A BY-LAW OF THE MUNICIPALITY OF THE TOWNSHIP OF PICKERING TO TAKE
OVER AS TOWNSHIP ROADS ALL 66 1 ROADS IN MONTGOMERY PARK PLAN 440
BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THE, TOWNSHIP OF PICKERING
that:
The following Roads:
(1) Susan Drive for its full 66t width.
(2) Ingrid Road from Susan Drive to Sandra Drive.
(3) Sandra Drive from Ingrid Road southerly 159'
be and they are hereby designated as Township Roads from the date of
PASSING of this By-Law.

Ontario, herein called the
CORPORATION
OF THE SECOND PART
WfiEHEA5, by petition, the Owners have requested this Corporation to create
certain improvements upon the following roads and assume same as Township
of Pickering Public Roads:
Susan Drive for its full 66'
Ingrid Road from Susan Drive
Sandra Drive from Ingrid Road
- for a total length of 1328'
AND WHEREAS the said Corporation has agreed to
terms hereinafter set out.
NOW THIS AGREEMENT WITNESSETR THAT:

The said Corporation will expend on its own authority and in its own manner so
as not to exceed the sum of $ 4,000.00 ( Four Thousand Dollars) upon the build-
ing of the roads, installing all necessary culverts and provide for suitable
drainage for the roads and such drainage taken to a proper outlet.
And the Said CORPORATION will levy the Onwers in lots 1 to 22 inclusive Plan
4405 ?00 + maximum of 8?5' to oamer of block on west side of Susan Drive and
251 for flankage on owner of lot 75' x 200' on North west corner of Susan. Drive,
the cost of such work levied on a frontage basis of total cost spread over
years 1957-1958-1959 Vjthat each of the said Owners covenant that he, she, or
they are owners in fee simple of their respective lands, and that the said
Corporation may, if it wishes, register this Agreement, or a copy of same, in the
Registry Office for the Registry Division of the County of Ontario at Whitby,
as notice to subsequent purchasers that the lands of the Owners are charged
with the aforesaidthree levies. It is also agreed by and between the said
parties hereto that the manner and method of carrying out the aforesaid
improvements on the said roads will be in the absolute discretion of the
Corporation, the officers , servants or agents of the Corporation., and that
the said Owners shall have no right of action against the said Corporation
resulting from nonfeasance or malfeasance.
AND THE SAID OWNERS agree to the installation by the said Corporation of a
Johns-Manville culvert at least 18 feet in length to be placed on the road,
in the ditch, at the driveway of each Owner, and at a place staked by the
Owner, immediately on completion of the work, if the lot is built on or unless
present culvert meets Township specifications. The Corporation agrees to install
said culvert at cost price, and to put gravel thereon., and the same will be added
to the Owners' tax bills in the year 1957.

AND THE SAID OWNERS for themselves, their respective heirs, e$ecutors
admi_r.istrators, succeseors or assigns, covenant to carry out and put into
effect the terms of this agreement.
IN WITNESS WHEREOF the Owners of the First Part have hereunto set their
hands and seals, and the Corporation of the Second Part has affixed its
Corporate Seal, duly attested by the hands of its proper officers:-
