HomeMy WebLinkAboutBy-law 3071 MUNIOIPALITY OF THE TOWNSHIP OF PICKERING BY-LAW NO,: 3~'7/ being a By-law to s~gns in the Township of Pickering. NOW THEREFORE BE IT AND IT IS HEREBY ENAGTED. SIGNS DEFINED 1. In this By-law:- a. SIGN means an advertisement by means of painting on, or attaching bills, letters or numerals to any structure, canopy sur2ace or device and shall include the structure, canopy sur- face or device upon which advertisement is painted, placed or attached. b. GROUND SIGN means any sign, excepting poster panels, bulletins or portable signs supported from the ground a~d not attached to any part of a building. c. WALL SIGN means any sign attached and parallel to the wall of a building, or which is painted on such wall. d. ROOF SIGN means any sign, the entire face of which is above the roof level and roof area of a building. e. PROJECTING SIGN means any sign which is attached to and projects at an angle from the wall of a building. f. PORTABLE SIGN means any sign which is not permanently constructed at one place in the ground, or attached to any building or structure and includes the type of sign con~nonly known as sandwich-boards. g. POSTER PANELS AND BULLETINS means any signs other than Eround signs and portable signs supported from the ground and not attached to any building on which an advertisement is posted or painted, or to which an advertisement is attached by means of advertising panels. h. INSPECTOR means the Building Inspector appointed by the Council of the Township of Pickering or such other person as the Council may from time to time appoint to carry out the provisions of this By-law. i. PROFESSIONAL SIGN means any signs adver~sing the professions recognized as such by competent University Authority. 2. Except with respect to location, the provisions of this By-law shall not apply to:- a, Professional signs having an area not in excess of two square feet. b. Real Estate Point of Sale signs, or Contractor Job-Site signs, having an area not in excess of twenty square feet. c. Any sign indicating the address and owner of a private residence on which the sign is located having an area not in excess of two square feet. Cont: PaRe 2. 3. LOCATION O~ SIGNS a. No sign shall be erected on any road allowance, excepting the following:- 1. Highway Information or Fare Zone signs; 2. Church or Service Club signs having an area not in excess of three square feet at locations approved by the Inspector; 3. Signs painted on what are commonly known as park benches located on a road allowance, subject to the approval of the location and the advertising content by the Inspector; 4. Signs in or on transit passenger shelters. 5. Signs on newspaper boxes advertising the name and contents of the newspaper sold therefrom. b. No sign shall be attached to a tree on a road allowance and no sign, excepting Highway Information or Fare Zone signs, shall be attached to any utility pole or standard, save and excepting lighting standards in shopping centres, when approved by the Local Hydro Authority. c. No sign shall be erected or maintained which is in view from any Highway, which sign resembles any official traffic sign or signal, or which attempts to direct the movement of traffic or which hides the view of any official traffic sign or signal, except Entrance Signs (which Entrance Signs shall have an area not in excess of eight square feet) provided they do not hide the view of any official traffic sign or signal. d. No sign shall be erected or maintained using red or green colours, where such colours are illuminated by any device or material within 200 feet of any intersection at which motor vehicle traffic is controlled by any type or automatic traffic signals. 4. PERMITS a. APPLICATION FOR A PERMIT. No sign shall be erected, maintained or structurally altered unless a permit is obtained from the Inspector. The application for such permit shall include the following in duplicate: i. The application form as supplied by the Building Inspector; ii. A block plan showing the street lines and/or other boundaries of the property on which it is proposed to erect such sign, and the location of the sign upon the property in relation to other structures on such properties and/or upon the premises inunediately adjoining thereto. If required by the Inspector, the correctness of such plans submitted for approval shall be certified by an Ontario Land Surveyor; iii. Complete plans and specifications covering the construction of the sign and the supporting framework; iv. Plans of, and such other information with respect to, any building upon which it is proposed to locate the sign as the Inspector may require in order to determine whether the structure of such building will carry the additional loads and stresses imposed thereon by the erection of such signs; Cont: Pa~e ~. v. In the case of the proposed structural alteration of a sign, the applicant shall supply such information as may be required by the Inspector in lieu of the provisions herein; vi. If required by the Inspector all plans of and specifica- tions covering the construction of the sign and the supporting framework shall be certified by a Registered Professional Engineer as to its structural adequacy. vii. An undertaking by the applicant to remove or permit the Township to remove the said sign when notice is given in accordance with this By-law; b. RENEWAL OF PERMIT: Permits shall be effective until the end of the calendar year in which they are issued and shall be renewed annually by the 31st. day of January. c. PERMIT FEES: The fees payable for a permit and for renewals thereof, for each individual sign shall be as follows:- i. Sig~s situate wholly on private property where the area of such sign does not exceed sixteen square feet, $1.00 per sign and over sixteen square feet, $3.00 per sign; ii. Signs projecting over Township property or street wholly or in part, $3.00 for the first six square feet, plus thirty cents for each square foot in excess thereof, per sign; iii. Poster Panels, Bulletins and Roof Signs not exceeding three hundred square feet in area, $7.50 per sign, and $15.00 for double sided signs; iv. Poster Panels, Bulletins and Roof Signs in excess of three hundred square feet, $10.00 per sign and $20.00 for double sided signs. v. Signs on transit passenger shelters, $5.00 per shelter. 5. REGULATIONS: a. GROUND SIGNS: No ground sign shall be erected or altered except in accordance with the following additional regulations:- i. Other than on Shopping Centres, no ground sign shall be erected or maintained on a parcel of land with a frontage of less than 75 feet and not more than one sign for every 150 foot frontage; ii. The outermost part of such sign shall be not less than 10 feet back from the streetline, the lowest part, other than supporting standards, decorative trim and the like, shall be not less than 6 feet 6 inches above the average grade level around the sign area, and the hi~hest part shall not be more than 35 feet above such average grade level; iii. In Shopping Centres which include a group of three or more individual stores or other commercial enterprises whether in one or more buildings, and with con.on ~arking facilities for customers, only shopping Cont: Page centre identification ground signs may be erected and only one such sign for every 500 feet of frontage. Such signs may, in addition to identification features, include a directory for stores and businesses in the Shopping Ce:fore with the name and type of store and identification insignia of any such businesses. The to~l area of the directory and insignias shall not exceed the area of the Shopping Centre identification pc~tion of such sign. b. WALL SIGNS: No wall signs shall be erected, maintained or altered except in accordance with the following regulations:- i. The area of such wall sign, whether painted on or attached to the wall, shall not have an area greater than one quarter of the size of the wall to which it is painted or attached; ii. It shall not project more than two feet from the face of the wall; iii. It shall be constructed in such a way as to exclude weather and prevent wind pockets. c. ROOF SIGNS: No roof signs shall be erected, maintained or altered except in accordance with the following additional regulations:- i. Every roof sign shall be so located as to maintain a clear space of at least three feet between the top of the roof or parapet wall of such building and the bottom of the sign; ii. No roof sign shall be so located upon any building as to obstruct any window, door, scuttle, skylight or fire escape or so as to prevent the free access of firemen to any part of the building in case of fire and shall be placed a minimum of four feet from the outer walls of the building unless the sign is composed of separate letters, numerals or panels, each not in excess of four feet in width and spaced at least two feet apart; iii. The structural framework of all roof signs shall be of steel; iv. The highest point of any roof sign shall be not mo~e than twenty-five feet (25') above the roof or cornice line of the top of the parapet wall immediately under- neath or adjacent to such sign, provided that when the top of the parapet wall is more than three feet (3') above the roof, the highest point of such sign shall be not more than twenty-eight (28'} above the roof; v. At any one site the total length of roof signs shall not exceed one hundred feet. vi. No roof sign or group thereof on any one site shall be located closer than eight hundred feet on the same side of the street from any other roof sign or group thereof or from any poster panel, bulletin or group thereof excepting signs advertising the name of the occupant or firm, of the building upon which such sign is located. However, if such location sign is constructed on a building other than that of the Cent: Pa~e ~. of the occupant or firm for which such location sign is constructed, the distance provisions shall apply. vii. No roof sign shall be located closer than two hundred feet from any church, dwelling or apartment house without the written permission of such abutting owner. d. PROJECTING SIGNS: No projecting signs shall be erected or altered except in accordance with the following additional re~lations:- i. A projecting sign shall h~ve a minimum clearance of ten feet above the level of the sidewalk grade and shall not exceed a total height of twenty feet exclusive of poles or guy wires; ii. Projecting signs attached to buildings which do not abut the property line shall not extend more than ten feet beyond the face of such building and the outermost projection of such sign shall not project over the streetline a distance of more than two feet; iii. Signs attached to buildLugs which immediately abut public property shall not project over the streetline a distance of more than two feet; iv. Signs pro~ cting more than two feet over the streetline shall be removed or altered to conform to such maximum projection by the 31st. day of December, 1966. e. PORTABLE SIGNS: No portable signs shall be placed or maintained except in accordance with the following additional regulations:- i. No portable signs shall be placed or maintained on. a road allowance; ii. Portable signs shall not have more than two advertising surfaces and each advertising surface shall not exceed sixteen square feet in area nor exceed four feet in total height; iii. No portable signs shall be placed or maintained in front of any private property having a frontage of less than seventy-five feet and not more than one such sign shall be maintained for each one hundred and fifty feet of frontage. f. POSTER PANELS AND BULLETINS: No poster panels or bulletins shall be erected or maintained except in accordance with the following additional regulations:- i. Poster Panels and Bulletins shall not be located closer to the streetline than either the existing building line or, if there is no exisZing building line, the front of the adjoining buildings, or if there is no building line or adjoining buildings, thirty feet back from the streetline; ii. At any one site there shall not be more than four poster panels or two bulletins or two poster panels and one bulletin and in any case the total length of such signs shall not exceed one hundred feet; iii. No poster panel of bulletin or group thereof shall be located nearer than eight hundred feet from any other poster panel or bulletin or group thereof, Cont: Page 6. whether on the same or the opposite side of the street or from any roof sign or group thereof nearer than 800 feet on the same side of the street; iv. No poster panel or bulletin shall be erected or maintairmd closer than one hurd_red and fifty feet from any intersection; v. Poster panels and bulletins shall have a clear space of at least three feet between the bottom of the sign and the ground, which space may be either left open or filled in with open la,ice work; vi. Poster panels and bulletins shall not exceed in height fifteen feet above the ground level, except where the ground level is below the level of the adjoining street when such sign shall not exceed in height fifteen feet above such street level; vii. No poster panels or bulletins shall be located closer than two hundred feet from any church, dwelling or apartment house without the written permission of such abutting owner. g. ELECTRIC SIGNS: No sign illuminated or operated electrically shall be erected, maintained or altered unless such electrical work is in conformity with the Canadian Electrical Code and the Hydro- Electric Power Commission of Ontario regulations. h. PLASTIC SIGNS: . The material used in the construction of plastic signs shall be incombustible. i. LIGHTING STANDARD SIGNS: No lighting standard signs shall be erected or altered except in accordance with the following additional regulations :- i. No lighting standard signs shall be erected except in shopping centres which include a group of three or more individual stores or other commercial enterprises, whether in one or more buildings, and with common parking facilities for customers; ii. No sign, together with frame, shall exceed a height of ~ feet 6 inches and a width of 5 feet 6 inches; iii. The outermost point of the signs, together with the frame, shall not be closer to a streetline than 20 feet, nor closer to the main wall of a building than 30 feet; iv. The distance from the finished grade or pavement to the lowermost point of the sign shall not be less than 14 feet; v. All such signs in a shopping centre shall be of a uniform size and placed at a uniform angle and height on the lighting standard. No more than two such signs shall be placed on one lighting standard; vi. The distance from the centre line of one lighting standard to the centre line of a~y other lighting standard in a shopping centre, upon which a sign may be erected, shall not be less than 40 feet; Cont: Pa~e 7- vii. Frame to be of extruded aluminum construction; viii.Adverting inserts to be of aluminum or tempered masonite; ix. Supporting brackets to be of galvanized steel with non-rusting bolt fasteners, fittings from which signs are suspended and at ~ahich movement may occur shall have a bearing surface of nylon; x.Lighting standard advertisements to be limite4 to national product or charitable advertising only; xi. Lighting standards upon which lighting standard signs may be erected shall be in conformance with requiremauts and specifications of Canadian Standards Association with regard to floodlighting poles. 6. REMOVAL OF, SIGNS: a. The Council or the Inspector may, upon giving thirty days notice, order the removal of any sign and if not so removed the Council may, upon giving a further ~u~ceen days notiEe, either direct the Inspector to remove such sign or that an application be made to the County Court for an Order authorizing the Township to remove such sign as the case may require. b. The Inspector may, without notice, immediately remove any sign which in his opinion is in such a condition that it may be dangerous to the public. c. Any sign removed pursuant to this By-Law may be deposited on the property on or in front of which the sign was situate. The cost of such removal shall be forthwith payable by the person in whose name the permit for such sign was obtained or the owner or occupant of the premises on or in front of which the sign was situate in like manner as municipal taxes. 7. NOTICE: Any notices required to be given under this By-Law may be given by registered mail addressed to the person in whose name the permit for s~ ch sign was obtained, or the owner or occupant according to the last revised Assessment Roll of the Township of Picketing of the property on or in front of which the sign was situate, and shall be effective as of the date on which such registered letter is deposited in the post office. 8. PENALTY FOR NON'~COMPLIANCE: Any person convicted of a breach of any of the provisions of this By-Law shall forfeit and pay at the discretion of the convicting magistrate, a penalty not exceeding the sum of Three Hundred Dollars ($300.00) exclusive of costs.
