HomeMy WebLinkAboutBy-law 1868BY LAW NO. 1868 of The Corporation of the Township of PICKERING A By-law to authorize the Corporation to enter into an agreement with The Hydro-Electric Power Commission of Ontario for street lighting. . WHEREAS a majority of the resident freeholders according to the last revised assessment roll residing within the area described in the petition have petitioned the Council of the Corporation of the Township of PICKERING to procure from The Hydro-Electrid Power Commission of Ontario, street lighting in the said area, and the said petition was accompanied by the certificate of the Clerk,of the Township stating that it was signed by a majority of the said resident freeholders; AND WHEREAS pursuant to such petition the Council of the said Township have requested The Hydro-Electric Power Commission of Ontario to supply electrical power or energy for that purpose; and The Hydro-Electric Power Commission of Ontario has furnished estimates of the cost thereof; AND WHEREAS notice was duly given to each of the petitioners signing the said petition that the Council of the Township would, at a special meeting called for that purposer consider the said estimates; AND WHEREAS the Council of the said Township at such meeting held within one month after the delivery of said estimates, namely on the Fourth day of J ?r L Y , 19 54 considered the said estimates, and heard the petitioners; AND WHEREAS at the close of the said meeting there were re- maining on the petition a sufficient number of names to constitute - 2 - a majority of the resident freeholders within the said area; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING enacts as follows:- nn lU 1. THAT the Corporation of the Township of PICKERINgo enter into an agreement with The Hydro-Electric Power Commission of Ontario for street lighting in the said area, a copy of which agreement is hereto attached and forms part of this By-law; 2. THAT the Reeve and Clerk of the Corporation be and they are Yfi I hereby authorized and required to execute the said agreement on behalf of the Corporation and to affix the Corporate Seal there- to and to deliver such agreement when executed to The Hydro- Electric Power Commission of Ontario; 3. THAT SIXTY P-,RCENTof the cost incurred under said agreement for street lighting in the area therein described be raised, levied and collected by an annual special rate upon the taxable property lying within the said area; ' 4. THAT FORTY PERCENTOf the cost incurred under the said agreement for street lighting in the area therein described be paid by the Corporation and be chargeable to the municipality as a whole. ?j 5 THAT By-Law No. 1825 be and the same is hereby repealed. {v DATED at BROUGHAM, Ontario and finally passed this 4"414 day of 1/17_ A.D. 1951. .............. .. ......... ?' B (By-Law 1868) TO THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF PICKERING THE PETITION of the undersigned resident freeholders in the unincorporated Village of Whitevale, in the Township of Pickering and County of Ontario, as the said Village is laid out on northerly parts of lots numbers 30, 31 and 32 in the Fourth Concession of the said Township of Pickering and on the southerly parts of lots numbers 30, 31 and 32 in the Fifth Concession of the said Township, as delineated upon the Municipal Plan of said Village, prepared by John Shier, Provincial Land Surveyor, and filed in the Registry Office for the Registry Division of the County of Ontario in the year 1869, beg to askt- (1) That your Honorable Body be pleased to request the Hydro-Electric Power Commission of Ontario to furnish an estimate of the cost of electrical power or energy for the purpose of lighting the public highways and streets in the said Village of Whitevale, and upon receipt of such estimates that the same be submitted to the said resident freeholders of the said Village, at a special meeting of the Council to be called for the purpose, after due notice to the said freeholders; and that at such special meeting any or all of your petitioners to have the privilege of withdrawing their names from this petition; but if, after deducting all such withdrawals, at the termination of such meeting there remains signed to this petition a majority of the resident free- holders within the limits of the said Village, then that your Honorable Body be pleased to enter into a contract with the said Hydro Electric Power Commission of Ontario, under procedure similar to that provided in Part 3 of the Power Commission Act, for the lighting by the said Commission of the highways and streets in the said Village. (2) And that the cost of such installation of street lights and the furnishing,from time to time, be made a charge upon the assessable property in the said Village of Whitevale, less any part or parts thereof that may be assumed by the Municipality of the Township of Pickering; and that money to defray the cost of installing such street lights be advanced by the said Municipality as a loan, or raised by the issue of Municipal Debentures, repayable in yearly instalments during a short term of ,years. (3) Your petitioners beg to ask that at least 14 lights be placed on the highways and streets of the said village and recommend that such lights be placed at or near the following points thereon, viz: 1. Suspension light at Scott and Main Streets 2. On fifth hydro pole from cor.Main and Scott on N. side of Main. At Mutual and Main - S.W.Conner. !} vAt west end of bridge on Main, where existing light is, supplying new 5.. vOn S. side of Main outside the Whitevale Flour Mill. bracket. 6. Second Hydro pole from bridge on North side 7. Outside library on S. side. New pole to be put in in co-op with Tel.Co. 8. -On Main Street S. side, directly opposite N. street (new pole) 9. 'Hydro pole E. of general store on the N. side. 10. East of Baptist Church; south side. 11. At the top of the hill. A suspension light 12. Corner of Church and North streets, opposite Oddfellows Hall, N.W.Cor. 1 . -Corner Church and Gladstone Streets, S.W.Corner. 14. ?On Church Street, first Hydro Pole from Mill Street S. side.
