HomeMy WebLinkAboutBy-law 2425BY - LAW NUMBER V'fVv A BY-LAW OF THE TOWNSHIP OF PICKERING TO CONTROL DUST IN QUARRIES AND ROADS LEADING THERETO. WHERW by The Municipal Act by-laws may be passed by the councils of local municipalities for regulating manufactures and trades which in the opinion of the Council may prove to be or may cause nuisances; AND WHERBAS, in the opinion of this Council, the manufactures and trades hereinafter mentioned may prove to be or may cause nuisances and it is desirable that such manufactures and trades be regulated as hereinafter provided; the Council of the Corporation of the Township of Pickering ENACTS AS FOLLOWS: 1. Every person carrying on the manufacture or trade of a gravel or sand pit or any manufacture or trade where gravel, sand, stone, or other like materials are dug, mined, won, excavated, extracted or quarried, shall comply with the following requisitions: (a) the dust producing portion of every such manufacture or trade shall be conducted with the use of machinery, fences, dust collectors, or other equipment to prevent effectively the escape of dust to the open air and C (b) all roads, lane, paths, or other means of access used by vehicular traffic in connection with such manufacture or trade shall be maintained and kept free from dust at all times. 2. Where there is a contravention of any of the foregoing regul- ations, the person carrying on the manufacture or trade shall be liable in respect thereto notwithstanding that an officer, employee, agent or independent contractor of such person directly caused or contributed to such contravention. 2 - 3. Every person vho contravenes any of the provisions of this by-lav shall, upon conviction thereof, forfeit and pay, at the discretiin \ of the convicting Magletrate, a penalty net exceeding (exclusive of costs) the sum of $100.00 for each offence.
