WHEREAS it is not the intention of the municipality to require the constructi°n of fences in residentially zoned areas; and %~rIEREAS IT IS CONSIDERED DESI~LE that ~here fences are constructed, same should be re,blared with respect to height in order to maintain the amenities of the area and the free movement of light and arr. BE IT THEREFORE ENACTED THAT: 1. DEFINITIONS For the ~urpose of this by-law, the following meanings shall apply: a) 'Building Main: shall mean a building in which is conducted the principal uses of the lot on which it is sit~ated. In any residential zone, a building containing one or more dwellin~ units shall be deemed to be the main building of the lot on which it is situated~ b) 'Fence' shall mean any linear bp~rier erected or growing on a lot, 'Front Lot Line' shall mean the lot line that divides a lot from the street provided that in the case of a corner lot, the shorter lot line that abuts a stree~ shall be deemed ~o be the front lot line and the longer lot line that so abuts shall be deemed the flankage of the lot~ d) 'Main Front Wall' shall mean the wall of the main~ building, located nearest the front lot l~ne; ~,... 'Street' shall mean a public h!shway~r private ~ which affords a principle means of access to abutting lots~ f) 'Yard Front' shall mean a yard extending across the full width of the lot between the front lot line and the nearest wall of any maln building or structure on the lot~ S) 'Neight of Fence' shall mean the distance measured perpendicular from the level of the ground on which it is situated ~o the top of the fence; 2. SCOPE The provisions of this by-law shall a~ply to all streets within the Township of Picketing, the abutting lands of which are zoned for residential use~ except that this restriction shall not apply where such fence is contiguous to a non-resid~ntially zoned property~ 3. O~STRUCTION OF STI?~.F..~S No person shall place or maintain any fence ~ither permanently or temporarily on any street. 4. HEIGHT OF FENCE .- i~FCERiqAL LOTS a) The maximum heif~ht of any fence between the front wall of the main buildin~ and the street line for the full width of the lot shall be tkree (3) feet; b) The maximum height of any fence between the front wall of the main building and the rear lot line for the full width of the lot shall be six feet; /fin the case of corner lots where a portion of either or both of the flank or rear lot lines project nearer to the same street than the front wall of the next adjacent strucgure~ the maximum he!sbt of any f~nce in the front~ side or rear yard so projecting shall be ~ (~) f~t~ except as limited by the foresoing~ the maximum height of any fence shall be six (6) feet~ ~. DETE~NATION OF ~q~ ~DUGTION POI}~ In the case of variable setbacks or curved streets and standard building setbacks from the street line, one house normally projects fo~ard of its neighbour. In such instances the maximum fence height reduction point shall be: a) Where both lots have ~ellings erected, the point where a line joining the adjacent front corners of the abuttin~ houses intersects t!~ co~n side lot b) Where one lot is vacant~ the intersection, with the co~n side lot line, of a line joining the abuttinS co~er of the existing house to a point in the buildins front yard setback line of the adjacent lot distant fr~ the co,on side !og line the required side yard setback for any ~in bui!dins on said vacant lot ~ 7. ~CT~CTION OF ~TERI~S: No person shall use barbed wire in any co~ection with such fence or any de,ice designed for or capable of projecting an electrzc current through such fence.
