressing a concern with the variance for a 0.7 metre side yard depth would contravene the Ontario Building Code requirements, and the City's Development Control Supervisor indicating a grading and drainage plan will be required for the land severance application. Written comments were also received from Rhonda & Bradford Pollard expressing no concerns and in favour of the application. Lee Gray, agent, was present to represent the application. MOTION: Moved by Bill Utton seconded by David Johnson That application PICA 24/06 by Jesse Gray, be APPROVED on the grounds that the variance to permit an insufficient front yard depth of 0.0 metre to the covered front porch of the existing dwelling is a minor variance that is desirable for the appropriate development of the subject lands, in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That the variance applies only to the existing covered front porch, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant enters into an encroachment agreement with the City to permit the existing covered front porch to remain on the municipal boulevard within one year of the date of this decision, or this decision shall become null and void. 14 And - that the variance to permit an insufficient north side yard width of 0.7 metre be REFUSED on the grounds that this is a major variance that is not desirable for the appropriate development of the subject lands, is not in keeping with general intent and purpose of the Zoning By-law. CARRIED UNANIMOUSLY 5. PICA 25/06 - Gail Skidmore 1808 Wood view Avenue (Part of Lot 4, Plan M-282) City of Pickering The applicant requests relief from the provision of Zoning By-law 3036, to permit the existing dwelling to remain temporarily on a lot that is proposed to be divided into two lots that will result in insufficient north side yard width of 0.6 metre; whereas the By-law requires a minimum side yard setback of 1.5 metres. The applicant requests approval of the variance to facilitate a future Land Severance application. - The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor indicating the roof drainage will need to be addressed prior to land severance. No representation was present in favour of or in objection to the application. MOTION: Moved by Marie Billinger seconded by David Johnson That application PICA 25/06 by Gail Skidmore, be TABLED to allow the owner or agent to be present for the decision. CARRIED UNANIMOUSLY 6. ADJOURNMENT MOTION: Moved by Bill Utton seconded by Eric Newton That the 3rd meeting of the Committee of Adjustment be adjourned at 7:11 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, March 15, 2006.
