W1JT43REAS by reason of the construction of the Campbellford, Lake Ontario, and Western Railway throu,11 the Township of Pickerin-•, in the County of Ontario, crossing the road allowance between Concessions Three (3) and Four (4) at Lots Seventeen and Eighteen in the Fourth Concession of the said Township, and with a view to eliminating the dan-lerous crossing on this road, it has become expedient in the public interest to close and divert a portion of the said road allowance, and to acquire other lands for the purposes of such diversion. AND WHEREAS by Order Number 17681 of the Board of Railway Commissioners for Canada, dated October 8th, 1912, it was authorized and directed that the said road allowance be closed and diverted as therein and thereby specified, and the same having been approved of by the Reeve and Clerk of the said Township on April 8th, 1912, it is expedient to -live formal effect to such closing and diversion by means of this By-Law. AND WHEREAS printed notices of this By-Law have been heretofore posted up for one month in six of the most public places in the immediate neighbourbrood of the portion of the said road allowance to be closed as aforesaid, and published weekly for four successive weeks in the Pickering News, a newspaper published in the Township of Pickering. AND WHEREAS the Council of the said Township of Pickering has heard in person Counsel or Solicitor all persons whose lands might be prejudicially affected by the passing of this By-Law and who petitioned to be so heard; NOW THEREFORE the Municipal Council of the Township of Pickering ENACTS AS FOLLOWS: 1. THAT upon and after the passing of this Ay-Law all that portion of the road allowance between Concessions Three (3) and Four (4) in the said Township described as follows: ALL AND SINGULAR that certain portion of the road allowance between Concessions Three (3) and Four (4) in the Township of Pickering, County of Ontario and Province of Ontario, shown coloured on the plan hereto attached and containing an area of fifty-three hundredth of an acre (0.53), more or less, the limits, dimensions and bearings of said portion of road allowance being described as follows: CO11MNCING at a point on the Northerly limit of said road allowance, said point being distant twenty-two feet and four-tenths of a foot (22.41) from the south-easterly angle of Lot Eighteen (18), measured in an easterly direction along said northerly limit of road allowance; THENCE north seventy-seven degrees 26 twenty-six minutes east (N.77o 261E), three hundred and forty-sine feet (3491) along the last mentioned limit; THENCE south sixty degrees hundred and thirty-one feet of said road allowance; THENCE south seventy-seven 21' W) along said southerly (3490; thence.. forty-five minutes west (S 60o 45' W) two (2311) to a point on the southerly limit degrees, twenty-one minutes west (S 770 limit three hundred and forty-nine feet THENCE north sixty degrees forty-five minutes east (11. 600 451 E) two hundred and thirty-one feet (2311) to the point of commencement; - 2 - BE AND THE SAME IS hereby closed up. 2. AND WHEREAS the Campbellford, Lake Ontario and Western Railway Company, owner of lands adjoining the portion of said road allowances to be closed as aforesaid, has offered to acquire the said closed portion of road allowance for the purpose of their Railway, and give in exchange therefor and convey to the Corporation of the Township of Pickering, and to construct the road thereon, free of charge, for the purposes of road diversion, in lieu of the said portion of road allowance to be closed, the lands as hereinafter described, that is to say: ALL AND SINGULAR those certain parcels of Lots Seventeen (17) and Eighteen (18), Concession Four (4) in the Township of Pickering, County of Ontario and Province of Ontario, shown coloured yellow on the plan hereto attached and having a total area of ninety-four hundredths of an acre (0.94), more or less, the limits, bearings and dimensions being described as follows: FIRSTLY: All that portion of Lot Seventeen (17) north of road allow- ance between Concession Three (3) and Four (4), containing an area of seventy-nine hundredths of an acre (0.79), more or less, and being described as follows: COMIIENCIXG at the south-west angle of Lot Seventeen (17); THENCE north seventy-seven degrees twenty-six minutes east (N. 770 261 E) along the northerly limit of road allowance between Concessions Three (3) and Four (4) twenty-two feet and four tenths of a foot (22.41); THENCE north Sixty degrees forty-five minutes East (N. 600 45' E) three hundred and thirty-three feet and five tenths of a foot (33.51), measured along the north-westerly limit of the right-of-way of the Campbellford, Lake Ontario and Western Railway; THENCE south twenty-nine degrees fifteen minutes East (S. 290 151 E) one hundred feet (1001) to a point on the said northerly limit of road allowance; THENCE along the last mentioned limit north seventy-seven degrees twenty-six minutes East (N. 77o261E) sixty-eight feet and six tenths of a foot (68.60; THENCE north twenty-nine degrees fifteen minutes west (N. 290 151 W) one hundred and eighty-five feet and eight tenths of a foot (185.81); THENCE SOUTH sixty degrees forty-five minutes west (S. 600 45' W) four hundred and three feet and eight tenths of a foot (403.81) to a point on the westerly limit of said Lot Seventeen (17); THENCE south thirteen degrees, thirteen minutes East (S. 130 13' E) along the westerly limit of said lot seventeen (17) sixty-one feet and five tenths of a foot (61.51) to the point of commencement. SECONDLY: All that portion of Lot Eighteen (18) north of road allow- ance between Concession Three (3) and Four (4), containing an area of fifteen hundredths of an acre (0.15), more or less, and being described as follows: COMMENCING. at the south east angle of Lot Eighteen (18); THENCE south seventy-seven degrees seventeen minutes west (770 171 W) along the northerly limit of road allowance between Concession Three (3) and Four (4) two hundred and seven feet and four-tenths of a foot (207.41); THENCE north sixty degrees forty-five minutes east (iN. 600 45' E) two hundred and sixteen feet (2161) to a point on the easterly limit of said Lot Eighteen (18); - 3 - 2. (Continued) THENCE south thirteen degrees thirteen minutes east (S 130 13, E.) along the last mentioned limit sixty-one feet and five tenths of a foot (61.51) to the point of commencement. AND THE SAID COUNCIL OF THE TOWNSHIP OF PICICERING FURTHER EXACTS that the said last described lands be and they are hereby established as a public highway in lieu of the portion of the said road allowance closed as aforesaid. 3. THE SAID COUNCIL FURTHER ENACTS as follows: That the Reeve and Clerk of the said Township be and they are hereby authorized and directed, upon receiving a conveyance to the Municipal Corporation of the said Township of Pickerin of the said lands described in Para graph 112" above numbered, to execute under the Corporate Seal of the said Township and to deliver to the said Railway Company a conveyance of the portion of the said road allowance described in Paragraph "1" above numbered. THIS BY-LAW shall take effect forthwith upon the passing thereof, subject to confirmation by the Municipal Council of the County of Ontario, as By-Law provided. (Signed) R, R. Beaton - Clerk A Y - L A W N U M B S 1 0 7 1 A B7-LAW TO CLOSE A PORTION OF THE ROAD ALLOWANCE BETWEEN CONCESSIONS THREE (3) AND FOUR (4) AT LOTS SEVENTEEN AND EIGHTEEN IN THE FOURTH CONCESSION OF THE TOWNSHIP OF PICYERING. WHRMS by reason of the construction of the Campbellford, Lake Ontario, and Western Railway through the Township of Pickering, in the County of Ontario crossing the road allowance between Concessions Throe (3) and Four (41 at late Seventeen and Eighteen in the Fourth Concession of the said Township, and with a view to eliminating the dangerous crossing on this road, it has become expedient in the public interest to close and divert a portion of the said road allowance, and to acquire other lands for the purposes of such diversion. AND WBMW by Order Number 17681 of the Board of Railway Commissioners for Canada, dated October 8th, 1912s it was authorised and directed that the said road allowance be closed and diverted as therein and thereby speoified# and the same having been ap roved of by the Rmeve and Clerk of the said Township on April 8th, all it is expedient to give formal effect to such closing and diversion by means of this By-Law. SECONDLY: All that portion of Lot Eighteen (18) north of road allow- ance between Concession Throe (3) and Four (4)0 containing an area of fifteen hundredths of an more ((0.18), more or less, and being described as follows: COMMENCING at the south east angle of Lot Eighteen (18); THENCE south seventy-seven degrees seventeen minutes west (770 171 W) along the northerly limit of road allowance between Concession Throe J3) and Four (4) two hundred and seven feet and four-tenths of a foot 207.40; THENCE north sixty degrees forty-five minutes east (N. 600 461 E) two hundred and sixteen feet (2161) to a point on the easterly limit of said Lot Eighteen (18); - 3 - S* (Continued) TRSNCR south thirteen degrees thirteen minutes east (s 130 13+ to) along the last mentioned limit sixty-one feet and fire tenths of a foot (81.130) to the point of oommencemant. AND TRR MID COONCIL OF TRB TOWNSHIP OF PICKERING FURTRRR BRACTS that the said last desoribed lands be and they are hereby established as a public h1shway in lieu of the portion of the said read allowance closed as aforesaid. 3. VHS SAID CWKCIL FORTARR BRACTS as fellows: That the Reeve and Clerk of the acid Township be and they are bereby authorised and directed, upon reoeiving a conveyance to the Municipal Corporation of the said Township of Pickering of the said lands described in Paragraph 020 above numboreds to execute under the Corporate Seal of the acid Township and to deliver to the said Railway Company a oonveyanoe of the portion of the said road allowance described in Paaragraph 01" above numbered. THIS BY-TAW shall take effect forthwith upon the passing thereof, subject to confirmation by the Municipal Council of the County of Ontario, as Ay-Law, provided. (Signed) Re R.
