HomeMy WebLinkAboutBy-law 3141 THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW NO. ~ / ~/! bei~ a by-law to amend By-law No. 3018 with regard to an increase in cost of the Chester Hill Road sanitary sewer and watermain and private connections therefrom. WHEREAS By-law 3018 authorized the construction of a sanitary sewer and watermain with private connections therefrom on Chester Hill Road between the points set out herein at an estimated cost of $10,694.00; AND WHEREAS it is now estimated that the costs of the said works will amount to $17,322.00; AND WHEREAS it is expedient that the construction of the works herein shall be undertaken at the costs hereinafter set out as local improvements under the provisions of The Local Improvement Act and notice of the intention of Council has been published; AND WHEREAS the construction of the said sanitary sewer and watermain is being undertaken under the provision of Sections 8 and 67 of The Local Improvement Act and the construc- tion of the private connections therefrom under Section 8 of The Local Improvement Act; NOW THEREFORE the Council of the Corporation of the Township of Pickering enacts as follows: 1. That a sanitary sewer, including one private sanitary sewer connection to the street line, be constructed on Chester Hill Road from approximately 1,OlO feet north-east of the west limit of Registered Plan 319 to approximately 180 feet north- east of the west limit of Registered Plan 319( being approxim- ately 840 feet south-west from the point of commencement) , at a total estimated cost of $10,927.00 as a local improvement under the provisions of The Local Improvement Act. 2. The entire cost of the said sanitary sewer, $10,760.00, is to be assessed upon the lands abutting directly on the work and upon lands not abutting directly upon the work but immed- iately benefitting therefrom. The entire cost, including debenture charges, shall be assessed and levied on the rateable property set out in Section 7 of this By-law which is hereby defined a local improvement area to be known as the Chester Hill Sanitary Sewer and Watermain Local Improvement Area, pursuant to Section 67(1) of The Local Improvement Act, and be paid by an annual rate of $1.17 per foot frontage on the lands assessed. 3. The entire cost of the said private sanitary sewer connection, $167.00, shall be assessed upon the particular lot for or in connection with which it is constructed. 4. That a watermain, including one private watermain connection to the streetline, be constructed on Chester Hill Road from approximately 905 feet north-east of the west limit of Registered Plan 319 to 210 feet north-east of the west limit of Registered Plan 319 (being approximately 695 feet wouth-west from the point of commencement), at a total estimated cost of $6,395.00 as a local improvement under the provisions of The Local Improvement Act. 5. The entire cost of the said watermain, $6,277.OO, is to be assessed upon the lands abutting directly on the work and upon lands not abutting directly upon the work but immediately benefitting therefrom. The entire cost, including debenture charges, shall be assessed and levied on the rateable property set out in Section 7 of this By-law pursuant to Section 67(1) of The Local Improvement Act and be paid by an annual rate of 68 cents per foot frontage on the lands assessed. 6. The entire cost of the said private watermain connec- tion, $118.00, shall be assessed upon the particular lot for or in connection with which it is constructed. 7. The following lands shall constitute a local improve- ment area to be known as The Chester Hill Sanitary Sewer and Watermain Local Improvement Area pursuant to the provisions of Section 67(1) of The Local Improvement Act, R.S.O. 1960, as amended, namely, all of Lots 151 to 162 inclusive, the southerly 200 feet of Block K and the westerly 80 feet ll inches of Block D, all on Registered Plan 319 for the County of Ontario. 8. The Engineer of the Corporation is hereby authorized to make such plans, profiles and specifications and furnish such information as may be necessary for the making of contracts, for the doing of the work or for carrying out the same by day labour, and the work shall be carried on and executed under the superintendence and according to the directions and orders of the -3- said Engineer. 9. That the entire cost of the works be paid by the issuance of debentures bearing interest at the rate of 6~ percentum per annum and be repaid by the said assessments over a term of 20 years. 10. The Treasurer of the Township may, subject to the approval of Council, agree with any bank or person for tempor- ary advances of money to meet the cost of the work pending the completion thereof. ll. Any person whose lot is assessed may commute by a payment in cash the rates imposed by paying the costs of con- struction assessed upon such lot without the interest forth- with after the Special Assessment Roll has been certified by the Clerk but may not commute after the Debenture By--law has been passed.
