PRESENT: Marie Billinger Chris Braney David Johnson Eric Newton Bill Utton ALSO PRESENT: Ross Pym, Assistant Secretary-Treasurer Flora Niro, Secretary-Treasurer The meeting convened at 7:07 p.m. in the Main Committee Room of the Civic Complex. 1. APPOINTMENT OF CHAIRPERSON MOTION: Moved by Bill Utton, seconded by Marie Billinger and CARRIED unanimously that Eric Newton be appointed as Chairperson for a 1 year term. MOTION CARRIED 2. APPOINTMENT OF VICE CHAIRPERSON MOTION: Moved by Eric Newton, seconded by Chris Braney and CARRIED unanimously that Marie Billinger be appointed as Vice Chairperson for a 1 year term. MOTION CARRIED 1 3. APPOINTMENT OF SECRETARY-TREASURER MOTION: Moved by David Johnson, seconded by Bill Utton and CARRIED unanimously that Flora Niro be appointed as Secretary-Treasurer for a 3 year term. MOTION CARRIED 4. APPOINTMENT OF ASSISTANT SECRETARY-TREASURER MOTION: Moved by Marie Billinger, seconded by Bill Utton and CARRIED unanimously that Ross Pym be appointed as Assistant Secretary-Treasurer for a 3 year term. MOTION CARRIED 5. ADOPTION OF RULES OF PROCEDURE MOTION: Moved by Bill Utton, seconded by Marie Billinger and CARRIED unanimously that the Rules of Procedure for the Committee of Adjustment be adopted as amended. MOTION CARRIED 6. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 7. ADOPTION OF MINUTES MOTION: Moved by Bill Utton, seconded by Marie Billinger and CARRIED unanimously that the minutes of the 14th meeting of the Committee of Adjustment held Wednesday, November 26, 2003, be adopted. MOTION CARRIED 8. ADOPTION OF AGENDA MOTION: Moved by Marie Billinger, seconded by Bill Utton and CARRIED unanimously that the agenda for the January 21, 2004 meeting be adopted. MOTION CARRIED 2 9. PICA 1/04 - J. & S. Renaud 612 Chartwell Court Lot 26, Pian 40M-1341 City of Pickering The applicants request relief from Section 5(2)(f) of Zoning By-law 3036, as amended by By-law 1939/84, to permit the establishment of a minimum 5.6 metre rear yard depth to be provided by the proposed sunroom addition, whereas the by-law requires a minimum rear yard depth of 7.5 metres. The applicants request approval of this variance in order to obtain a building permit for a proposed sunroom addition attached to the rear of the existing dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Kevin Ashe - Ward 1, City Councillor provided written comments that he is in support of the application. Ken Faber, agent, and owners R. & J. Renaud were present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Faber stated that he concurred with Staff's recommendation. DECISION: Moved by Bill Utton, seconded by David Johnson and CARRIED unanimously that - Application PICA 1/04 by J. & S. Renaud, be APPROVED on the grounds that the proposed 5.6 metre rear yard depth to be provided by the proposed sunroom addition is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law subject to the following conditions: 1. That this variance apply only to the proposed sunroom addition, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the proposed addition within two years of the date of this decision, or this decision shall become null and void. 3 10. PICA 2/04 & PICA 3/04 - B. & M. Vidinovski 1035/1051 Brock Road South Part of Lot 18, Concession 1 City of Pickering The applicant requests relief from Section 5(1 )(b)(iv)B of Zoning By-law 2511, as amended by By-law 3893/91, to permit the establishment of a total of 27 parking spaces to be provided on the proposed severed parcel (application PICA 2/04), to permit the establishment of a total of 43 parking spaces to be provided on the proposed retained parcel (application PICA 3/04), whereas the by-law requires a minimum of 70 parking spaces on the lot. The applicant requests approval of these variances in order to facilitate proposed severances. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Mr. Vidinovski, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. DECISION: Moved by Bill Utton, seconded by Chris Braney and CARRIED unanimously that - Application PICA 2/04 & PICA 3/04 by B. & M. Vidinovski, be APPROVED on the grounds that the proposed establishment of a total of 27 parking spaces to be provided on the proposed severed parcel (application PICA 2/04), and proposed establishment of a total of 43 parking spaces to be provided on the proposed retained parcel (application PICA 3/04), are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law subject to the following condition: 1. That the applicant finalize associated Land Severance Application LD 107/03, or this decision shall become null and void. 4 11. PICA 5/04 - R. & J. Griffin 942 Mountcastle Crescent Part Lot 38, Plan 40M-1415 (Part 1, Plan 40R-1 0661) City of Pickering The applicants request relief from Section 5(3)(b)(vi) of Zoning By-law 3036, as amended by By-law 1998/85, to permit the establishment of a minimum 6.5 metre rear yard depth to be provided by the proposed sunroom addition, whereas the by-law requires a minimum rear yard depth of 7.5 metres. The applicants request approval of this variance in order to obtain a building permit for a proposed sunroom addition attached to the rear of the existing dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. John Kewell of Lifestyle Sunrooms was present to represent the application. No further representation was present in favour of or in objection to the application. DECISION: Moved by Marie Billinger, seconded by Bill Utton and CARRIED unanimously that - Application PICA 5/04 by R. & J. Griffin, be APPROVED on the grounds that the proposed 6.5 metre rear yard depth to be provided by the proposed sun room addition is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law subject to the following conditions: 1. That this variance apply only to the proposed sunroom addition, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the proposed addition within two years of the date of this decision, or this decision shall become null and void. 5 12. PICA 7/04 - T. & E. Josevski 3295 Sideline 8 South Part of Lot 8, Concession 5 City of Pickering To permit the enlargement and extension of a legal non-conforming residential use on the subject property, whereas the by-law states that pits, quarries and agricultural uses are the only permitted uses on the subject property. The applicants request that the Committee allow the enlargement and extension of the legal non-conforming residential use in order to obtain a building permit for the construction of an addition, totaling approximately 235 square metres, to the existing detached dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. David McKay, agent, and Tony Josevski, owner, were present to represent the application. No further representation was present in favour of or in objection to the application. DECISION: Moved by Chris Braney, seconded by Bill Utton and CARRIED unanimously that - Application PICA 7/04 by T. & E. Josevski, be APPROVED on the grounds that the proposed enlargement and extension of a legal non-conforming residential use on the subject property is desirable for the appropriate development of the land, subject to the following conditions: 1. That the enlargement and extension of a legal non-conforming residential use apply only to the proposed addition, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the proposed addition within two years of the date of this decision, or this decision shall become null and void. 6 13. PICA 8/04 - 1441483 Ontario Inc. 1641 Goldenridge Road Part of Lot 55, Plan 1051 (Part 6, Plan 40R-21831) City of Pickering The applicant requests relief from Section 5(1 )(b)(iv)A of Zoning By-law 3036, as amended by By-laws 6027/02 and 6113/03 to permit the continuance of a minimum 0.3 of a metre south side yard width provided by the existing dwelling on the subject property, whereas the by-law requires a minimum side yard width of 1.2 metres on one side and 0.6 metres on the other side. The applicant requests approval of this variance in order to maintain the reduced south side yard width provided by the existing dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Ian McCullough of Marshall Homes was present to represent the application. No further representation was present in favour of or in objection to the application. DECISION: Moved by Bill Utton, seconded by Marie Billinger and CARRIED unanimously that - Application PICA 8/04 by 1441483 Ontario Inc., be APPROVED on the grounds that the proposed continuance of a minimum 0.3 of a metre south side yard width provided by the existing dwelling on the subject property is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following condition: 1. That this variance apply only to the existing dwelling, as generally sited and outlined on the applicant's submitted plans with this application. 7 14. ADJOURNMENT MOTION: Moved by Marie Billinger, seconded by Bill Utton and CARRIED unanimously that- The 1st meeting of the Committee of Adjustment be adjourned at 7:30 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, February 11, 2004.
