REPEAt r.D BY REPEALS _ AMENDED BY - AMENDS DISPOSITION THE CiJRPORhTIDN THE TOM' OF PICKERING BY-i-?i'rd IMBER -t C?'' 7_7 Being a By-law of the Corporation of the Town of Pickering to authorize the execution of an agreement between the Corporation and Jock 'Shields with respect to the demolition of certain buildings. THE COUNCIL OF THE CORPORATION OF THE TOWN, OF PICKERING HEREBY ENACTS AS FOLLOWS; i I 1. The Mayor and Clerk he authorized to execute C an agreement between the Corporation of the E Town of Pickering and Jock Shields with respect to the demolition of certain buildings for ultimate use by the Pickering Museum. OF PICKERTN hereinafter called the "Torn" tE E OF THE SECOND PART wITNESSE`T'H that, in consideration of the .utual covenants and agreements herein contained and subject to the ter-,s and con- }a ditions hereinafter set out, the parties, hereto agree as follows: Ii 1. Shields agrees to tear down or der..oiish the barn a.d shed owner by the Town situate lying and being i j i I 1 i i i I i i i 'k a 2. (a) Shields further agrees to remove all existing nails. from all salvagable materials and to deliver and stock all such salvagable materials at I I (b) Shields shall be the sole judge of what m ter.ials ?? from the barn and shed shall be salvagable. 3. It is expressly understood and agreed between the i parties that Shields stall not be regaired to demolish or to remove any cement or stone foundations. 4. Shields agrees to complete the said work within ninety (90) davs and provided that in the event that the work is delayed by reason of contingencies over ?•rhich Shields has no control, an extension will be granted by the mown. 5. The Town agrees to pay to Shields the sus.. of Pour Thousand, Two Hundred Dollars ($4,200.00) for the said cork, as follows: (i) One-half upon the Building Inspector for the Town confirming that one-half of the said worst has been completed; and (ii) The remaining one-half on completion of the work. 2 i fie The Tc :-rn agrees to pa,- for all c ::edition permits which may be required. 7. Shieids agrees to indem;ify and save harmless the Team from any costs, or damages resulting from any loss, damage or injury (including loss of life) to any person or property- of an%, kind occurring as a result of the tearing down or demolition of the barn and shed referred to in Section 1, however such loss, j damage or injury may occur.
