HomeMy WebLinkAboutBy-law 3745/69 COR O T O being a by..-law regarding fences around private outdoor swimming pools WHEREAS The Municipal Act, R~S 0 1960, Chapter 249 as amended, Section 379 (1) paragraph 23~ authorizes the Council of the Corporation of the Township of Pickering to pass By-laws requiring owners of privately o~%ed outdoor swimming pools to erect and maintain fences around such swimming pools,. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: ']. For the purposes of this By.~law a privately owned outdoor swimming pool shall mean a body of water permanently or temporarily located outdoors on privately owned property above or below grade, contained by artificial means and used or maintained for the purposes of swimming, diving or bathing and which body of water or any part thereof has a depth of more than twenty inches (2~"). No owner of a privately owned outdoor swimming .pool shall construct or maintain such swimming pool unless there is erected and maintained around such pool a fence which shall be of a height of at least four feet (4') and of a chain link or other design such as will reasonably deter any children from climbing over it to gain entry into the fenced in area 3 Any gate in such fence shall be of a similar or other adequate design to the fence and shall be equipped with a lock and shall be locked at all times except when b. the fenced in area is actually being used by the owner of the property on which it is located or the owner's duly ~uthorized agents Any person convicted of a breach of any provisions of this By.~law shall 2orfeit and pay at the descretion of the Convicting Magistrate a penalty not exceeding, exclusive of costs~ the sum of Three Hundred Dollars ($35,] ~') for each offence By-.law Number 2521 be and the same is here~y repealed, READ a FIRST, SECOND and THIRD time and passed
