HomeMy WebLinkAboutBy-law 1827$Y - LAW N UMBER #1827 y of the Corporation of the Township of Pickering, to accept an agreement with certain owners in Fairport to take over certain private roads as Township roads. WHEREAS over 66% of Owners of properties in the Northern part of Fairport have signed the attached agreement called"Schedule A" and have petitioned Council to take over certain roads in Fairport. AND WHEREAS the Council view with favor the granting of such petition; BE IT THEREFORE ENACTED by the Municipal Council of the Township of Pickering:- 1. That the following private roads shall be taken over as Township Roads. _' (a) Park Road - from the north end of Front Street to Browning Avenue, a distance of approximately 630 feet. 7 (b) Browning Avenue - from Park Road westerly to Marsh, approximately 625 feet. P 7j'. (c) Fairview Avenue - from Browning Avenue northerly 800 feet to North limit of Lot 1 r? 2. That the said Streets will be taken over in accordance with agreement in Schedule A of this By-law. 3. The Corporation will assume said roads on completion of work as specified in "ScheduleA". S C H E D U L E " A" (ATTACHED TO AND FORMING PART OF BY-LAW #1827) AGREEMENT made this BETWEEN : First day of August 1950, All Parties named who have subscribed their names hereto, herein called the "OWNERS", of the First part: AND The Municipal Corporation of the Township of Pickering, in the County and Province of Ontario, herein called the "CORPORATION" of the Second part: WHEREAS by petition the Owners have requested this Corporation to create certain improvements upon the following roads within the limits of the subdivision of FAIRPORT VILLAGE :- 1. Park Road - from the north and of Front Street to Browning Avenue, a distance of approximately 630 feet. 2. Brownin Avenue - from Park Road westerly to Marsh, approx ma e y 25 feet. 3. Fairview Avenue - from Browning Avenue northerly 800 feet to Nor h imit of Lot 1. AND WHEREAS the said Corporation has agreed to make such improvements upon he terms hereinafter set out:- NOW THIS AGREEMENT WITNESSETH THAT the said Corporation will extend on its own author-M-77-07n its own manner, and so as not to exceed SIX HUNDRED AND FIFTY DOLLARS ($650) upon rebuilding the road foundation and culverts upon the said roads; the said Corporation will levy upon its general rate FORTY PERCENT (40%) of such expenditure and the Owners will pay on levy thereof in the years 1951, 1952 and 1953 the other SIXTY PERCENT (6096) of the said total cost, or TWENTY PERCENT (20%) of the said total cost in each of the said three years, each of the Owners, whose property abuts directly on the work or upon land immediately benefitted by the work, paying an equal share, the one with any other one of them, in each of the said each of the said Owners covenant that in fee simple of their respective lands and that the said Corporation may, if agreement, or a copy of same, in the Re Registry Division of the County of Onta to subsequent purchasers that the lands with the aforesaid three levies, it is the said parties hereto that the manner out the aforesaid improvements on the s absolute discretion of the Corporation, or agents of the Corporation; and that have no right of action against the sai from nonfeasance or malfeasance. three annual levies; that he, she, or they are owners in the said subdivision, they wish, register this gistry Office for the rio at Whitby, as notice of the Owners are charged also agreed by and between and method of carrying aid roads will be in the the officers, servants the said Owners shall d Corporation resulting AND THE SAID OWNERS AGREE to the installation by Corporation of a STEEL CULVERT to be placed on t the ditch, at the driveway o each Owner, and at agreed to between the owner and the Corporation on completion of the work.
