PRESENT: Marie Billinger Chris Braney David Johnson Eric Newton ALSO PRESEN~ Ross Pym, Assistant Secretary-Treasurer Flora Niro, Secretary-Treasurer ABSENT: Bill Utton The meeting convened at 7:00 p.m. in the Main Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by David Johnson, seconded by Marie Billinger That the minutes of the 9th meeting of the Committee of Adjustment held Wednesday, July 7, 2004, be adopted. CARRIED UNANIMOUSLY 3. ADOPTION OF AGENDA MOTION: Moved by Marie Billinger, seconded by Chris Braney That the agenda for the July 28, 2004 meeting be adopted. CARRIED UNANIMOUSLY 56 (Tabled from the July 7, 2004 meeting) P/CA 39/04 - S. Gnanasekaram 2372 Denvale Drive Lot 58, Plan 40M-1512 City of Pickering MOTION: Moved by David Johnson, seconded by Marie Billinger That Minor Variance Application P/CA 39~04, by S. Gnanasekaram, be lifted from the table. MOTION CARRIED No one was present to represent the application. Eric Newton acknowledged a letter received from John Kewell of Lifestyle Sunrooms requesting that the application be tabled until the August 18, 2004 meeting. MOTION: Moved by Marie Billinger, seconded by Chris Braney That Minor Variance Application P/CA 39~04, by S. Gnanasekaram, be tabled to the August 18, 2004 meeting. MOTION CARRIED P/CA 4~04 - R. & C. Lennox 3880 Kinsale Road South Part of Lot 3, Concession 6 (Part 1, Plan 40R-4773) City of Pickering The applicant requests relief from Section 6.2.2 of Zoning By-law 3037, to permit the establishment of a minimum 20 metre lot frontage provided by the proposed retained parcel on the subject property, whereas the by-law requires a minimum lot frontage of 150 metres. The applicant requests approval of this variance in order to facilitate proposed severances. 57 The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Comments were received from the City's Development Control Supervisor expressing no concerns and from Rick Johnson, Regional Councillor - Ward 3, in support of the application. Written comments were received from Central Lake Ontario Conservation Authority expressing no objections, however, site is subject to Ontario Regulation 145/90. Written comments were received from the Durham Region Health Department expressing no objections. There was no one present to represent the application. Laura Orlandi of 3840 Kinsale Road and her parents were present for information purposes. Ms. Orlandi inquired as to the zoning and future development of the subject property. Mr. Pym outlined the reasons for the variance and the applicants' intent with the subject lands. DECISION: Moved by Chris Braney, seconded by David Johnson That Minor Variance Application P/CA 4/04 by R. & C. Lennox be APPROVED on the grounds that the proposed establishment of a minimum 20 metre lot frontage provided by the proposed retained parcel on the subject property is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That this variance apply only to the proposed lot, as generally sited and outlined on the applicants' submitted plans with this application. 2. That the applicant receive approval and finalize associated Land Severance Applications LD 11/04 & LD 12104 or this decision shall become null and void. CARRIED UNANIMOUSLY 6. ADJOURNMENT MOTION: Moved by Marie Billinger, seconded by Chris Braney That the 10th meeting of the Committee of Adjustment be adjourned at 7:12 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, August 18, 2004.
