A BY..IAW TO REQUIRE YARDS TO BE PUT IN A
SAFE CONDITION
WHEREAS by Section 388 (1) (52) of the Municipal Act, R.S.O.
1950 Chapter 243 as amended by-laws can be passed by the councils of local
municipalities for requiring yards to be put in a safe condition to guard
against fire or other dangerous risk or accident.
AND WHEREAS the Council of the Corporation of the Township
of Pickering deems it desirable to require the owners and occupants of
yards to put the same in a safe condition for the purposes aforesaid.
NOW THEREFORE the Council of the Corporation of the Town-
ship of Pickering enacts as follows:

?,- (a) "Occupant" shall include any person apparently of the
v? age of sixteen years or more who is in control of any
yard.
(b) "Owner" shall include any person or persons registered
as the owner or owners of any yard and the person or
persons in fact able to exercise the rights of owner-
ship with respect to any yard.
(c) "Yard" shall include all areas of land appurtenant to
but not covered by a building.
2. Every occupier and every owner or either of them of a yard
shall put such yard in a safe condition to guard against fire or
other dangerous risk or accident.
3. When by reason of the ruinous or dilapidated state of any
yard, or arV erection, structure, excavation or other situation in
connection with the yard, a yard is in the opinion of the Council

in such a condition as to be unsafe, the Council shall give to the
owner and to the occupier of such yard, notice in writing specifying
the unsafe condition and upon receipt of such notice the owner and
occupier or either of them shall forthwith put such yard in a safe
condition.
4. Any notice required to be given under this by-law shall be
deemed to be validly given to the occupier of a yard by delivering
a copy thereof to and leaving the same with a person apparently over
the age of sixteen years present in the yard or the building or
buildings used in connection therewith, or by mailing the same by
prepaid post addressed to the municipal address of such occupier
shown on the last assessment roll of the Township, Any notice
required to be'given under this by-law shall be deemed to be validly
given to the owner of a yard by mailing the same by prepaid post
addressed to the municipal address of such owner shown on the last
assessment roll of the Township, or in the absence of such municipal
address being shown, by being posted in a conspicuous spot in or
about the said yard. All notices mailed as aforesaid shall be deemed
to be received by the addressee forbyw-eight (4) hours after the

5. In default of compliance with the notice in writing specify-
ing the unsafe condition, the Council may enter on the yard for the
purpose of putting the same in a safe condition and may put the same
6 in a safe condition at the expense of the owner and the Corporation
of the Township of Pickering may recover the expense incurred in so
doing by action or in a like manner as municipal taxes as the Council
may determine,
b. When in the opinion of the Council any yard is in such a
condition that immediate precautionary measures ought to be taken
to guard against fire or other dangerous risk or accident in
connection therewith, the Council may enter on such yard for the

purpose of putting the same in a safe condition, and may put the
same in a safe condition at the expense of the owner and the
Corporation of the Township of Pickering may recover the expenses
incurred in so doing, whether or not any notice was given to the
owner, by action or in a like manner as municipal takes as the
Council may determine.
7. Every, person who contravenes any of the provisions of
this by-law shall upon conviction thereof be liable for a penalty
of not more than Three hundred 06300.00) dollars exclusive of costs
for each such offense, such penalty to be recoverable under The
Summary Convictions Act.
