HomeMy WebLinkAboutBy-law 2947 TOWNSHIP OF PICKERING being a by-law foz~ the licensing, regulating and governing of Salvage Yards, Second Hand Goods Shops and Dealers in Second Hand Goods. WHEREAS The Municipal Act, R.SoO. 1960 Ch. as amended authorizes the enactment of this By-Law~ NOW THEREFORE BE IT ENACTED and it is hereby enacted as a By-law of the Council of the Corporation of the Township of Picketing as follows: 1. In this by-law, whenever the terms hereinafter defined are used, they shall have the meaning hereinafter ascribed to them. (1) "Salvage Yard" includes an automobile wrecking yard or premises, a place where motor vehicles are disassembled and resold, a place where farm implements are disassembled and resold, a place where second hand goods are collected to be sorted and a place where used lumber and used building materials are stored for sale or resale or other disposal. (11) "Second hand goods shop" is a place wheme second hand goods are kept for sale ol- l'esale or other disposal. (111) "Second hand goods" includes waste paper, rags. bones, bicycles, automobile tires, old metal, clothing, bottles, hardware and other scrap material and salvage. (iV) "Dealers in second hand goods" includes pemsons who go from house to house, o~ along highways, for the purpose of collecting, pumchasing, or obtaining second hand goods, and includes a person who so does, om the agent om servant of such person. 2. Notwithstanding any othel~ pz'ovision in this by-law contained, no license shall be ~equired by persons engaged in any of the tmades, callings, businesses or occupations to which this Schedule relates for patl-iotic or charitable purposes in ~he purchase, sale o~ exchange of al'ticles commonly known and ~ecognized as valuable antiques and works of art, either . 2 in their original condition or as renovated, remodelled, repaired or ~e-manuf attuned. 3. Any license issued under this By-law may be issued to authorize the licensee to deal in one class only of second- hand goods or in more than one class as may be specified in the license and such licensee shall not be entitled to deal in any class of second-hand goods not covered by his license. ~. No person shall have, keep~ operate or carry on any salvage yard, second hand goods shop, or act as a dealer in second hand goods within the boundaries of the Township of Picketing, without having first obtained a license from the Council of the Corporation of the Township of Picketing so to do. 5. The Annual fee for a license under this By-law shall be Twenty Dollars ($20.00). 6~ Every person requiring a license under the provisions of this By-law shall obtain a separate license in respect of each and every salvage yard, second hand goods shop, or other' place used for the transaction of business or for taking in or stol~ing second-hand goods. 7. Every salvage yard, second hand goods shop or other place or premises in respect of the use of which a license was issued under this By-law shall be liable to inspection at all reasonable times by a By-law Enforcement Officer, Police Constable, or any other person or officer authorized in this behalf and no person so licensed shall refuse admission to such officer or person after o~ upon demand made. 8. Every salvage yard, second hand goods shop or other place or premises, the owner or keeper of which is licensed under this By-law shall be kept clean, in a neat condition, and in good ~epair. No goods or merchandise shall be displayed on the outside of any such store, shop, yard or other place, and all goods shall be exhibited in an orderly manner. ~ 3 9. NO person being a holder of a license under the provisions of this By-.law shall alter, repair, dispose of or in any way part With any goods or articles purchased or taken in exchange until after the expiration of three days from the date of purchase, exclusive of S~ndays and holidays and during these three days the goods or ar%icles so obtained shall remain on the licensed premises and be kept apart from goods previously purchased. 10. Every person being the holder of a license under the provisions of this By-law shall enter in the English language written in ink, in a plain legible hand. a record of all goods mecelved or taken in exchange or otherwise obtained, either at The licensee's place of business or elsewhere. The entry must be made at the time the go~ds are received or immediately thereafter, and shall include in addition to the date on which and the hour at which the goods are received, a full description of article or articles including the serial and model number, if any, and The Manufacturer's name, if any, and the name and address of the person from whom the goods are received, and if purchased, the price paid therefor. 11. No person shall have, keep or operate any salvage yamd unless the premises are enclosed by a board fence originally constructed and kept repaired with new lumber and painted and maintained to present a neat and tidy appearance. The said fence shall be of sufficient height and construction so that none of the goods stored on the premises shall be visible to a person six feet tall standing at the grade level of the neares~ roadway and distant one hundred feet from the nearest lot line, provided that in no event shall the said fence be less than seven feet in height. 12. Where automobiles or vehicles a~e exhibited for sale, such automobiles shall be stored behind a fence as described in paragraph ll, unless such automobile bears a certificate of mechanical fitness certifying that it is mechanically fit, as laid down in section 49 of the Highway Tl-affic Act R.S.0. 1960 and subsequent amendments thereto. S 13, Where a licensee is also the holder of a license for storage of automobiles, such automobiles shall be stored behind a fence as described in paragraph 14. Every owner or keeper of a Salvage yard, second hand goods shop om other place or premises for the pumchase, sale or exchange of second hand goods, shall during the whole period in which the license is in force, exhibit over the street doom or in the front window of the premises in respect to which a license is issued, om in some other conspicuous place on the fmont thereof satisfactory to the Council of the Township of Picketing in large plain letters in the English language, the words "Licensed Salvage Yard" or "Licensed Second-hand Shop" or as the case may be and shall also keep the license constantly exposed in a conspicuous place in the interiom of the licensed premises, 1§, Any license granted under this By-law shall be revoked upon the second conviction of a breach of this By-law or a conviction under the Criminal Code of Canada. 16. Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay~ at the discretion of the convicting Magistrate, a penalty not exceeding Thmee Hundred Dollars ($300.00) exclusive of costs, for each offence, 17. This By-law shall come into force and take effect on the 1st day of January 19B5, lB.
