HomeMy WebLinkAboutBy-law 4065/71THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW NUMBER being a by-law to authorize the construction of watermains as local improvements under the provisions of sections 11 and 67 of The Local Improvement Act WHEREAS it is expedient that the construction of a booster station and watermains in the Township of Pickering shall be undertaken at the cost hereinafter set out as local improvements under the provisions of section 11 of The Local Improvement Act; AND WHEREAS the cost of the said works is to be levied by imposing special assessments therefor against land in a local improvement area hereinafter defined pursuant to section 67 of The Local Improvement Act; AND WHEREAS notice of the intention of Council to the imposing of special rates has been published; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: 1. That watermains be constructed on the streets and between the points thereon set out on Schedule "A" hereto annexed together with a booster pumping station at an estimated cost of $385,000.00 as local improvements under the provisions of The Local Improvement Act. 2. The entire cost of the said works is to be specially assessed upon the land abutting directly on the works and upon land not abutting directly upon the work but immediately bene- fitting therefrom. The entire cost, including debenture charges, shall be assessed and levied on the rateable property in the area set out in Schedule "B" hereto annexed which is hereby defined a local improvement area pursuant to section 67(1) of The Local Improvement Act, R.S.O. 1960, as amended, and be paid by an annual rate of $1.53 per foot on the land specially assessed. - 2 - 3. The Engineer of the Corporation is hereby authorized to make such plans, profiles and specifications and furnish such plans and information as may be necessary for the making of contracts for the doing of the works or for carrying out the same by day labour and the works shall be carried on and executed under the superintendence and according to the directions and orders of the said Engineer. 4. The entire cost of the said works is to be paid by "P 'Tc> the issuing of debentures bearing interest at the rate of^nine percent per annum and be repaid by the special assessments over a term of 20 years. 5. The Treasurer of the Township may, subject to the approval of Council, agree with any bank or person for tempor- ary advances of money to meet the cost of the works pending com- pletion thereof. 6. Any person whose lot is specially assessed may com- mute by a payment in cash the special rate imposed by paying the cost of construction assessed upon such lot without the interest forthwith after the special assessment roll has been certified by the Clerk but may not commute after the debenture by-law has been passed. SCHEDULE "A" Watermains to be constructed on: Sheppard Avenue from Altona Road to a point 560 feet east of the Pickering Scarborough Town line; Woodview Avenue South from Sheppard Avenue to Lot 19, Plan 434; Woodview Avenue North from Sheppard Avenue to Finch Avenue; Pine Grove Avenue from Woodview Avenue North to the east limit of Plan 282; Finch Avenue, south side, from Rosebank Road North to the Pickering Scarborough Town line; and Rosebank Road North from approximately 3230 feet south of Finch Avenue to Finch Avenue. SCHEDULE "B" Water local improvement area: ALL AND SINGULAR those certain parcels or tracts of land and premises situate, lying and being in the Township of Pickering in the County of Ontario and being composed of those lands fronting on both sides of: Sheppard Avenue from Altona Road to a point 560 feet east of the Pickering Scarborough Town line; Woodview Avenue North from Sheppard Avenue to Finch Avenue; Woodview Avenue South from Sheppard Avenue to Old Trespass Road; Pine Grove Avenue from Woodview Avenue North to the east limit of Plan 282; and the lands fronting on the south side of Finch Avenue from Rosebank Road North to the Pickering Scarborough Town line.
