HomeMy WebLinkAboutBy-law 3908/70THE CORPORATION OF THE TOWNSHIP OF PICKERING By-law Number 3 ? 0 S/7v being a By-law for the regulation of kennels for the breeding or boarding of cats and dogs within the Township of Pickering WHEREAS the Municipal Act R.S.O. Chapter 249, Section 379 (1) permits the Municipality to regulate kennels for the breeding or boarding of dogs and cats within the Municipality; NOW THEREFORE The Council of the Corporation of the Township of Pickering enacts as follows: 1. For the purposes of this By-law; (1) "KENNEL" means a building, premises or place in which cats or dogs or both are maintained, boarded, bred or cared for in return for remuneration or are kept fcrthe purpose of sale. (2) "MUNICIPAL LAW ENFORCEMENT OFFICER" means a person designated as a municipal law enforcement officer by a by-law of the Township. (3) "TOWNSHIP" means the Corporation of the Township of Pickering. (4) "KENNEL OPERATOR" means any person who owns, operates, manages, controls, or supervises any kennel within the Township. (5) "DWELLING" means a building intended for habitation by one or more persons. 2. No person shall own, operate, manage, control or supervise any kennel except in accordance with this By-law and any other By-law of the Township. 3. From the date of passing of this By-law no kennel shall be constructed or used except in accordance with the following provisions: - 2 - (1} No kennel or part thereof shall be used for human habitation or human sleeping purposes; nor shall any kennel or part thereof be structually connected with a dwelling. (2) The construction of any kennel shall conform to the requirements of the National Building Code, latest revised edition, and in particular to supplement No. 6, "Farm Building Standard'. (3) No kennel shall be used unless the following standards are met: (a) DOGS (i) Dogs shall be housed in individual enclosures except in the case of puppies under 6 months of age with or without the bitch. (ii) Each enclosure shall be large enough to permit any dog enclosed therein to move freely and in particular shall be maintained at a minimum of 60 degrees Fahrenheit. (iii) Floors shall be of dense concrete or similar light material and shall be adequately sloped to drains. (iv) Walls shall be non-porous, water-tight and easily cleaned. (v) Where floors are on grade, suitable bedding shall be provided in the form of a raised wood, fibreglass or similar platform, large enough for the dog to lie on. (vi) Outside exercise facilities shall be provided which shall be fenced in such a manner as to keep the dogs securely enclosed. Each dog shall be placed in such facilities at least twice in every 24 hour period for not -3- less than 30 minutes each period. (b) CATS (i) Cats shall be housed in individual enclosures except in the case of kittens under 3 months of age with or without the mother cat. (ii) Each enclosure for an adult cat shall not be less than 24"x24"x24" and in the case of a cat with a litter, not less than 30"x30"x24" high. (iii) Inside temperature shall be maintained at 60 degrees Fahrenheit. (iv) Cages or enclosures shall be constructed of a non porous water tight material with a smooth finish that can be easily cleaned. 4. No kennel shall contain greater numbers of cats or dogs or both than may, in the opinion of the municipal law enforcement officer, be housed, fed or otherwise cared for without overcrowding, unnecessary discomfort and risk of injury or disease to the cats and dogs therein. S. (1) Every kennel operator shall maintain the kennel in a clean and sanitary condition at all times. in particular the kennel operator shall see to it that all excrement, refuse and other objectionable material is removed from the premises at least once in every 24 hour period including weekends. (2) Such excrement, refuse and other objectionable material shall be disposed of in a manner which does not cause a nuisance. 6. Every kennel operator shall ensure that all dogs and cats are provided with an adequate source of clean, fresh drinking water available to them at all times. - 4 - 7. Every kennel operator shall ensure that competent and experienced kennel staff or attendants as may be necessary are on duty for a minimum of eight hours in every 24 hour period including weekends. 8. Every kennel operator shall ensure that any dog or cat that appears to be suffering from any disease shall within reason be given care and attention from a qualified veterinarian. 9• Every kennel operator shall at all times take all reasonable steps to prevent a nuisance by undue noise caused by the barking of dogs housed within his kennels. 10. Every kennel operator shall record the following: The names and addresses of the owners of all dogs or cats cared for at the kennels. The dates of arrival at and departure of all dogs and cats. H. Notwithstanding anything to the contrary in subsection 1 of section 3 above the following provisions apply to kennels existent at the time of the passing of this by-law. (1) Where a kennel or part thereof is structurally connected with a dwelling the kennel operator shall, within six months of the passing of this by-law, comply with the following provisions: (i) A separate entrance shall be provided for the premises occupied by the kennel. (ii) A partition wall shall completely separate the dwelling from the kennel in order to eliminate any direct access from the dwelling to the kennel. (iii) Such partition wall must be constructed in order to eliminate odour, dust and other obj:ctionable materials t rav>7 1 inn fr..?m thin kwn ne) in`,) tii t9 -5- dwelling. (2) Where a kennel or part thereof is being used for human habitation or human sleeping purposes, the kennel operator shall,within six months of the passing of this by-law comply with the following provisions: (i) A separate entrance shall be provided for the premises being used for human habitation or human sleeping purposes. (ii) Partition walls must be constructed in order to completely isolate the kennel from the areas being used for human habitation or human sleeping purposes. (iii) Such partition walls must be constructed in order to eliminate odour, dust and other objectionable materials travelling from the kennel into the areas being used for human habitation or human sleeping purposes. ?. The municipal law enforcement officer or any other officer of the :ace having jurisdiction within the Township may at any time enter a ;nnel and inspect the premises to ensure compliance with this By-law. 1. Every person convicted of a breach of any of the provisions this By-law is guilty of an offence and is liable upon summary )nvictlon to a fine of not less than ten dollars and not exceeding ie sum of thee hundred dollars, exclusive of costs, for each offence. _AD A FIRST, SECOND AND THIRD TIME AND PASSED IN OPEN COUNCIL {IS ilk DAY OF v°cw 1970.
