A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF PICKERING TO AUTHORIZE
THE TDWNSHIP ROAD SUPERINTENDENT TO SUPERVISE THE TRIMMING AND REMOVAL
OF TREES AND FOR OTHER PURPOSES.
WHEREAS by Section 473(4) of The Municipal Act R.S.O. 1960 Chapter 249
as amended it is provided that except with the authority of an officer
of the Council of the said Corporation no person shall remove or cut down
or injure any tree upon a highway;
AND WHEREAS by Section 473(4)(b) of the said Municipal Act the said
Council is empowered to pass by-laws authorizing any officer of the
Council to supervise the trimming of trees planted upon a highway or
upon private p~operty where the branches extend over a highway or to
remove decayed or dangerous trees or trees which have by by-law of the
Township been directed to be removed;
AND WHEREAS the said Council deems it expedient to authorize the
Township Road Superintendent from time to time to carry out the duties
aforesaid;
NOW THEREFORE the Council of the Corporation of the Township of Picketing
ENACTS AS FOLLOWS:
1. The Road Superintendent of the Corporation is and he is hereby
authorized as an officer of the Council to supervise the trimming
of trees planted upon a highway or upon private property where the
branches extend over a highway or to remove decayed or dangerous
trees or trees which this Corporation has directed to be removed.
2. Where this Council has directed the removal of any tree planted
upon a highway the owner of such tree shall be given ten dayst
notice of the intention of the Council to remove such tree and be
recompensed for his trouble in planting and protecting it and if he
so desires he shall be entitled to remove the tree himself but shall
not be entitled to any further or other compensation.
3. Any notice required to be given under this By-law may be given by
leaving it with a grown-up person residing on the land or if the
land is unoccupied by posting it in a conspicuous place on the land.
4. Except with the authority of the Road Superintendent of this
Corporation no person shall remove, cut down or injure any tree
within the said Corporation planted upon a highway.
5. By-law No. 2304 be and the same is hereby repealed.
