Pedrick is the owner of Part of Lot 27 in the First Coneession of the Township of Pickering, municipally known as 890 Kingston Road, Pickering. AND WHEREAS a cottage and shed located on the said lands encroach upon and obstruct a public road allowance in contravention of By-law 1312 of the Township of Pickering. AND WHEREAS it is necessary that the said cottage and shed be removed from the road allowance so that road re-construction may take place. AND WHEREAS the said Mary L. Pedrick has been notified of the encroachment and obstruction and has further been notified of Council's intention to enact a by-law removing the said obstruction. AND WHEREAS Section 476 of The Municipal Act, R.S.O. 1960, Chapter 249 as amended, authorizes Councils of all Municipalities to pass by-laws for requiring erections or things projected into or over any highway, to be removed by the owner or occupant of the lands in which they exist. AND WHEREAS Section 485 of the said Municipal Act authorizes Council to remove the said obstructions at the owner's expense in default of such removal by the owner. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: 1. That the cottage and shed located on part of Lot 27 in the First Concession of the Township of Pickering, municipally known as 890 Kingston Road be removed to the extent that they encroach upon and obstruct the public road allowance. 2. That the Clerk and Township Engineer be directed and authorized to do all things necessary to accomplish such removal. 3. That the expenses of such removal be recovered from the owner.
