Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended by By-law 2498/87, to implement the Official Plan of the City of Pickering, Region of Durham, Lot 40, Plan 1051, City of Pickering. (A 10/02) WHEREAS the Council of the Corporation of the City of Pickering deems it desirable to change the zoning of the lands to permit additional retail and commercial uses on the subject property, being Lot 40, Plan 1051, City of Pickering; AND WHEREAS an amendment to By-law 3036, as amended by By-law 2498/87, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: TEXT AMENDMENT Section 5. PROVISIONS of By-law 2498/87, is hereby further amended by adding thereto the following: (5) (a) Uses Permitted ("SC-36" Zone) No person shall within the lands designated "SC-36" on Schedule 'T' attached hereto use any lot or erect, alter or use any building or structure for any purpose except the following: (i) (ii) (iii) (iv) (v) (vi) (vii) (viii) (ix) (x) bakery business office commercial school dry cleaning depot financial institution laundromat personal service shop professional office restaurant- type A [subject to Section (5)(c)] retail store (5) (b) Zone Requirements ("SC-36" Zone) No person shall with the lands designated "SC-36" on Schedule "1" attached hereto, use any lot or erect, alter or use any building or structure except in accordance with the following provisions: (i) FRONT YARD DEPTH (minimum): A For the purpose of this by-law, Old Kingston Road shall be deemed to be the front lot line. B 4.5 metres (ii) REAR YARD DEPTH (minimum): 0.5 metres (iii) INTERIOR SIDE YARD WIDTH (minimum): 0.5 metres -2- (iv) FLANKAGE SIDE YARD WIDTH (minimum): 3.5 metres (v) BUILDING HEIGHT (maximum): 10 metres (vi) OPEN STORAGE: no open storage shall be permitted in any yard (vii) PARKING REQUIREMENTS: A There shall be provided and maintained on the lands designated "SC-36" on Schedule "1" attached hereto, a minimum of 12 parking spaces for business office and professional office uses. B There shall be provided and maintained on the lands designated "SC-36" on Schedule 'T' attached hereto, a minimum of 16 parking spaces for all other permitted uses. C Sections 5.21.2a) and 5.21.2b) of By-law 3036, as amended, shall not apply to the lands designated "SC-36" on Schedule 'T' attached hereto. D All parking areas shall be set back a minimum of 3.0 metres from all road allowances. E Notwithstanding Section 5.21.2g) of By-law 3036, as amended, all parking areas shall be surfaced with brick, asphalt or concrete, or any combination thereof. (5) (c) Special Regulations ("SC-36" Zone) Despite Section (5) (a) (ix), a restaurant - type A shall not include a drive-thru. (5) (d) Uses Permitted ("(H)" Holding Symbol) Despite the provisions of Section 5. (5) (a) of this By-law, while the "(H)" Holding Symbol is in place preceding the "SC-36" Zone designation as outlined on Schedule 'T' attached hereto, no person shall use any lands for any purpose other than business office and/or professional office. (5) (e) Removal of the "(H)" Holding Symbol Prior to an amendment to remove the "(H)" Holding Symbol preceding the "SC-36" Zone, on the area so zoned, the owner shall enter into an appropriate agreement with the City and receive site plan approval to address, such matters as, site function (access/egress, traffic aisles, parking locations), site improvements (landscaping, paved surfaces, road improvements), and stormwater management. 2. SCHEDULEI Schedule 'T' to By-law 2498/87, as amended by By-law 2923/88, is hereby further amended by adding thereto the zone designation "(H)" SC-36 as shown on Schedule 'T' attached hereto. -3- 3. BY-LAW 3036 By-law 3036, as amended by By-law 2498/87 and 2923/88, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Section 1 above and as it applies to the area set out in Schedule 'T' attached hereto. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3036. 4. EFFECTIVE DATE This By-law shall come into force in accordance with the provisions of the Planning Act.
