HomeMy WebLinkAboutBy-law 3688/69 being a by-law to authorize the construction of sanitary sewers, watermains and roads on Salk Road, Plummet Street and Brock Road as local improvements under the prov- isions of Sections 8 and 67 of The Local Improvement Act . WHEREAS it is expedient that the construction of the works herein in Lot 19 in Concession 1 of the Township of Picketing shall be undertaken at the cost hereinafter set out as local improvements under the pzovisiors of Section 8 of The Local Improvement Act; AhD WHEREAS the cost of the said works is to be levied by imposing special assessments therefor against lands in a local improvement area hereinafter defined, pursuant ~o Section 67 of The Local Improvement Act; AND W}IEREAS notice of the intention of Council to the said construction and imposin~ of special rates has been published; NOW THEREFORE THE COUNCIL OF THE CORPORATION (F THE TOWNSHIP OF PICgERING ENACTS AS FOLLOWS: 1. That sanitary sewers be co~ructed on the west side of Brock Road from 20 feet south of the north street line of Bayly Street to a point 1040 feet north of the north street line of Bayly Street and on Salk Road from Bayly Street to a point 1425 feet north of Bayly Street at a total estimated cost of $36,000.00 as local improvements under Zbe provisions of The Local Improvement Act. 2. The entire cost of the said sanitary sewers, $36,000.00, including debentures, shall be specially assessed and levied on all of the rateable property on Bayly Street, Sa]/< Road, Plumm~er Street and Brock Road lying within the area set out in Schedule "A" annexed hereto which is hereby defined a Local Improvement Area pursuant zo Section 67(1) of The Local Improvement Act, R.S.O. 1960, as amended, and be paid by an annual rate of 9~ per foot on the lands specially assessed. - 2 3. That watermains be constructed on the west side of Brock Road from 10 feet north of the street line of Bayly Street to a point 1044 feet north of the north street line offS/ Bayly Street, on Salk Road from Bayly Street to a point ~ feet north of Bayly Street and on Plummet Street from Salk Road to Brock Road at an estimated cost of $48,000.00 as local imp- rovements under the provisiorsof The Local Improvement Act. 4. The entire cost of the said watermains, $48,000.00, including debenture charges, shall be specially assessed and levied on all of the rateable property on Bayly Street, Salk Road, Plummet Street and Brock Road lying within the area set out in Schedule "A" annexed hereto, which was defined a local improvement area under paragraph 2 of this by-law, and be paid by an annual rate of $1.03 per foot on the lands specially assessed. 5. That granular based roads with asphalt pavement and ditches for surface drainage be constructed on Salk Road from Bayly Street to the north lima. of Salk Road (approximately 1700 feet north of ~=fu~:- -.~a~) and on Plummet Street from Brock Road to Salk Road at an estimated cost of $83 ,000.00 as local improvements under the provisions of The Local Improvement Act. 6. The entire cost of the said roads, $80~000.00, including debenture charges, is to be specially assessed and levied on all of the rateable property on Bayly Street, Salk Road, Plummet Street and Brock Road lying within the area set out in Schedule "A" annexed hereto, which was defined a local improvement area under paragraph 2 of this by-law, and be paid by an annual Iate of $2.55 peI foot on the lands specially 7. The Engineer of the Corporation is hereby authorized to make such plans~ profiles and specifications and furnish such infoxmation as may be necessary for the making of contIacts for the doing of the work or for carrying out the same by day labour and the work shall be carried on and executed under the super- intendence and according to the directions and orders of the said engineer. 8. The entire cost of the sanitary sewer and wa~er- mains is to be paid by the issuin0 of debentures bea~ing interest at the rate of 8 per centum per annum and be zepaid by the special assessr~nts over a term of 20 years, and the entire cost of the roads is to be paid by tbs issuance of debentures bearin9 interest at the ~ate of 8 per cenZum per annum and be repaid by the said special assessments over a te~m cf 10 years. 9. The Treasurer cf the Township may, subject to the approval of Council, agree with any bank or person, for temp- orary advances of money to ~et the cost of t~ work pending completion thereof. 10. Any person whose lot is specially assessed may commute by a payment in cash the special rate imposed by payin9 ~he cost of construction assessed upon such lo~ without the interest forthwith after the special assessment roll has been ce~ti£ied by the Clerk, bu~ may no% commute afte~ ~he debenture by-law has been passed. SCKEDULE "A" LOCAL IMPROVEMENT AREA ALL AND SIN~II,AR that certain parcel or tract of land and premises situate lying and being in the Township of Picketing in the County of Ontario and being composed of that part of Lot 19 in Concession l of the said Township bounded on the north by the lands of the Canadian National Railway Company, on the east by Brock Road, on the south by Bayly Street, and on the west by the ].ands of the Hydro-Electric Power Commission of Ontario; except those parcels of land at the north-west corner of Bayly Street amd Sa]k Road having a depth o~ 183 feet from Bayly Street and extending 200 feet west along Bayly Street from Salk Road.
