A BY-LAW TO ESTABLiSIt A ROAD ON THE REACt OF LOT NO. 20 IN THE FIRST
CONCESSION OF THE TOWNSIIIP OF PICKERING AND OTIIER PURPOSES THEREIN
MENTIONED.
~{EREAS the Corporation of the Township of Picketing is desirons of
establishing a road across a portion of the rear of Lot Number Twenty
in the First Concession of the Township of Picketing now ow~ed and
occupied by John McVey Lumsden;
AND W~[EREAS the establishment of said road would deprive the said
John McVey Lumsden of access to the waters of Duffin's Creek at that
place;
AND WTIEI{EAS it was arranEed and agreed by and between the sai~l
Corporation of Picketing and the said John McVey Lumsden that if the
said Corporation would erect and maintain a good and sufficient passage
way for cattle under the said road and pay the said Jolm McVey Lumsden
the sum of Forty Dollars for extra fencing and vest the original allow-
ance for road for which the herein mentioned road was established in
lieu thereof in the said John McVey Lumsden, his heirs and assigns,
then he the said John McVey Ltunsden would abandon any claim for further
compensation on account of the establishment of the said road as herein
de scribe d.
BE IT THER.EFORE ENACTED by the Council of tile Corporation of the Town-
ship of Picketing
THAT the road on rear of Lot Number Twenty in the First Concession of
the Township of Picketing as surveyed by John Shier Esq. P.L.S. and
described as follows, that is to say:
Commencing on the southerly limit of the original allowance for
road at the north east angle of the said Lot Number Twenty in the
First Concession and running thence south 46° W 7 chains and 28 links,
thence North 70o W 5 chains and 80 links more or less to the southerly
limit of the said original allowance for road the said road to be 75
links wide and the above described line to be the southerly lin~it
thereof be and the same is hereby established as a public highway.
AND BE IT FURTIIEH ENACTED THAT that certain portion of the original
allowance for road in rear of said Lot Number Twenty in said First
Concession for which the above described road is in lieu thereof and
which said portion is described as follows, that is to say:
Commencing on the southerly limit of the said original allowance
for road at the distance of 1 chain and 60 links on a course of S 74° W
8 chains and 20 links, thence N 70° West 1 chain and 70 links more or
less to the northerly limit of the said allowance for road, thence
N 74° E 11 chains and 50 links, thence S 46° W 2 chains and 15 links
more or less to the place of beginning be and the same is hereby vested
in John McVey Lumsden his heirs and assigns forever.
