HomeMy WebLinkAboutBy-law 3844/70THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW NUMBER 5 gl/ 1) Being a by-law for requiring and regulating the filling up, draining, cleaning, clearing of any grounds, yards and vacant lots and the altering, relaying or repairing of private drains. ---------------------------------------- WHEREAS the Municipal Act provides that By-laws may be passed for requiring and regulating the filling up, draining, cleaning, clearing of any grounds, yards and vacant lots and the altering, relaying or repairing of private drains; AND WHEREAS The Municipal Act provides (inter alia) that where a Council has authority to direct or require by By-law or otherwise that any matter or thing be done, the Council may by the same or by another By-law direct that, in default of its being done by the person directed or required to do it, such matter or thing shall be done at his expense, and the Corporation may recover the expense incurred in doing it by action, or the same may be recovered in like manner as municipal taxes; NOW THEREFORE BE IT ENACTED and it is hereby enacted as a By-law of The Corporation of the Township of Pickering as follows; 1. DEFINITIONS In this By-law, (a) "Municipal Law Enforcement Officer" shall mean the Municipal Law Enforcement Officer for The Corporation of the Township of Pickering or any other officer authorized by the Corporation of the Township of Pickering for the enforcement of By-laws in the Township of Pickering; (b) "Corporation" shall mean The Corporation of the Township of Pickering; (c) "Premises" shall mean any grounds, yards or vacant lots; (d) "Owner" shall mean the owner, tenant, occupant, or person in charge or possession of any premises. 2. The owner of any premises shall keep such premises clean and clear of and from any garbage, tin cans, old or decayed lumber, discarded machinery, discarded, wrecked or dismantled motor vehicle, and any part thereof or therefor, and junk, refuse, rubble, ruins and waste or discarded material of any kind. 3. The owner of any premises, after delivery of notice in writing from the Municipal Law Enforcement Officer requiring such owner so to do, shall: Continued ...... 2 - 2 - Item 3 continued. (a) Fill up any hole, excavation or depression in or on the premises; (b) Clean and clear the premises of and from any garbage, tin cans, old or decayed lumber, discarded machinery, discarded wrecked or dismantled motor vehicle, and any part thereof or therefor, and junk, refuse, rubble, ruins, and waste or discarded material of any kind. 4. The aforesaid notice in writing from the Municipal Law Enforcement Officer may either be delivered to the owner at or mailed by prepaid registered first class post to the address of the owner as shown on the last revised assessment roll and the sending of the aforesaid notice shall be deemed to be good and sufficient delivery of notice upon the owner within the meaning of Section 3 of this By-law. 5. The Municipal Law Enforcement Officer is hereby authorized and empowered to enforce the provisions of this By-law. 6. Nothing in this By-law shall apply to any licensed salvage yard. 7. Wherever this By-law directs or requires any matter or thing to be done, in default of its being done by the person directed or required to do it, such matter or thing shall be done by or under the direction of the Muaiaipal Law Enforcement Officer at the expense of such person and the Corporation may recover the expenses incurred in doing it by action or the same may be recovered in like manner as municipal taxes. 9. Notwithstanding any other provisions of this By-law any person who contravenes any of the provisions of this By-law shall, upon conviction thereof, forfeit and pay at the discretion of the Convicting Magistrate a penalty of not more than $300.00, exclusive of costs, for each offence. f?
