WHEREAS after many meetings between the members of Council and the Central Mortgage and Housing Corporstion sn Agreement hes been reached concerning the costs of social services given the AJsx Area by this Township during the period 1942 to 1947 inclusive and also for servicss to be given in 1948 and 1949. AND WREREAS the said Agreement is attached hereto end marked Exhibit AND WHEREAS it is necessary that Council authorize the Reeve and Clerk to sign this agreement on behalf of the Municipality, BE IT TltEREFORE ENACTED by the Municipal Council of the Township of Picketing: That the attached Agreement as submitted by Central Mortgage and Housing Corporation be accepted by the Council of this Municipality and the Reeve and Clerk be duly e~thorized to sign on behalf of the Municlpelity snd affix the Seal of the Municipality to ssid Agreement. Exhibit "A" T~IS AGREEMENT made in triplicate this 1st day of May, A.D., 1948. BETWEEN: HIS MAJEST~ THE KING IN RIGR~T OF CANADA represented by CENTRAL MORTGAGEAND HOUSING CORPORATION (hereinafter called "His Majesty"). OF T~ FIRST PART, THE CORPOP~ATION OF TR~CO~TY OF ONTARIO (hereinafter celled "The County"). OF THE SECOND PART, -a nd - T~ COR!m0RATION OF THE TOWNSHIP OF PICKERING (hereinafter celled "The Township"). OF THE THIRD PART: WHEB~AS His M~Jesty is the owner of certain lands and buildings, houses, plant and equipment situate in the Township of Pickering in the County of Ontario in the Province of Ontario on lands described as foll~s: (8) 106 acres more or less located on the northerly side of the Queen Elizabeth Highwsy upon which sro situated 600 dwelling units. (b) 2755 acres more or less located on the southerly side of the Queen Elizabeth Highway and extending from the Queen Elizabeth Highway to Lake Ontario upon which sro situated b,~ildings, houses, plant and equipment formerly operated by Defence Industries Ltd. All of which said lends and premises ere commonly known end are hereinafter referred to as the Ajax area. A_krD WI~REAS His Majesty has supplied the Ajax Area with oertsin Municipal services and the County and Township have supplied certain other services which would normally be paid for from taxes collected from the property. AND WHEREAS in fact no Municipal taxes have been levied or collect- ed from the said property and the County and the Township have received no revenue therefrom. AND ~tEREAS the County and the Township have bean put to the expense of incurring costs in respect of the following services for the Ajax Area: Children's Aid Society Secondary School Education 0nterio Trsining School Tuberculosis After Care Administration ef Justice Hospitalization of Indigents Last Post Fund Children's Aid ~ltness Fees. AND WHEREAS His Majesty is prepared to reimburse the County end the Township for all costs and expenses incurred by them or either of them in supplying the eforessid services to the Ajax area to December 31st, 1947, by payln$ to the County the sum of $21,361.30 snd to the Township the sum of $3,27§.98. Exhibit "A" cont'd -£- AND ~IIEREAS the County and the Township have respectively agreed with His Majesty that such payments will be accepted in full settlement of all claims that the County and the Township may have against His Majesty arising out of or pertaining to the operation of the said properties known ss the Ajax Ares up to December 31st, 1947, and that no claims, levies or charges will henceforth be mede by either the County or the Township against His Majesty or otherwise in respect thereof. ~ wHeREAS it is desired by all parties hereto to enter into an agreement whereby such services as hews been in the past supplied by the County end Township will be continued to be supplied by the County and the Township for the years 1948 and 1949; the County and the Township to be reimbursed therefor by His Majesty on the terms hereinafter set forth: NOW THEREFORE THIS AGREEMENT WITNESSETH that the Parties hereto mutually covenant and sgree ss follows: His Majesty agrees to pay to the County forthwith the sum of $21,361.30 in full payment end satisfaction of sny and all claims of the County in respect of all costs incurred by the County to December 31st, 1947 for services supplied in connection with or pertaining to the Ajax Area end the tenants and occupants thereof. His Me Jesty agrees to pay to the Township forthwith the sum of $3,275.98 In full payment and satisfaction of any end all claims of the Township in respect of all costs incurred by the Township to December 31st, 1947 for services supplied in connection with or pertaining to the Ajax Area and the tenants and occupants thereof. In consideration of the aforesaid payments the County end Township do respectively release His Majesty from all manner of claims and demsnds whatsoever which s~ainst His Majesty the County and Township, either Jointly or individually, either did hsve, now have, or hereafter can, shall or may have for or by reason of the herein- before recited services. His Majesty covenants end agrees that during the period of two years from January 1st, 1948 to December 31st, 1949 His Majesty will pay to the County the smount of $9,000.00 per annum in half-yearly instalments payable June 30th and December 31st in each year for costs incurred during the said period by the County for supplying the following services to and for the Ajax Area and the tenants or occupants thereof: Children's Aid Joclety Secondary School Education Ontario Training ~chool Tuberculosis After Care Hospitalization of Indigents Administration of Justice Costs incurred and paid by the County in respect of proceedings in any Court held in the County of Ontario in which any resident, tenant and/or depend- ent thereof is s party in civil proceed- lnge or the accused in criminal pro- ceedings. As soon as may be possible after the end of each year, the County will render to ~is ~ajesty an account of 9ctual expenditures in connection with the above services ~nd upon approval by ~'i~ ~aJesty ~n adjustment will be made to the sald ~nnusl payment by increasing or decreasing the amount thereof in accordance with ~he actual co,roved expenditures. Exhibit "A" cont'd -3- ~lis Majesty covenants snd agrees that during the period of two years from January 1st, 1948 to Recember 31st, 1949 His Majesty will pay to the Township the smount of ;~1,500.00 per annmn in hslf-yea~rly instalments payable June 30th and December 31st in esch year for costs incurred by the Township for the fol~owlng services: ~econdary School Education Ontario Treinin~ School Tuberculosis After Care Hospitaliz.~tlon of Indigents The Last Post Fund Children's Aid qitness Fees Unemployment ~elief. As soon as may be possible at the end of each year, the Township will render to His Majesty an account of sctual expenditures in connection with the above services and upon approval by His Majesty an adjustment will be made to the said annual payment by increasing or decreasing the amount thereof in accordance with the actual approved expenditures. It is a~reed with the parties hereto that the aforasaid amounts to be paid by His Majesty to the County end Township respectively shall be in lieu of all ;.,iunicipal taxes, charges, levies or assessments against the said Ajax Ares or tenants and occupants thereof. 'i'he County and Township respectively a~ree to keep proper records snd books of account showing charges ~ndexpenditu~es incurred by them or either of them with respect to the aforesaid services and such books, records, accounts end sll docu~nts with respect thereto shall at all times be open for inspection by His Majesty. Items included under the heading Children's Aid Society sh~ll not include costs billed to the County or pald by the County during the said period of two years in respect of wards created on the basis of residence established in the Ajax Ares prior to January 1st, 1948 with the exception of sixteen eases now reco~nized by His Majesty.
