WHEREAS it has been du~ declared by Declaratory By-Law N,,-her ~ passed by a vote of two-thirds of all the Members of the Fmumicipal Council, desirable that the construction of the work hereinafter described shall be undertaken as a local improvement. AND WHEREAS notice of the intention of the Municipal Council to undertake such work was duly published more than twenty-one (21) days prior to the passi~ of this By-law. AND ~P~%FAS no Petition has been made to The Ontario Municipal Board p~rzuant to the said Act. AND WHE2~EAS the Council has procured to be made the reports, estimates and statements required for undertaking the said work. NOW THEREFORE THE ~JNICIPAL COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PIC~WRING enacts as follows: 1. That as so declared an eight-inch (8") watermain along East Avenue from Island Road to Highway No. 2 and thence along Highway No. 2 from East Avenue to a point one thousand one hundred and fifteen feet (1,115') west of the west street line of East Avenue be constructed as a local improve- ment under the provisions of The Local Improvement Act. 2. That the Engineer of the Corporation do forthwith make such plans, profiles and specifications and furnish such information as may be necessary for the making of a contract or contracts for the execution of the said work. 3. That the said work shall be carried on and executed under the superintendence and according to the directions and orders of such Engineer. -2- That the Reeve and Clerk are authorized to cause a contract or contracts for the construction of the said work to be made and entered into with some person or persons, firm er firms or corporation or corporations subject to the approval of this Council to be declared by resolution. 5. That the Treasurer may, subject to the approval of the Council, agree with an~ bank or person for temporary advances of money to meet the cost of thc said work pending the completion thereof. 6. That the special assessment shall be paid By twenty (20) annual instalments in respect to the debentures for the said watermain. 7. That the debentures to be issued for the loan to be effected to pay for the cost of the work when completed shall bear interest at such rate as Council may determine and be made payable within twenty (20) years on the instalment plan in respect to the debentures for the said watermain. 8. That any person whose lot is specially assessed may co~!.,,*te for a payment in cash the special rates imposed thereon by paying the p~rtion of the cost of construction assessed upon such lot without the interest forthwith after the special assessment roll hms been certified by the Clerk, but may not commute after the debenture by-law has been passed. 9. That the whole of the cost of the construction of the said water- main is to be paid by the owners of land ~ wster ~res Number / as evidenced by By-law Number ~ ~ ~/ ,'hr ~o~ai cost ther~o~ ~s to be divided into two (2) parts as follows~ (a) a special assessment on the rateable property abutting or fronting on the proposed watermain at the frontage rate of Three Dollars and Sixteen Cents ($3.16) per foot frontage; (b) a special assessment on all the rateable property in the said water area Number / which will be sufficient to provide for the balance of the cost of the said watermain inclu~t-g -3- debenture charges and the cost of ~aintenance and management.
