HomeMy WebLinkAboutBy-law 4092/71THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW NUMBER Being a by-law to sell a stopped-up portion of the road allowance known as Greenwood Road, Sideline 11/12, Concession 4. WHEREAS a Municipality is empowered by Section 459 of The Municipal Act, R.S.O. 1960, C.249 to stop up highways and to sell the soil and freehold of such stopped-up highway; AND WHEREAS by virtue of Section 477 of the said Municipal Act, a municipality may fix by by--law the price at which such stopped-up highway may be sold to abutting owners and the period within which the same may be sold; AND WHEREAS said stopped up portion of said road allowance was stopped up by By-law #3962/71, passed on March 1, 1971; AND WHEREAS said By-law Number 3962/71 was confirmed by By-law Number 2822 of the Council of the County of Ontario passed at the regular meeting of the County Council on the 1st day of March, 1971. NOW THEREFORE the Council of the Corporation of the Township of Pickering ENACTS AS FOLLOWS: 1. That the soil and freehold of the stopped-up portion of the road allowance known as Greenwood Road shown as Part 3 of Plan RD 407, a plan registered in the Registry Office for the Registry Division of the County of Ontario as number RD 407 be sold to the Canadian Pacific Railway Company for the sum of $1.00, said parcel containing by admeasurement an area of 0.152 ac. 2. That the said Canadian Pacific Railway Company be allowed the right to complete the purchase of the said stopped-up portion of the road allowance for the said price within one month from the date of the passing of this by-law. 3. That if the said Canadian Pacific Railway Company does not exercise the said purchase within the time limited herein or within the time limited in any subsequent by-law, the Township may sell said lands to any other person at the same or a greater price. 4. That the Reeve and Clerk be and the same are hereby authorized to execute any documents necessary to give effect to this by-law.
