HomeMy WebLinkAboutBy-law 3803/70BY-LAN NUMBER 3803/70 BEING A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF PICKERING TO PROTECT, MANAGE, REGULATE, GOVERN AND CONTROL ALL PUBLIC PARK LANDS AND COMMUNITY- CENTRE PREMISES UNDER THE AUTHORITY OF THE CORP- ORATION OF THE TOWNSHIP OF PICKERING. WHEREAS the Municipal Act, persuant to R.S.O. 19600 Chapter 249, Section 377, paragraphs 63 and 69 provides in addition to the authority contained in the Public Statutes of Ontario that By-laws may be passed for the use, protection, government, management, regulation and control of all public park lands and community centre premises; NOW THEREFORE BE IT ENACTED and it is hereby enacted as a By-law by The Corporation of the Township of Pickering as follows: 10 Except as herein otherwise provided, this By-law applies to all public park lands and community centre premises that are or hereafter may be owned by the Corporation of the Township of Pickering or are under the control and management of that Municipality by lease, agreement or otherwise. 2. In this By-law (a) "Municipality" shall mean the Corporation of the Township of Pickering. (b) "Director" shall mean the Director of Parks and Recreation appointed by the Council of the Municipality for the time being. (c) "Park Land" shall mean all land used by the Corporation of the Township of Pickering for public park purposes including any and all buildings, structures, facilities, erections, improvements and equipment of any nature or kind located in or on such land, for so long as the land is used for public park purposes. 2 - (d) °°Community Centre Premises" shall mean all land used by the Corporation of the Township of Pickering for recreation purposes including any and all buildings, structures, facilities, erections, improvements and equipment of any nature or kind located in or on such land, for so long as the land is used for recreation purposes. (e) "Motor Vehicle" includes an automobile, motorcycle and any other vehicle projected or driven otherwise than by muscular power but does not include the cars of electric or steam railways,or other motor vehicle running only upon rails. (f) "Motorcycle" shall mean a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a bicycle with a motor attached and a motor scooter. (g) "Posted Area" means an area where permissive, warning or prohibition signs are erected. (h) "Motorized Snow Vehicle" means a vehicle that is manufactured or designed exclusively to be operated on snow or ice or both and is propelled or driven otherwise than by muscular power. 3. No person shall in any Fark Lands or Community Centre Premises: (a) Wilfully cause injury to any person or damage any park Land or Community Centre Fremises or both by any means whatsoever. (b) Leave or deposit any ashes, bottles, garbage, or waste of any kind whatsoever except in the receptacles provided for such purposes; (c) as owner, or person having the control of any animal, permit such animal to swim in any swimming or wadinf* pool, fountain, stream or pond located in any Fark Lanes or Community Centre premises or both or permit such animal to swim in any water adjoining such lark lanes or Community Centre Premises: - 3 - 3. (continued) (d) hunt, fish or kill or attempt to hunt, fish or kill any animal, fish or bird or in any way maim, injure, molest or disturb any animal, fish or bird; (e) destroy, damage or disturb the nest or den of any bird or animal; (f) encroach upon Park Lands or Community Centre Fremises; should any person encroach upon such Land or premises the municipality shall notify such person to cease such encroachment and warn such person that if he fails to do so the Municipality may take such steps as are necessary to preclude the continuance of the encroachment and if the Municipality takes such steps and rectifys the continuance of the encroachment it may recover the costs of such action; (g) conduct himself in such manner as to be obnoxious or objectionable to other persons or indulge in boisterous, unseemly or unlawful conduct or use profane, indecent or abusive language; (h) enter or bathe in any water in or adjoining any park Land or Community Centre Fremises, bathing beach or swimming pool without being properly clothed in a bathing suit; (i) dress or undress in or adjacent to any water in or adjoining any Park Land or Community Centre premises, bathing beach or swimming pool except in the places specifically provided for such purpose; (j) being amale person enter any portion of any change or bathhouse or washroom set apart for the use of female persons or being a female person enter any portion of any change or bathhouse or washroom set apart for the use of male persons. - 4 - 4. Unless authorized by the Municipality, no person shall in any Park Land or Community Centre Fremises: (a) ride, park or drive any horse, motor vehicle, trailer or bicycle except upon the roadway therein designated for public vehicular use; (b) drive, park or walk upon prepared ground,newly seeded or sodded ground or ground Under repair or upon any lawn which is a posted Area prohibiting such driving, parking or walking in that area; (c) shoot an arrow or practice archery or operate power model aircraft; (d) play or practice golf or in any way strike, hit or otherwise propel a golf ball; (e) distribute or expose any kind of commercial circular or advertisement or post, mail, attach, stencil or otherwise fasten or erect any poster, sign, notice, placard or other circular, bill, advertisement, or paper to any tree, bush, shrub, fence, building or structure; (f) sell or keep for sale any goods, wares, merchandise, or articles, souvenires, novelties, tobacco, food, drink or refreshment of any kind; (g) ride, park or drive any Motorized Snow Vehicle; (h) perform for reward any art, skill, service or work; or practice, carry on, conduct or solicit for any trade, occupation, business or profession; (i) dig or tear up any pavement, sidewalk, crosswalk, grass plot or roadway or any part thereof; (j) destroy or cut, mark, break, dig, pull up, burn or in any way damage, injure, remove or deface: (i) any tree, flower, flower bed, bush, shrub, plant, sod, grass or other vegetation, soil, sand, gravel or wood; (ii) any wading pool, monument, fountain, bridge, fence, wall, gate, roadway, pavement, parking area, sidewalk, walk or other facility, erection - 5 - (ii) (Continued) or improvement; (iii) any building or other structure or any appurtenance thereof; or (iv) any swing, slide, playgvound, apparatus, table, seat, bench, sign, vase, or other fixture, equipment or personal property of ornament or utility; (k) operate or use any apparatus, mechanism or device for the amplification of the human voice, music or other sound; (1) light, make, build, or use any fire except in fireplaces provided for in specially designated areas; having first obtained a permit to do so; (m) Flace, maintain, or allow to remain therein any coin operated machine or game of any nature or kind or use any part of such lands or premises for any gambling purpose; (n) organize or arrange a picnic of more than 25 persons; (o) erect, construct, build or cause to be erected, constructed or bdilt any tent, shelter or building. 5. Every person who contravenes any of the Provisions of this By-law aball upon conviction thereof, forfeit and ray, at the discretion of the convicting magistrate, a penalty not exceeding the sum of $300.00, exclusive of costs, for each offence.
