HomeMy WebLinkAboutBy-law 2458BY-LAW NUMBER ?sg A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF PICKERING TO AUTHORIZE THE GRANTING OF TOWNSHIP PERMITS FOR THE MOVING OF HEAVY VEHICLES, LOADS OR OBJECTS IN EXCESS OF THE LIMITS PRESCRIBED PY THE HIGHWAY TRAFFIC ACT, WHF,REE+S Section 35 (1) of The Highway Traffic Act provides that a municipal corporation having jurisdiction over a highway may, uron application in writing, grant a permit for the moving thereon of heavy vehicles, loads or objects in excess of the limits prescribed by Sections 19 or 34 of The Highway Traffic Act; AND WHEREAS Section 35 (2) of the said Highway Traffic Act provides that such permit may be general or may limit the time and the particular highway which may be used, and may contain any special conditions or provisions which may be deemed necessary for the protection of the highway from injury, and a municipal corporation riay require a bond sufficient to cover the cost of repairing such possible injury to the highway; AND WHEREAS Section 35 (3) provides that, the council of any municipality may, by by-law, provide that such a permit may be issued by any officer of the corporation named therein; AND WHEREAS Section 35 (5) of the said Highway Traffic Act provides that the person who obtains a permit under the said Section 35 shall nevertheless be. responsible for all damages which may be caused to the highway by reason of the driving, operating or moving of the vehicle, object or con- trivance for which the permit was granted; AND WHEREAS the said Section 35 contains a provision for a. minimum and maximum penalty for operating or permitting the operation of a vehicle contrary to any of the conditions of such permit; - 2 - BE IT THEREFORE ENACTED BY THE MUNICIPAL COR- PORATION OF THE TOWNSHIP OF PICKERING, that: 66; No person shall drive, operate or move or permit the driving, operation or moving of any vehicle, object or contrivance on any highway under the jurisdiction of the Council of the Township of Pickering (a) if such vehicle, object or contrivance has a greater width than 96 inches except traction engines or threshing machines which may have a total width of 110 inches and except loads of loose fodder; (b) if such vehicle, object or contrivance other than a public vehicle or semi-trailer as defined in Section 37 (6) (b) of The Highway Traffic Act including load or contents exceeds the length of 33 feet and if a combination of vehicles, including load or contents, coupled to.-ether exceeds the total length of SO feet; (c) if such vehicle, object or contrivance, including load or contents, has a greater height than 13 feet 6 inches; until he has applied in writing on the prescribed application forms to the Corporation of the Township of Pickering for and has been issued a permit (hereinafter referred to as a"Town- ship Permit") to do so, Unless a Township Permit has been issued, no vehicle having a gross weight in excess of the gross weights set forth in Section 34 (2) of the Highway Traffic Act shall be moved upon wheels, rollers or otherwise over and upon a Class A highway (as designated by the Minister of Transport under the authority of 34 (1) (a) of the Highway Traffic Act) under the jurisdiction of the Corporation of the Township of Pickering, No vehicle, object or contrivance for moving V -3- loads which is equipped with tires of less than six inches in width shall be operated or moved upon or over any highway of the Corporation of the Township of Pickering, the weight of which, or the gross weight of which, exceeds 5n0 rounds upon any inch in width of tire, roller, wheel or other object, and no vehicle equipped with tires of six inches or more in width, the weight or gross weight of which exceeds 600 pounds upon any inch in width of the tire, shall be so operated without first obtaining a Township Permit, A Township Permit may to general in its form or ay limit the time and the particular highway which may be used, and may contain any special conditions or provisions which may be deemed necessary for the protection of the highway from injury and the Township of Pickering may require from the applicant a bond in an amount sufficient to cover the cost of repairing possible injury to the highway before issuing a Township Permit. ?Atfi A Township Permit shall contain a clause stating that the holder shall be responsible for all damages which may be caused to the highways by reason of the driving, operating or moving of the vehicles, objects or contrivances for which the permit has been issued. The provisions of this by-law shall not apply to the moving of houses or other structures into or through or out of the Township of Pickering, 1 7 yep The Road Superintendent, Office Manager, Clerk ' r Engineer of the Township of Pickering shall be duly authorized to issue a Township Permit upon being satisfied that the provisions of this by-law will be complied with. CP. For the purpose of enforcing the provisions of this by-law the provisions of Section 36 (1) and (2) and Section 37 of the Highway Traffic Act shall apply mutatis - 4 - mutandis to this By-law. Every person to whom a permit has been issued Inder this By-law who operates or permits the operation of a vehicle contrary to any of the conditions of such permit -hall be guilty of an offence and shall be liable upon conviction under the provisions of the Summary Convictions Act to a penalty of not le-s than w50,00 and not more than $500,00 and in addition the permit for the vehicle concerned issued under Section 3 of the Highway Traffic Act may be suspended for a period of not more than six months.
