nature of an easement over certain
lands and lands covered with water
in the Townahip of Pickering for the
construction, operation and maintenance
of a sanitary sewer outfall pipe.
WHEPJ~ it is required that the Corporation of the Township of
Picketing acquire a right in the nature of an easement in, over, under,
along, upon and through certain lands and lands covered with water in
connection with and for the construction, operation and maintenance of a
sanitary sewer outfall pipe and related works and undertakings on the lands
and lands covered with water more particularly described in Schedule "A"
annexed hereto.
A~\~ WHEREAS by Section 333 of The Municipal Act, R.S.O. 1960, Ch. 249,
the Council of the Corporation of the Tc~nship of Picketing may pass by-laws
for acquiring or expropriating any land required for the purpm es of the
Corporation.
A~,~ ,.f.-~FAS by virtue of Scetion l(h) of The Mmticipal Act, land
includes lands, tenements and hereditaments and any estate or interest
therein, and any right or easement affecting them, and land covered with
w~ter.
AND ~,~.t~S by the said Section 333 of The Municipal Act, the
Council of the Corporation of the go~mship of Pickering n~y pass by-laws
more particularly for acquiring or expropriating a right in the natt~e of
an easement.
AND ~,a~EREAS the Corporation of the Township of Pickering deems it
expedient to expropriate a right in the nature of an easement in, over,
along, under, upon and through the lands more particularly described in
Schedule "A" hereto armexed for the purpose of constructing, operating and
maintaining a sanitary sewer outfall pipe and related works and undertakings.
N~J TH~KFO~ the Council of the Corporation of the Township of
Picketing HEREBY ENACTS as follows:
1. k right in the nature of an easement is hereby expropriated
and taken for Municipal purposes in perpetuity or for so long
as shall be required for the purposes hereinafter set out, in, over, urder,
along, upon and through the lands described in Schedule "A" a~exed hereto,
for ~e fo~i~ p~poses:
(a) To enter on, to lay do~, co~truct, operate, m~nt~n, repair
and replace a sew~e outfa~ pipeline with related works and ~dert~i~s
and supports necessa~ry or incident~ thereto.
(b) For the p~poses aforesaid to enter on, excavate, drill, erect,
inst~l or ~t to be excavated, drilled, erected or installed ~y
ch~ber, pit, well, fou~ation, pave~nt or other struct~e or other instal-
lation necess~y for the p~poses afores~d.
(c) To disch~ge thro~ or pe~t to be discharged throu~ the
said sewage outf~l pipe~ne sewage effluent from ~e sewage treat~nt plant
from ~ch the said sewage pipeline r~s.
2. ~e To,ship .~gineer ~d persons authorized by him, and/or
cla~ thro~h h~ are hereby au~orized to enter on said lands desc~bed
in Schedule "A" ~nexed hereto for the p~pose of car~i~ out the purposes
referred to in this By-law.
