HomeMy WebLinkAboutBy-law 3245 THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW By-law of the Corporation of the Township of Pickering, authorizing the Reeve and Clerk to sign an agreement with the Township of Uxbridge relating to the Uxbridge Pickering Townline. BE IT ENACTED by the Municipal Council of the Township of Pickering that the Reeve and Clerk be, and they are hereby authorized to sign the attached agreement described as Schedule "A" to this by-law between the Township of Pickering and Township of Uxbridge relating to the maintenance of the Pickering Uxbridge Townline. Reeve SCHEDULE "A" BY-LAW THIS AGREE~.~NT made this 31~day of'~, A.D.19 ~6~, BETWEEN: ~HE COR]~RATIOD OF THE T~NSHIP OF PICKERI~.iG hereinafter called "PICKERING" of the First Part, -and- THE CORPORATION OF TI~ T~$~P O? UXBRIDGE hereinafter called "Uxbridge" of the Second Part, WHEREAS the Corporations are adjoining muni- cipalities and the Pickering-Uxbridge Townline is a high- way forming a boundary between them; AND WHEREAS the Corporations have agreed to the maintenance and repair of certain portions of the Pickering-Uxbridge Townline on the terms hereinafter set out. N~ T~{EREFOR~ THIS AGREEmeNT ~IT~SSETH; 1. The portions of Pickering-Uxbridge Townline for its whole width afI~ected b]~ this agreement are: a) Those portions of the Pickering-Uxbridge Townline firstly commencing at the ~Jest Townline between Markham Township and Pickering To~ship easterly to the Road Allowance between Concession Two and Three, To~ship of Uxbridge and; secondly comme~cing at the East Townline between Whitby Township and Picketing Township westerly for a distance of 0.6 miles~ and thirdly commencing at the Road Allowance between Concessions Six and Seven, Township of Uxbridge easterly for a distarce of 0.2 miles~ herein referred to as the Pickering Portion. b) that portion of the Pickering-Uxbridge Townline conmencing at the Road Allowance between Concessions Two and Three~ Township of Uxbridge easterly to the Road Allowance between Concessions Five and Six, Townshi9 of Uxbridge, herein referred to as the Uxbridge portion. Pickering and Uxbridge undertake and agree, one with the other, that during the term thereof Picketing will assume jurisdiction over, and will maintain and repair the Picketing portions of the boundary road and Uxbridge will assume Jurisdiction over, and will maintain and repair the Uxbridge portion of the boundary road and will indemnify and save harmless the other from any loss or damage arising from the want of repair of such portion. 3. During the term hereon, each Corporation is, with respect to the portion under its Jurisdiction, liable for any damages incurred by reason of neglect %0 maintain and keep the sane in repair, and the Corporation is relieved from all liability in respect of its maintenance nnd repair.. ~. The terms of this agreement shall be for a period of Ten Years commencing with the date of its registration in the appropriate Registry Office (or last date if required to be registered in more than one Registry Office) and the date of assumption of Jurisdiction shall be such date of registration. The p~rties agree that such registration shall be affected as soon as conven- iently may be after the due execution thereof. 5. If either Corporation or any Board or Commission acting under it requires to install amy municipal services on that portion under the Jurisdiction of the other it shall first give notice in writing to the other Corporation of the work to be done and sba:! arrange a mutually agreeable time for it to be done. It shall thereafter restore or replace the highway in the same condition it was -Page-3- prior to the installation of the servic es. For a period of six months after such work is completed the Corporation installing the work shall reimburse the Corporation under whose jurisdiction the portion of road is for any repair work required on the portion restored. In the event of emergency, the Corporation requiring the work to be done may cause emergency work only to be done without notice, but shall notify the party having jurisdiction ~er the highway as soon as practicable. 6.In the event that any portion of the said highway is assumed by the County of Ontario or other competent authority, the parties hereto shall, within a period of six months thereafter, renegotiate the terms of this Agree~uent to the end that an equitable division of responsibility of the respective portions be maintained failing which either party may on three months' notice to the other terminate this Agreement and thereupon the Jurisdiction over the road shall return to the party having jurisdiction prior to this Agreement being entered into. 7.IN ?~TNESS ~HEREOF the parties hereto have hereunto · affixed their respective Corporate Seals attested to by the hands of their proper officers in that behalf fully authorized.
