HomeMy WebLinkAboutBy-law 2209B Y- L A W N U M B E R 2 2 0 9 A BY-LAW OF THE TOWNSHIP OF PICKERING TO TAKE OVER AND ASSUME AS A TOWNSHIP ROAD A CERTAIN ROAD IN PLAN 233. BE IT ENACTED by the Municipal Council of the Township of Pickering that: 1. THAT ROAD commencing at westerly limit of Plan 233 where it abuts sideline between Township Lots 30 and 31 immediately south of Canadian National Railway right-of-way at Rosebank and ea- tending easterly to the easterly limit of Lot 39, be and it is hereby declared a Township road as of the date of the passing of this By-Law. 2. The conditions of payment and signatures requesting such roads to be taken over, as set out on Schedule "A" shall form a part of this By-Law. BY-LAW read a First and Second time this 4day of - 195'1 BY-LAW read a Third time and PASSED this 11-t day of .1957 A/ t Reeve S C H E D.U L E " A" Attached to and Forming Tart of By-Law Number 2209 A G R E E M E N T: made this Twenty-Seventh day of December, One Thousand, Nine Hundred and Fifty-Six B E T W E E N: All Parties named who have subscribed their names hereto herein salled the OWNERS OF THE FIRST PART The Municipal Corporation of the Township of Pickering in the County and Province of Ontario, herein called the CORPORATION OF THE SECOND PART WHEREAS, by petition, the Owners have requested this Corporation to create certain improvements upon the following road and assume same as a Township of Pickering Public Road: THAT ROAD commencing at westerly limit of Plan 233 where it abuts sideline between Township lots 30 and 31 immediately south of Canadian National Railway right-of-way at Rosebank and extending easterly to the easterly limit of Lot 30; AND WHEREAS the said Corporation has agreed to make such improvements upon the terms hereinafter set out; NOW THIS AGREEMENT WITNESSETH that the said Corporation will extend its own authority and in its own manner, and so as not to exceed the sum of $ 5,944.40 (Five Thousand Nine Hundred and Forty-Four Dollars d Forty Cents) upon rebuilding the road foundation and culverts upon the said road, and providing suitable drainage; the said Corporation will levy upon its general rate Forty Percent (40%) of such expenditure and the Owners will pay on levy thereof in the years 1957-1958-1959 inclusive, the other Sixty Percent (60%) of the said Total cost, or Twenty Percent (207o) of the said total cost in each of the said three years; each of the Owners whose property abuts directly on the work, or is benefitted thereby, paying three annual levies, based on a foot frontage for each lot; that each of the said Owners covenant that he, she, or they are owners in fee simple of their respective lands, and that the said Corporation may, if it wishes, register this Agreement, or a copy of same, in the Registry Office for the Registry Division of the County of Ontario at Whitby, as notice to subsequent pur- chasers that the lands of the Owners are charged with the aforesaid three levies. It is also agreed by and between the said parties hereto that the manner and method of carrying out the aforesaid improvements on the said road will be in the absolute discretion of the Corporation, the officers, servants or agents of the Corporation; and that the said Owners shall have no right of action against the said Corporation resulting from nonfeasance or malfeasance. AND THE SAID OWNERS AGREE to the installation by the said Corporation of a Johns-Manville culvert at least 18 feet in length to be placed on the road, in the ditch, at the driveway of each Owner, and at a place agreed to between the Owner and the Corporation, immediately on completion of the work. The Corporation agrees to instal said culvert at cost price, and to put gravel thereon, and the same will be added to the Owners' tax bills in the year 1957. AND THE SAID OWNERS, for themselves, their respective heirs, executors administrators, successors or assigns, covenant to carry out and put into effect the terms of this agreement.
