HomeMy WebLinkAboutBy-law 3870/70THE CORPORATION OF THE TOWNSHIP OF PICKL'RING BY-LAW NUMBER ?300/7c being a by-law to authorize the construction of water- mains in the Altona local improvement area as local improvements of Sections 11 and 67 of The Local Improve- me nt Act. WHEREAS it is expedient that the construction of water- mains in the Altona local improvement area of the Township of Pickering shall be undertaken at the cost hereinafter set out as local improvements under the provisions of section 11 of The Local Improvement Act ; AND WHEREAS the cost of the said works is to be levied by imposing special assessments therefor against lands in a local improvemnt area hereinafter defined, pursuant to section 67 of The Local Improvement Act; NOW TFEREOFRE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: 1. That watermains be constructed on the streets and between the points thereon set out on Schedule "A" hereto annexed at an estimated cost of $356,000.00 as local improvements under the provisions of The Local Improvement Act. 2. The entire cost of the said watermains is to be specially assessed upon the lands abutting directly on the work and upon lands not abutting directly upon the work but immediately benefitting therefrom. The entire cost, including debenture charges, shall be assessed and levied on the rateable property in the local improvement area set out in Schedule "B" annexed hereto, which is hereby defined a local improvement area puusuant to section 67 (1) of The Local Improvement Act. R.S.O. 1960, as amended, and be paid byfan - 2 - annual rate of$1.47 pet foot on the lands specially assessed. 3. The Engineer of the Coxpoxation is hereby authorized to make such plans, profiles and specifications and fuxnish such information as may be necessary for the making of contracts for the doing of the work or fox carrying out the same by day labour and the work shall be carried on and executed under the superintendence and according to the directions and orders of the said engineer. 4. The entire cost of the said watermains is to be paid by the issuing of debentures beaxi_ng interest at the rate of 10 per centum per annum and be repaid by the special assessments over a term of 20 years. 5. The Treasurer of the Township may, subject to the approval of Council, agree with any bank or person, for temporary advances of money to meet the cost of the work pending completion thereof. 6. Any person whose lot is specially assessed may commute by a payment in cash in the special rate imposed b paying the cost of construction assessed upon such lot without the interest forthwith after the special assessment roll has been certified by the Clerk, but may not commute after the debenture by-law has been passed. SCHEDULE "B" LOCAL IMPROVEMENT AREA All and singular those certain parcels or tracts of land and premises situate lying and being in the Township of Pickering in the County of Ontario and being composed of all those lands fronting or abutting on Altona Road from Highway 401 to Sheppard Avenue; on Rougemount Drive from highway 401 to Altona Road; on Highway 2 from Rosebank Road to Altona Road; on Sheppard Avenue from Altona Road to Rosebank Road; on Highbush Trail from its northerly intersection with Old Forest Road to its southerly intersection with Old Forest Road, and on Old Forest Road from Rosebank Road to Sheppard Avenue.
