HomeMy WebLinkAboutBY-law 1326B Y- L A W N U M B E R 1 3 2 6 A BY-LAW TO CLOSE A CERTAIN PORTION OF THE ROAD ALLOWANCE BETWEEN CONCESSIONS ONE AND TWO, OPPOSITE LOT NUMBER NINETEEN IN CONCESSION ONE, OF THE SAID TOWNSHIP OF PICHERING, AND FOR THE CONVEYANCE OF SUCH CLOSED PORTION TO SCARBORO SECURITIES LIMITED, AND FOR ESTAB- LISHING AS A PUBLIC HIGHWAY OF CERTAIN LAND IN LIEU OF THE SAID PORTION OF HIGHWAY TO BE CLOSED. WHEREAS It is expedient in the public interest to close, stop up, and convey to the Scarboro Securities Limited a portion of the road allowance as hereinafter described and to establish as a highway in lieu thereof certain land also as hereinafter described. AND WHEREAS printed notices of this By-Law have been posted up for four weeks in six of the most public places in the immediate neighbourhood of the portion of said highway to be closed as aforesaid and of the said lands to be established as a highway, and said notice has been published for four consecutive weeks in the Pickering News, a newspaper published in the said Township of Pickering. AND WHEREAS the Council of the Municipality of the said Township of Pickering, has heard, in person or by Counsel or Solicitor, all persons whose lands might be prejudicially affected by the passing of this By- Law, who petitioned so to be heard. Now wherefore the Council of the Corporation of the Township of Pickering ENACTS AS FOLLOWS: 1. That from and after the passing of this By-Law that portion of the road allowance between Concessions One and Two opposite Lot Number Nineteen of the said Township of Pickering which is described as follows, that is to say: All and singular that certain parcel or tract of land and premises situate, lying and being in the Township of Pickering, in the County and Province of Ontario, and being composed of part of the road allowance between Concessions One and Two of said Township, said parcel or tract of land being more particularly described as follows: Commencing at the intersection of the Northerly limit of the road allowance between Concessions One and Two, with the production northerly of the Westerly limit of Lot Number 19 in the First Con- cession of said Township; Thence North 74 degrees, East along said Northerly limit a distance of 682 feet 62 inches to a point; Thence South 15 degrees 46 minutes East, a distance of 12 feet 81 inches to a point- Thence South 71 degrees 05 minutes, West a distance of 605 feet Sz inches to a point; Thence SQnth 56 degrees 40 minutes, West a distance of 82 feet 3 inches to a point in the said Northerly production of the Westerly limit of loot Number 19, said point being distant Southerly 64 ft. 3J inches from the place of beginning; Thence North 15 degrees 46 minutes West a distance of 64 feet 3} inches, more or less to the place of beginning, be and the same is hereby stopped up and closed as a public highway. 2. That the following parcel or tract of land, which is described as follows, that is to say: All and singular that certain parcel or tract of land and premises situate, lying and being in the Township of Pickering, in the County and Province of Ontario, being composed of part of Lot Number Nineteen in the First Concession of said Township, which said parcel or tract may be more particularly described as follows: Commencing at the North West angle of said Lot Number 19, Thence North 74 degrees, East along the Northerly limit of said Lot Number 19 a distance of 682 feet 61 inches to a point; Thence South 15 degrees 46 minutes East, a distance of 12 feet 91 inches to a point; Thence South 71 degrees 05 minutes, West a distance of 593 feet 512 inches By-Law Number 1326 - 2 - to a point; Thence South 56 degrees 40 minutes, West a distance of 94 feet 4 inches to a point in the Westerly Limit of said Lot Number Nineteen, said point being distant Southerly 67 feet 6 inches from the place of beginning; Thence North 15 degrees 46 minutes West a distance of 67 feet 6 inches, more or less, to the place of beginning, be and the same is hereby established as a public highway. 3. That the Reeve and Clerk are hereby authorized and directed to execute under the Corporate Seal of the said Township and deliver to the said Scarbor Securities Limited, a conveyance of the portion of highway hereby closed and stopped up in exchange for a conveyance to the Township of the land hereby established as a public highway. 4. This By-Law shall take effect forthwith upon being confirmed by By-law of the Council of the Corporation of the County of Ontario, passed in pursuance of the Section 483 (6)of the Municipal Act.
