HomeMy WebLinkAboutBy-law 3494 TME CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW NUMBER ,. , ~,,o...o~.o BEING A BY-LAW TO AMEND BY-LAW NUMBER 3037, as amended; WHEREAS the Council of The Corporation of the Township of Pickerin~ deems it desirable to amend the provisions of By-law Number 303?, as amended; NOW THEREFORE, the Council of The Corporation of the Township of Piekerlng ENACTS AS FOLLOWS: A. TEXT AMENDMENTS 1. That Section 12.5.1 of By-law 3037 be and the same is hereby deleted and the following inserted therefore: 12.5.1 Gravel Pits (a) Lot Lines No Gravel Pit or Quarry operation shall be o~ened, established or maintained closer to any lot line than 50 feet in horizontal distance; (b) Abutting Creeks, Lakes or Rivers No Gravel Pit or Ouarry operation shall be conducted closer than 50 feet to any creek, lake or river; (c) Abutting Residential DwelXings or No aravel Pit or Quarry oper~tion shall be opened, established or maintained closer to any residential dwelling or residentially zoned land, than 200 feet in horizontal distance, but in no case shall the setback from the lot line be less than 50 feet in horizontal distance. (d) Caretaker's Residence Notwithstanding the provisions of Section 12.5,1(c), nothing shall prevent the erection of a caretaker's residence in accordance with Sections 12.3.3, 12.~.3, and 12.5.3; (e) Abutting The Rear of (i) a Residence, or (ii) Residentially Zoned Land If a tree screen, in accordance with Section 3(a) of By-law 3010; and an earthen berm having a minimum height of 10 feet; are provided on the required setback, then the setback may be reduced, but in no case shall the setback from the lot line be less than 50 fe~t in horizontal distance; - 2 . (f) Abutting The Flank of (i) a Residence, or (ii) Residentially Zoned Land If a t~ee screen, in accordance with Section 3(a) of By-law 3010; and an earthen berm having a minimum height of 15 feet; are provided on the required setback, then the setback may be reduced but in no case shall the setback from the lot line be less than 50 feet in horizontal~distance. B. SCHEDULE "A" AND"C" A~EN~MENTS._ 1. Schedules "A" and "C" of By-law Number 3037 as amended be and the same are hereby amended by altering the Rural Agricultural Zone 'A' designations in Lots 13~ 14, 15 and 16, Concession 5; to read Pit end Quarry Zone 'Q', as shown on Schedules "A" and "B" attached hereto, and described in Schedules "D" and "E" attached hereto, 2. Schedules "A" and "C" of By-law Number 3037 as amended be and the same are hereby amended by altering the Rural Ag~eultural Zone 'A' designation in Lot 22, Concession to read PiT ~nd Quarry Zone 'Q', as shown on Schedules "A" and "C" attached hereto~ and described in Schedule "F" attached hereto, C. That By-law Number 3037 be and the same is hereby repealed and amendad only to the extent necessary to give effect to the provisions of this By-law. D. No part of this By-law shall come into force without the approval of the Ontario Municipal Board, but subject to such approval, ~e By-law shall take effect from the day of passing thereof.
