HomeMy WebLinkAboutBy-law 3687/69 being a by-law to authorize the construction of a sanitary se~ex, watermains and roads on Quigley S~reet and Dillingham Road as local improvements under the provisions of Sections 8 amd 67 of The Local Improvement Act. WHEREAS it is expedient that the construction of the works herein in Lot 19 in Range 3 of the Township ~f Fickezing shall be undertaken at the cos~ hereinafter set out as local improvements under the provisions of Section 8 of The Local Improvemer~t Act~ AND WHEREAS ~he cost of the said wozks is to be levied by imposing special assessments there£ur against lands in a local improvemen~ area hereinafter defined, pursuant to Section 67 of The Local Improvement Act ~ AbD WHEREAS notice of the intention ~f Council to the said construction and imposing of special rates has been published ~ 5DW THEREFORE THE COUNCIL OF THE CORPORATION (]~ THE TOWNSHIP OF PICIIERIN~ ENACTS AS FOLLOWS: 1. That a sanitary sewer be constructed on Dillingham Road from Quigley Street, northerly amd easterly, to a point 210 feet west of Brock Road at a total estimated cost of $27,000.00 as a local improvement under the provisions of The Local Improvement Act. 2. The entire cost of the said sanitary sewer, $27,000.00, is to be specially assessed upon lands abu~ ting directly upon the work and upon lands not abutting directly upon the v~xk but immediately benefitting therefrom. The entire cost, including debenture charges~ shall be assessed and levied on all of the rateable proper~y on Dillingham Road and Quigley S~reet lying within the area se~ out in Schedule "A" annexed hereto~ which is hereby defined a Local Improvement Area pursuant to Section 67(1) of The Local Improvement Act ~ R.S.O. 1960, as amended, and be paid by an annual rate of 65¢ per font on the lands specially assessed. 3. Tha~ watermains be constructed on Quigley Street - 2 - from Brock Road to Dillingham Road and on Dillingham Road from Quigley Street, northerly and easterly, to Brock Road at an estimated cost of $33,500.00 as local improvements under the provisions of The Local Improvement Act. 4. The entire cost of the sa~ watezmains, $33,500.00, including debenture charges, shall be specially assessed and levied upon all of the rateable property on Dillingham Rc~d and Quigley Street lying within the area set out in Schedule "A" annexed hereto, whichwas defined a local improvement area under paragraph 2 of ~his by-law, and be paid by an annual rate of 81¢ per foot on the lands specially assessed. 5. That granular based roads with asphalt ~vement and ditches for surface drainage be constructed on Quigley Street from Brock Road to Dillingham Road and on Dillingham Road from Quigley Street, northerly and easterly, to Brock Road at an estimated cost of $83,520.00 as local improvements under the provisions of The Local Improvement Act. 6. The entire cost of the said roads, $83,520.00, including debenture charges, shall be specially assessed and levied on all of the rateable property fronting on Dillingham Road and Quigley Street lying within the local improvement area defined in paragraph 2 and be paid by an annual rate of $2.93 per foot on the lands specially assessed. 7. The Engineer of the Corporation is hereby authorized to make such plans, profiles amd specifications and furnish such information as may be necessary for the making of contracts for the doing of the work or for carrying out the same by day labour and the work shall be carried on and executed under the superintendence and according to the directions and orders of the said engineer. 8. The entire cost of the sanitary sewer and watermains is to be paid by the issuing of debentures bearing interest aZ the rate of 8 per centum per annum and be repaid by the special assessments over a term of 20 years~ and the entire cost of the roads is to be paid by the issuance of debentures bearing interest at the rate of 8 per centum per annum and be - 3 - repaid by the said special assessments over a term of 10 years. 9. The Treasurer of the Township may, subject to the approval of Council, agree with any bank or person, for temp- orary advances of money to meet the cost of the work pending completion thereof. 10. Any person whose lot is specially assessed may commute by a payment in cash Che special rate imposed by paying the cost of construction assessed upon such lot without the interest forthwith after the special assessment roll has been certified by ~he Clerk, but may not commute after the debenture by-law has been passed. SCHEDULE "A" LOCAL IMPROVEMENT AREA ALL AND SINGULAR that certain parcel or tract of land amd premises situate lying and being in the Township of Picketing ~n the County of Ontario amd being composed of that part of Lot 19 ~n Range 3 of the said Township described as follows: COMMENCIRTG at a point in the interior of said Lot 19 distant 313 feet south of Bayly Street as widened and 227 feet west of the original west street line of Brock Road; THENCE westerly a]omg a ]~ne drawn parallel to the said li~t of Bayly Street and d~ stant 3].3 feet measured southerly therefrom a distance of 976.17 feet ~ore or less to the east limit of the la,nde of tho Hydro Electric Power Com~ssion of Ontario; THENCE so~therly along the said easterly limit of the Hydro Electric Power Commission of Ontario lands a distance of 1620 feet; THENCE easterly parallel to and approximately 200 feet so,~th of the so~th ]~m~t ~f ~uigley Street to a point 227 feet west of the original west street line of Brock Road; THENCE northerly parallel to the aforementioned west street line of Brock Road a distamee of 1620 feet more or less to the POINT OF COMMENCEMENT.
