All Parties named who have subscribed their names hereto, hereinafter called "The O~ners" OF THE FIBST PART AND The Hunicipal Corporation of the Township of Picketing in the County and Province of Ontario, hereinadter called "the Corporation", OF THE~S~COND PART WHEREAS by petition the owners have requested the Co~poration to create certain improvements upon the Spruce Hill Road, located on subdivisions of Township Lot Number 27 in the first concession of the said township, the east-half of said Township lot being subdivided under the name of "Dunbarton Gardens" and the west-half thereof under the name of "Bayview", and the said Spruce Hill Road extending from the southern limit of said tom ship lot to its norther~ limit. AND WHEREAS the said Corporation has agreed to make such improvements upon the terms hereinafter set out. NO__~WTHI.S. A6.REEMENT._WITNESSETH that the said Corporation will extend on its own authority and its own manner and so as not to exceed Twelve Hundred Dollars ($1,200.00) upon rebuilding the road foundation and culverts upon the said Spruce Hill Road. The said Corporation will levy on its general rate forty per cent (40%) of such expenditure; that the owners will pay on special levy during the years 1942, 1943 and 1944 the other sixty per cent (60%) of the said cost, in equal shares or amounts, the one with the other of such owners; and one-third of the said sixty per cent shall be levied by special rate in each of said three years on the lands of said owners and paid by them respectively, and shall constitute a charge upon their said lands ~espectively, located in either or both of said subdivisions; and in each of said three years said amounts shall be entered upon the Collector's Roll and collected and paid with the other rates of taxation in each of said three years, in equal shares or amounts, the one with the other; and one third of the said sixty per cent shall be levied upon the lands of the said Owners in each of said three years and shall constitute a charge thereon; and in each of said years shall be charged upon the said owners respectively and upon the respective lands o~ned by them in either or both o£ the said subdivisions; and in each of said three years shall be entered upon the Collector's Roll of the said municipality of the Township of Picketing and collected with the other rates of taxation from the said Owners. AND THE SAID OWNERS AGREE that this document may be registered in the RegistRY office for the County of Ontario as notice to subsequent purchasers that the lands are charged with for the said three annual tax levie~ in the proposed sum to be payable by each such Owner; and that the manner and method of carrying out the said improvements will be in the absolute discretion of the said Corporation, its officers, employees or agents. AND THE SAID OWNERS for themselves their respective heirs, executors, ad- ministrators and assigns covenant to carry out and put into effect the terms of this agreement. All herein contained shall enure to the benefit of and be binding upon the parties hereto, their respective heirs, executors, administrators and assigns.
