BE IT ENACTED by the Municipal Council of the Township of Pickering that: The Reeve and Clerk be and they are hereby authorized to sign the attached Memorandum of Agreement marked as Schedule "A" which is attached to and forms part of this By-Lew. B E T W E E N THE MUNICIPAL COUNCIL OF THE CORPORATION OF HE TOWNSHIP OF PICURING, in the County of Ontario, herein called the TOWNSHIP OF THE FIRST PART - and - THE TRUSTEES OF THE POLICE VILLAGE OF CLAREMONT, in the said Township of Pickering, herein called the POLICE VILLAGE OF THE SECOND PART WHEREAS the unincorporated Village of Claremont, forming a part of the said Township of Pickering has, under authority of the Municipal Act been, by By-Law of the Municipal Council of the County of Ontario, set apart as a Police Village in the year 1908; AND WHEREAS the Agreement made on March 9, 1908s setting out the share of costs to be borne by each with services supplied is now obsolete, and a new Agreement is desirable; AND WHEREAS the Police Village have a fire truck, equipment and housing operated by a special committee which serves the Police Village and a part of the Township; AND WHEREAS on October 150 1956, Council passed a motion authorizing the cancellation of the Agreements made with the Police Village in 1908 and the authority to enter into a new Agreement; THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the premises, the said Parties hereto do hereby mutually covenant, promise and agree to and with each other, in manner and form following, that is to say: 1. Ratepayers of the said Police Village of Claremont shall pay the regular Township rates applicable to their area, but in the case of the general Township road rate same shall be credited to the V Police Village account 100o at the end of each year, as well as any grants or subsidies accruing from Police Village Street Work. 2. The Township roadbuilding machinery, with operators, will be made available to the Police Village at an hourly rate sufficient to cover operating capital and administrative costs, at times most satisfactory to the Township Engineer. 3. Traffic enforcement on streets in the said Police Village, except County roads, will be a responsibility of the Trustees. 4. All other Municipal services shall be available to the said Police Village as in other parts of the Township. 5. That in each year during the continuance of this Agreement, there shall be levied upon the property liable to assessment in the said Police Village, such rate or sums as the Trustees thereof shall by requisition under their hands require to be levied, which rate shall be called the "Village rate" and the money so collected shall be set aside by the Treasurer of the Township of Pickering in a special account for the Police Village of Claremont, and - 2 - will pay out such monies as directed by the Inspecting Trustee of the Police Village of Claremont, when presented with a voucher and proper accounts. 6. This Agreement shall commence December 31, 1956, and shall remain in force until terminated in writing by either Party prior to April 1st in any year, effective December 31st of the preceeding year. 7. The collection of all moneys under Agreements for Fire Services shall be the responsibility of the Township who shall place such moneys to the credit of the Police Village account. 8. As provided in Section 513, sub section 5, of the Municipal Act, the Police Village Trustees shall be responsible and have control of care and management of the fire engine and appliances and housing for same.
