HomeMy WebLinkAboutBy-law 3010 TOWNSHIP OF PICKERING N MB R ........ BEING ~ BY-L~W TO REGULATE THE OPERATION OP PITS AND QUARRIES, NOW THEREFORE BE IT AND IT IS HEREBY ENACTED: 1. In this By-law; GRAVEL PIT (a) 'Gravel Pit' shall moan a pit or quarry from which sand, gravel, stone or other similar aggregate is, or is proposed to be removed for the purpose of processing same or removed for direct use on a road or for road construction, road surfacing, building construction or similar uses. STRIPPING b) 'Stripping' shall mean clean overburden consisting of earth and rock only. SCRAP c) 'Scrap' shall mean all waste material such as rejected metal, lumber and tree stumps. PERCHED PONDS d) 'Perched Ponds' shall mean ponds resulting from Pit and Quarry excavations above th~ natural water table, in excess of eighteen [18) inches in depth or covering a minimum area of ten thousand (10,000) square feet. WAYSIDE PIT e) 'Wayside Pit' shall mean a temporary pit, quarry, borrow or fill removal operation, carried on by or for a public authority engaged in highway construction or re- construction. 2. No gravel pit shall be hereafter established in the Township of Pickering until a Site Plan in triplicate and drawn to scale, is filed with and aoproved by the Council of the Township of Picketing. The said plan shalI show the following information; (a the true shape, dimensions and location of the property; (b the location, height, dimensions and use of all buildings or structures remaining or proposed to be erected on the property; (c existing and proposed grades, contours and excavation setbacks$, (d) drainage provisions; (e) all entrances and exits. - 2 3. Ail gravel pit operations shall be conducted in accordance with the following provisions: SCREENING (a) Screening A tree screen, not less than twenty (20) feet in width, containing two rows of evergreen trees planted on twenty (20) foot centres, alternately, and having a minimum planting height of six (6) feet shall be constructed between any excavation and any abutting area zoned for Residential, Commercial or Village purposes; and shall be provided in all instances ~here excavation operations are located two hundred (200) feet or closer to the nearest point of any residence; such screening shall extend a minimum distance of one hundred (100) feet on either side of said residence(s), FENCING (b) Fencing - Every pit or quarry or portion thereof, hazardous or dangerous by reason of its deoth or watery condition, shall be securely fenced or otherwise protected against inadvertent access. STRIPPING PILES (c) Stripping Piles - Stripping Files shall be restricted to specific areas, in such a manner as to assume a generally smooth grade. All sides facing upon a street shall be so sloped that excessive erosion will not take place, SETBACKS (d) Setbacks - Clean overburden consisting of earth and rock only may be stockpiled on the required setback from any street, but such stockpile shall not be located closer than ten (!0) feet to any street line and in all open pit workings, all unconsolidated matorials, such as clay, earth, sand, gravel and loose rock lying within six (6) feet of the rim of the pit or quarry shall be removed there- from. OVERBURDEN (e) Overburden - Such overburden may be used as a screening and buffer strip, and shall be piled in an orderly fashion, properly sloped and ~e,e. ded to preclude undue erosion, or the provisions of Section 3 (a) sh~l] apply. SCRAP (f) Scrap - Scrap shall be confined to a specific designated area; shall not be permitted to accumulate in haphazard locations throughout the pit; and shall be disposed of periodically. TRI~IING (g) Trimming - The floors of every Pit or Quarry shall be trimmed to give smooth surfaces such as can be obtained by back-dragging with a bulldozer. SLOPE OF BANXS (h) Slope of banks - Ail faces worked to the legal setback shall be sloped to the material's natural angle of repose, but in no case shall this be an angle of less than thirty-five (35) degrees off vertical. - 3 - DRAINAGE (i) Drainage - Ail perched ponds shall be drained to the low point in the pit or quarry site. Ponds ~hich occur due to the natural water table and cannot be drained, shall be provided with graded banks. BUILDINGS AND STRUCTURES (j) Buildings and Structures - Upon removal of buildings and structures, all excavations pertaining thereto shall be adequately filled. 4. No gravel pit or quarry operation shall be conducted closer than fifty {50) feet from any creek, lake or river. 5. No gravel pit or quarry shall be opened, established or maintained closer to any to any lands zoned for Residential, Comm- ercial or Village uses than one-half (1/2) the height of the highest face of the pit or quarry. EXEMPTION 6. EXEMPTION - TEMPORARY WAYSIDE PITS Notwithstanding the general provisions of this By-law, the operation of temporary wayside or borrow pits, may be permitted for a period not exceeding six (6) months upon application to, and approval of, the Council of the Corporation of the Township of Pickering. BONDING 7. Before commending any Gravel Pit operation, the owner shall file with the Township of Pickering, a Guarantee Bond in an amount and in a form satisfactory to the Township of Pickering to insure the compliance with the terms of this By-law. PENALTY 8. Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay, at the discretion of the convicting Magistrate, a penalty not exceeding the sum of Three Hundred ($300.00) Dollars exclusive of costs.
