HomeMy WebLinkAboutBy-law 2181B Y- L A W N U M B E R 2 1 8 1 A BY-LAW TO DESIGNATE AN AREA OF SUBDIVISION CONTROL OVER REGISTERED PLANS. WHEREAS Section 24 of The Planning Act provides as follows: 24. (1) The Council may br By-Law designate any area within the Municipality as an area of subdivision control and thereupon no person shall convey land in the area by way of a deed or transfer on any sale or enter into an agree- ment of sale and purchase or enter into any agreement that has the effect of granting the use of or right in the land directly or by entitlement to renewal for a period of 21 years o' more, (a) Unless the land is described in accordance with and is within a registered plan of subdivision, tLut the council may, in the By-Law, designate land which although within a registered plan of subdivision shall be deemed not to be within a registered plan of subdivision for the purposes of this subsection; (b) Unless the land is ten acres or more in area and the remnant, if any, remaining in the vendor is also ten acres or more in area; (c) Unless the land is the whole part remaining to the person of one parcel destrl-bed in a registered convey- ance to him'; or (d) Unless the consent, (i) of the Planning Board of the area in which the land lies, or (ii) where the land lies in more than one planning area of the Planning Board designated by the Minister from time to time, or (iii) where there is no planning board, of the Minister, is given. R.S.O. 19500 c. 277, S. 24(1); 19530 c. 80 s.6 (1,2). (la) The By-Law may provide that where land is described in accordance with and is, (a) within a registered plan of subdivision; or (b) within a registered plan of subdivision, or a part thereof, designated in the By-Law, no person shall convey a part of any lot or block of the land by way of deed or transfer on any sale, or enter into an agreement of sale and purchase, or enter into any agreement that has the effect of granting the use of or right in the land directly or by entitlement to renewal for a period of twenty-one years or more unless a consent thereto is given in the manner provided in Clause D of subsection 1. 1954, c.712 s.10(1). (2) At least two, or as many as may be required, certified copies of the By-Law shall be lodged in the office of the Minister where they shall be available for public inspection during office hours, and registered in the proper registry office where they shall be made available to the public as productions. R.S.O. 1950, c. 277. s.24 (2). -2- (2a) Where land within a registered plan of subdivision is deemed under the By-Law not to be within a registered plan of sub- division, the clerk of the municipality shall, within ten days after the By-Law is passed, send notice of the passing of the By-Law by registered mail to the last-known address of each person appearing by the last revised assessment roll to be the owner of any of such land. 1952, c.750 s.9. (2b) Where the By-Law contains provisions authorized by subsection la, the clerk of the municipality shall, within ten days after the By-Law is passed, send notice of the passing of the By-Law by registered mail to the last known address of each person appearing by the last revised assessment roll to be the owner of land within any registered plan of subdivision, or within any part of a registered plan of subdivision, to which such provisions apply. 1954, c.71, s.10 (2). (3) When an area is designated as an area of subdivision control it shall not be altered or dissolved without the approval of the Minister. (4) Every person who contravenes this section shall be guilty of an offence and on summary conviction shall be liable to a enalty of not more than $500.00. R.S.O. 1950, c.2770 s.24 ?3,4); AND WHEREAS on the 24th day of January, 1949s Council passed By-Law Number 1771 providing for control of all lands within the Township of Pickering not registered by Plan; NOW THEREFORE, the Councii of the Corporation of the Township of Pickering hereby ENACTS AS FOLLOWS: 1. The following described area is hereby designated as an area of subdivision control to be known as Area of Subdivision Control No. 3, in accordance with section 24 of the Planning Act; "" 10A A.o 'rs iW Plan registered in 1865 in the north part of Lot 24, Concession 1, Township of Pickering& known as the Bostwick Plan, and Plan 612 comprising Lots 1 to 255 inclusive. ? The following described land within Area of Subdivision Control No. 3 is hereby designated as land which although within a registered plan of subdivision shall be deemed not to be within a registered plan of subdivision for the purposes of subsection 1 of section 24 of The Planning Acts Asti ra,E ties 1w Plan registered in 1865 in the north part of Lot 24, Concession 1, Township of Pickering, known as the Bostwick Plan, and Plan 612 Hcoc•Ki} comprising Lots 1 to 255 inclusive. 91 3. This By-Law shall come into force and take effect on the day that it receives third reading.
