PRESENT: Marie Billinger (Acting Chairperson) Tom Mohr Eric Newton ALSO PRESENT: Ross Pym, Assistant Secretary-Treasurer Flora Niro, Secretary-Treasurer ABSENT: Kevin Ashe Carl Young The meeting convened at 7:07 p.m. in the Main Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Tom Mohr, seconded by Eric Newton and CARRIED unanimously, that the minutes of the 13th meeting of the Committee of Adjustment held Wednesday, November 5, 2003, be adopted. MOTION CARRiED 3. ADOPTION OF AGENDA MOTION: Moved by Eric Newton, seconded by Tom Mohr and CARRIED unanimously that the agenda for the November 26, 2003 meeting be adopted. MOTION CARRIED 90 4. ADOPTION OF 2004 MEETING SCHEDULE MOTION: Moved by Tom Mohr, seconded by Eric Newton and CARRIED unanimously that the Committee of Adjustment Meeting Schedule for 2004 be adopted. MOTION CARRIED 5. PICA 54/03 - N. & D. Francis 1992 Valley Farm Road Lot 18, Plan M-1079 City of Pickering The applicant requests relief from Provision 2 of Schedule "B" of Zoning By-law 3036, as amended by By-law 230/75, to permit the establishment of a maximum lot coverage of 38% to be provided by the existing dwelling and proposed sunroom addition on the subject property, whereas the by-law permits a maximum lot coverage of 33%. The applicant requests approval of this variance in order to obtain a building permit for a proposed sunroom addition to the existing dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Fire Prevention Officer expressing no concerns. lance Ingleton, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Ingleton advised the members that he is ready to proceed with construction and that the sunroom addition would not impose on any property lines. DECISION: Moved by Tom Mohr, seconded by Eric Newton and CARRIED unanimously that - Application PICA 54/03 by N. & D. Francis, be APPROVED on the grounds that the proposed establishment of a maximum lot coverage of 38% to be provided by the existing dwelling and proposed sunroom addition is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 91 1. That this variance apply only to the proposed sunroom addition, approximately 9.4 metres by 4.6 metres in size, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the sunroom addition within two years of the date of this decision, or this decision shall become null and void. 6. PICA 55/03 - 2030606 Ontario Inc. 526 Rosebank Road lot 88, Plan 350 City of Pickering The applicant requests relief from the following provisions of Zoning By-law 2511: Section 10.2.3 to permit the establishment of a minimum 5.1 metre rear yard depth to be provided by the existing dwelling on the proposed severed lands, whereas the by-law requires a minimum rear yard depth of 7.5 metres. Section 6.6(a) to permit the continuance of a minimum 2.8 metre flankage side yard width to be provided by the existing dwelling on the proposed severed lands, whereas the by-law requires a minimum flankage side yard width of 4.5 metres. The applicant requests approval of these variances in order to facilitate proposed severances. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Fire Prevention Officer expressing no concerns. Ross Pym advised the Committee that the applicant concurred with Staff's recommendation to table the item and will therefore not be attending the meeting. No representation was present. John Honsberger of 588 Maitland Drive, Jim Bradley of 596 Maitland Drive, and Mr. Spinosa, on behalf of his father, were all present in objection to the application. John Honsberger and Jim Bradley provided a petition signed by 10 area residents opposing the application. They expressed concerns with increased volume of traffic, the variances adversely affecting the character of the neighbourhood and negatively impacting on property values. Mr. Spinosa concurred with Staff's recommendation that the application is premature. He asked that the Committee determine what the applicant proposes to do with the remaining lands before making a decision. 92 MOTION: Moved by Eric Newton, seconded by Tom Mohr and CARRIED unanimously that - Application PICA 55/03 by 2030606 Ontario Inc., be TABLED on the grounds that the proposed establishment of a minimum 5.1 metre rear yard depth and continuance of a minimum 2.8 metre flankage side yard width to be provided by the existing dwelling on the proposed lot is an application that is premature. MOTION CARRIED 7. OTHER BUSINESS On behalf of all members, Marie Billinger thanked the Assistant Secretary-Treasurer and Secretary-Treasurer for their contribution and excellent presentation provided to the Committee during the term. Marie also extended her thanks to all Committee members and said that it was a pleasure serving the Committee. 8. ADJOURNMENT MOTION: Moved by Eric Newton, seconded by Tom Mohr and CARRIED unanimously that- The 14th meeting of the Committee of Adjustment be adjourned at 7:25 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, January 21, 2004.
