HomeMy WebLinkAboutBy-law 2139BY - L_AW _ NU?1_BER----Z_l 3-9 A BY-LAW OF THE CORPORATION OF TIIE TOWNSIITP OF PICKERING TO PROHIBIT THE MAKING OF PITS AND OUARRTEES TN TIIE SAID TOWNSHTP AND REGULATING THE LOCATION TH[REOF. WUEREAS paragraph 115 of subsection 1 of section 3S8 of The Municipal Act, R. S. 0. 19511.5 chapter 243 and amendments thereto provides that Municipalities may pass by-laws for prohibiting the making of pits - and quarries in a mtuiicipality,and regulating the location thereof. NOS. THEREFORE BE IT ENACTED and it is hereby enacted as a by-law of the Corporation of the Township of Pickering by the Council thereof as follows: 1. No person shall make a pit or quarry- in the Township of Pic'.rering or pern:iit a pit or quarry to be made on property owned by hir: in said Township, wiless (? (a) an application for permission so to do, accompanied by such information as 1'? may be required has been made to Council for J the Corporation of the Township of Pickering, and (b) the approval of the Corporation of the Township of PickerinG has been obtained and permission Given for the making of such pit or quarry. 2. No person shall hereafter abandon a pit or quarry in the Township of Pickering or permit a pit or quarry to be abandoned on property owned by hire in said Township, unless (a) permission so to do has been obtained from the Council of the Corporation of the Township of Pickering, and (b) the pit or quarry has been backfilled. and levelled. to the satisfaction of the Township of Pickering Engineer. (c) a pit or quarry shall be deemed to be abandoned when there has been no removal, of stone, sand or any other substance therefrom for a period of/months consecutive time. 3. Any person convicted of a breach of any of the provisions of this by-law shall forfeit and pay, at the discretion of the convicting magistrate, a penalty of not more than X300.00 exclusive of costs or, in default of payment thereof, imprisonment for a tern: of not more than 21 days. 4. Where a person is directed by this by-law to backfill and level a pit or quarry site and he fails to do so, after reasonable notice, in writing, directed to him at his last known place of residence, said. backfilling and levelling shall be done by the agents of the Corporation of the Township of Pickering and the cost thereof recovered by said Corporation by action against said person and, in the case of non-payment, the expense thereof may be recovered in like manner as municipal taxes. 5. All provisions of by-laws or amendments thereto inconsistent with the provisions of this by-law are hereby repealed.
