HomeMy WebLinkAboutBy-law 3265 THE CORPORATION OF THE TOWNSHIP OF PICKERING A By-law of The Corporation of The Township of Pickering to close a portion of old Highway Number 2, lying west of Pairport Road W}tEREAS R.S.O. 1960, Chapter 249, Section 459, Sub- section 1, provides that a municipality may close a road allowance. AND WHEREAS that portion of old Highway Number 2, as described in Schedule "A" hereto attached is not being maintained as a public highway. AND WHEREAS the Corporation desires to deed said portion of old Highway Number 2 to abutting owners. NOW THEREFORE the Council of The Corporation of The Township of Pickering hereby enacts as follows: 1. The lands described in Schedule "A" attached hereto are hereby stopped up and closed as a public highway. 2. For purposes of illustration only attached hereto is a plan referred to as Schedule "B", showing the lands described in Schedule "A", coloured in red. 3. The stopping up and sale of all or any part of the soil and freehold of the stopped up highway shall be subject to the free, uninterrupted and unobstructed right of The Bell Telephone Company of Canada to operate, maintain, repair, replace, and add to its existing conduits, cables, manholes and other facilities on the stopped up part of the highway. READ A THIRD TIME AND FINALLY PASSED THIS l, / Clerk SCHEDULE "A" Attached and forming part of By-law Number PART OF LOT 27, RANGE 3, BROKEN FRONT CONCESSION (OLD HIGHWAY NO. 2) ALL A~D SINGULAR that certain parcel or tract of land and premises, situate, lying and being in the Township of Pickering, in the County of Ontario, Province of Ontario, being composed of part of Lot 27, in the 3rd Range of the Broken Front Con- cession of the said township, the said parcel being more part- icularly described as follows: ,PREMISING that the easterly limit of the said Lot 27 has a bearing of North 17© 11' West, and relating all bearings herein thereto, then COMMENCING at the point of intersection of the northerly limit of the old highway No. 2 as shown on Deposited Plan No. 31, on file in the Registry Office for the County of Ontario, with the said easterly limit of Lot 27, said point being distant southerly therealong twenty-six decimal four three feet (26.43') from the north-east angle thereof; THENCE South 54° 59' West, along the said northerly limit of the old Highway No. 2, three hundred and twenty-three decimal one six feet (323.16') to an iron bar planted at an angle therein: THENCE North 79° 15'30" East, along the southerly limit of Deposited Plan No. 745, on file in the Registry Office for the County of Ontario, two hundred and nine decimal two two feet (209.22') to an iron bar planted in the southerly limit of the old Highway No. 2 as shown on Deposited Plan No. 31; THENCE North 54© 59' East, along the last mentioned limit, one hundred and four decimal seven five feet (104.75') more or less to an iron bar planted in the easterly limit of the said Lot 27; THENCE North .17© 11' West, along the said easterly limit of Lot 27, ninety decimal three five feet (90.35') more or less to the POINT OF COMMENCEMENT.
