HomeMy WebLinkAboutBy-law 3148 TOWNSHIP OF PICKERING ~EING A BY-LAW TO REGULATE THE CONSTRUCTION OF CULVERTS UPON HIGHWAYS UNDER THE JURISDICTION OF THE TOWI~SHIP OF PICKERING, AND TO REPEAL BY-LAW NUMBER 2912. IT IS HEREBY ENACTED by the Municipal Council of the Township of Pickering, that: 1. No person shall construct or cause to be constructed a culvert upon any highway under the jurisdiction of the Township of Pickering unless in compliance with the follow- ing regulations: (a) The application for the construction of a culvert shall be in writing on a form provided by the Township Engineer for the Township, signed by the applicant as owner of premises adjacent to the highway requesting the construction of a culvert and shall be accompanied by payment in advance forthe amount required to be paid for the construction of such culvert as hereinafter provided. (b) The applicant shall furnish in writing, when requested to do so, particulars of the place where the culvert is to be constructed. The applicant shall also plant two stakes in the ground marking the location of the culvert to be so constructed. (c) The applicant shall pay to the Treasurer of the Township of Pickering the sum of $75.00 for a normal sized cul- vert. A normal sized culvert is hereby defined to mean for the purposes of this by-law a culvert 18 feet in length and not less than 15 inches or more than 18 inches in diameter. Where an applicant requires a normal sized culvert longer than eighteen feet, AD shall pay in addition to ~ other charges the sum of ~-~ per foot for each foot of culvert in excess of eighteen feet, plus the cost of the required couplers. Where an applicant requires a culvert having a diameter larger than 18 inches, he shall pay, in addition to other charges provided for this by-law, such sum as the council shall prescribe. (d) No culvert shall be constructed on a highway under the jurisdiction of the Township of Pickering unless it be of standard galvanized corrugated steel pipe construction of not less than eighteen feet in length and 15 inches in diameter or of such other construction as approved by the Township Engineer or someone authorized by him in that behalf. 2 2. ~y person convicted of a breach of any of the provisions of this by-law shall forfeit and pay at Se discretion of the convicting magistrate a penalty not exceeding (exclusive of costs) the s~ of ~ee ~ndred Dollars ($300.00) for each offence. 3. ~-Law No. 2912 be and the s~e is here~ repealed.
