Johnson T.J. Quinn - Vacation - Chief Administrative Officer (Medical Leave) (i) INVOCATION Mayor Ryan called the meeting to order and led Council in the saying of the Invocation. (11) Councillor ADOPTION OF MINUTES Special Meeting of November 9, 2004 Regular Meeting of November 15, 2004 Brenner declared an interest November 9, 2004 in the Special Meeting Minutes of -1- PICKERING Council Meeting Minutes Monday, December 6, 2004 7:30 PM (111) 1. DELEGATIONS John Wager, representing Greenwood & Area Ratepayers Association (GAP, A) addressed Council concerning the Draft Greenbelt Plan. In support of the Province's draft Greenbelt Plan, Mr. Wager provided the City with a copy of the Picketing Official Plan, Greenwood & Area Ratepayers Association Greenbelt Task Force Submission, a copy of the Provincial Greenbelt Draft Plan and the Greenwood Community Survey. GARA's positions that Greenwood (all of it) should be included in the greenbelt area. This position has remained unchanged throughout the study and has support of the majority of its members. There are very sound reasons to include this area in the greenbelt lands, Duffins Creek runs through the heart of the community, the museum is situated in Greenwood, this area was the shoreline for Lake Iroquois. The Planning and Development Report PD 47-04 came as a complete shock to GAP, A, excluding 25 lots in Greenwood. GARA feels the staff report ignores the City's Official Plan, the citizen's desires and the Greenbelt Plan. The Association .'supports small growth but not moderate. He stated that they would be willing to live with the constraints as anticipated from the Province assuming it would be like the Oak Ridges Moraine. Jeanette Wiles, 3475 Greenwood Road, advised that she is a member of the Board of Directors for the Greenwood & Area Ratepayers (GARA), but is speaking as a resident. She adviSed that she has not had an opportunity to go through the details of the report therefore, is relying on the comments of the members of GARA, and is disappointment with what is stated in the report. She understands there is a risk in requesting to be included in the greenbelt area but with the speed by which these types of activities proceed, she would prefer to take the dsk rather than the alternative. She was under the impression that the whole of the Hamlet was to be included. (IV) RESOLUTIONS Resolution #156104 Moved by Councillor Brenner Seconded by Councillor Pickles That the Report of the Executive Committee EC 2004-19, Appendix II, dated November 22, 2004, be adopted. CARRIED -2- Council Meeting Minutes Monday, December 6, 2004 7:30 PM Resolution #157/04 Moved by Councillor Ashe Seconded by Councillor Pickles That Picketing Council RECEIVE Report PD 47-04 as i[ts comments on the provincial Draft Greenbelt Plan, dated October 2004, EBR Registry Number: PF04E0006; and 2. That Pickering Council ADVISE the Minister of Municipal Affairs and Housing; (a) That Pickering Council continues to support the concept of a permanent greenbelt in the Golden Horseshoe; and (b) That the southern part of the Agricultural Assembly (the Cherrywood community) be excluded from the greenbelt Plan and that lands east of the Hamlet of Whitevale be added; and (c) That the other Greenbelt land use and boundary issues be addressed to: i) delete the Protected Countryside designation from the Rouge Park Neighbourhood, which is within Pickering's existing urban area as identified in the City and Regional Official Plans; and ii) delete the Protected Countryside designation from all of the residential lots approved in Registered Plans of Subdivision along the edge of the Rouge River, south of the Rouge Park neighbourhood to Lake Ontario; (d)That the approval of the draft Greenbelt Plan should be delayed until such time as municipalities and other stakeholders have had an opportunity to review the Ministry's supporting documentation; and (e)That the draft Greenbelt Plan for the Golden Horseshoe as well as other provincial initiatives such as the Planning Act reforrn are released as a comprehensive package for further consultation; and (f) That further examination is required, in consultation with all affected communities, respecting: i)the boundary and rationale for inclusion of hamlets and other rural settlements in the Greenbelt; and ii)the boundaries, extent and rationale of proposed greenbelt and non- greenbelt lands in the northeast sector of Pickering. -3- Council Meeting Minutes Monday, December 6, 2004 7:30 PM That Picketing Council authorize City staff to continue to review and provide technical comments on the draft Greenbelt Plan to the Province after the deadline date of December 12, 2004 to address the issues; and That the City Clerk FORWARD a copy of Report PD 47-04 to the Minister of Municipal Affairs and Housing; the Minister of Public Infrastructure Renewal; the Region of Durham; Durham Region Area Municipalities; the Town of Markham; the Region of York and the Toronto and Region Conservation Authority. CARRIED AS AMENDED Recorded Vote on 2(b) Yes: Councillor Brenner, McLean, Pickles and Mayor Ryan No: Councillors Ashe and Dickerson Absent: Councillor Johnson Council considered the following motion in conjunction with the above resolution: Resolution #157104(a) Moved by Councillor Pickles Seconded by Councillor Brenner That Section 2(c), be amended by deleting reference to Sections 3.0 and 5.0 and replacing with: i) delete the Protected Countryside designation from the Rouge Park Neighbourhood, which is within Pickering's existing urban area as identified in the City and Regional Official Plans; and ii) delete the Protected Countryside designation from all of the residential lots approved in Registered Plans of Subdivision along the edge of the Rouge River, south of the Rouge Park neighbourhood to Lake Ontario, and That Section 5 be amended by deleting reference to Sections 3.0 and 5.0. CARRIED Resolution #157/04(c) Moved by Councillor Brenner Seconded by Councillor McLean That Section 1, of the above resolution be amended by deleting "and ENDORSE". CARRIED Resolution #157104(d) Moved by Councillor Dickerson Seconded by Councillor Brenner That the above resolution be divided by removing 2(b). CARRIED Resolution #158/04 Moved by Councillor Brenner Seconded by Councillor McLean 1. That Report CAO 06-04 concerning the Region Analysis, be received; and of Durham Business Case -5- HCKHedNG Council Meeting Minutes Monday, December 6, 2004 7:30 PM That Council advise the Region of Durham that the City of Pickering Operations Centre is the physical asset of Picketing and is not to be considered, in whole or in part, for transfer to the Region of Durham; and That Council request the Region of Durham to provide a further report on cost sharing and unfunded liabilities to be forwarded to the local municipalities for review and comment; and That the Region maintain the existing level of "GO" funding to the local municipalities at the 2004 funding level for the 2005 Operating year to ensure the viability of the existing local transit operations until transfer to the Region in 2006; and That the sharing of Regional Transit costs be based on the traditional funding model of using 100 percent equalized assessment that is used for other Regional services; and 6. That copies of this resolution be forwarded to other Durham municipalities. CARRIED Resolution #159104 Moved by Councillor Brenner Seconded by Councillor McLean WHEREAS the voter turnout across Canada has been steadily decreasing over the years at Federal, Provincial and Municipal elections; and WHEREAS young people have expressed that they do not feel engaged in the electoral process; and WHEREAS young people have a good knowledge of the electoral process and the way the three levels of government operate through school programs that start in the early grades; and WHEREAS a lowering of the voting age from eighteen to sixteen will have the advantage of reinforcing a pattern of voter participation that will stay with our youth throughout life; and WHEREAS the Member of Parliament for Ajax-Pickering, Mark Holland, has introduced Bill C-261 that if enacted would have the effect of lowering the voting age for Federal elections to sixteen while at the same time ensuring that a candidate must be at least eighteen years of age; -6- Council Meeting Minutes Monday, December 6, 2004 7:30 PM NOW THEREFORE the Council of the Corporation of the City of Pickering hereby states its support for Bill C-261 to lower the voting age from eighteen to sixteen at the Federal level; and FURTHER THAT the Legislature of the Province of Ontario be requested to amend the Elections Act, which governs Provincial elections and the Municipal Elections Act, 1996 which governs Municipal elections to lower the voting age from eighteen to sixteen; and FURTHER THAT this resolution be forwarded to: · The Right Honourable Paul Martin, Prime Minister of Canada · Mark Holland, MP, Ajax-Pickering · Dan McTeague, MP, Pickedng-Scarbomugh East · The Honoumble Dalton McGuinty, Premier of Ontario · The Honoumble John Gerretsen, Minister of Municipal Affairs & Housing · The Association of Municipalities of Ontario · Federation of Canadian Municipalities · All Ontario Municipalities · The Honourable Michael Bryant, Minister Responsible for Democratic Renewal · Wayne Arthurs, MPP, Pickering-Ajax-Uxbridge CARRIED Recorded Vote: Yes: Councillors Ashe, Brenner, Dickerson, McLean, Pickles and Mayor Ryan Absent: Councillor Johnson (V) BY-LAWS That Councillor Brenner, seconded by Councillor Ashe, took leave to introduce by-laws of the City of Pickering: By-law Number 6407/04 Being a by-law to dedicate that part of Lot 28, Range 3, Broken Front Concession, Pickering, designated as Part 12, Plan 40R-22824 as public highway and name it "Delta Boulevard". -7- I ICKERIN Council Meeting Minutes Monday, December 6, 2004 7:30 PM By-law Number 6408/04 Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation - 1555 Finch Ave., 1865 Kingston Road and St. Martin's Anglican Church, 1203 St. Martin's Ddve.) CARRIED THIRD READING: Councillor Brenner, seconded by Councillor Ashe, moved that By-law Numbers 6407/04 and 6408/04, be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED Councillor Dickerson sought an explanation concerning the spending authority and accountability of internal renovations. (VII) CONFIRMATION BY-LAW By-law Number 6409~04 Councillor Dickerson, seconded by Councillor Brenner, moved for' leave to introduce a By-law of the City of Picketing to confirm those proceedings of the Council of The Corporation of the City of Pickering at its Regular Meeting of December 6, 2004. DATED CITY CLERK -9- Appendix II Executive Committee Report EC 2004-19 That the Executive Committee of the City of Pickering having met on November 22, 2004, presents its nineteenth report to Council and recommends: CORPORATE SERVICES REPORT CS 48-04 2005 INTERIM SPENDING AUTHORITY That Report CS 48-04 from the Director, Corporate Services & Treasurer, concerning 2005 Interim Spending Authority, be received; and That the 2005 Interim Operating Expenditures be approved at 50% of the prior years' budget including exceptions as contained in Attachment I, pending approval of the formal 2005 Current Budgets by Council; and That the Treasurer be authorized to transfer to the Ajax Pickering Transit Authority (APTA) a maximum of 50% of APTA (City of Pickering's share) prior years budget, pending approval of the formal APTA 2005 Current Budgets by Council; and That the appropriate City of Pickering officials be authorized to take the necessary actions to give effect thereto.
