HomeMy WebLinkAboutBy-law 4025/71BY-LAW NUMBER Z/O 2s/-7/ A BY-LAW TO DESIGNATE AREAS TO BE USED AS TOURIST CAMPS OR TRAILER CAMPS, AND TO LICENCE, REGULATE AND GOVERN SUCH CAMPS. 1. For the purpose of this By-law; (a) "Tourist Camps" shall include and mean auto camp or any parcel of lard or premises equipped with cabins or structures, used or maintained for the accommodation of the public, and any parcel of land or premises used or maintained as an overnight tenting, camping or parking ground for the public, whether or not a fee or charge is paid or made for the rental thereof; and (b) "Trailer Camp" shall include and mean land in or upon which any vehicle so constructed that it is suitable for being attached to a motor vehicle for the purpose of being drawn or propelled by the motor vehicle, is placed, located, kept or maintained, notwithstanding that such vehicle is jacked up or that its running gear is removed, but not including any vehicle unless it is uned for the living, sleeping or eating accommo- dation of persons therein. 2. The areas described in Schedule "A" of this By-law shall not be used as tourist camps or trailer camps during the period from October 31st in any year to May 1st in the year following. 3. (a) There shall not be more than twenty (20) cabins or structures located upon each of the areas set out in Schedule "A" to this by-law used for the living, sleeping or eating accommodation of persons therein and if a trailer is used for sleeping purposes such trailer shall be considered as a structure. (b) There shall not be more than twenty (20) vehicles or motor vehicles placed, located, kept or maintained for the living sleeping or eating accommodation of persons therein in each of the areas described in Schedule "A" of this by-law. (c) There shall be not more than forty (40) tents placed, located, kept or maintained for the living, sleeping or eating accommodation of persons therein in each of the areas described in Schedule "A" to this by-Law. (d) Tent sites that comply with the regulations of the Department of Tourism and with the other provisions of this By-law may be permitted by Council, with the maximum number of such tents permitted to be endorsed upon the licence, and no tents in excess of this number shall be erected or placed upon any site so licenced. (e) The use of any other land in the Township of Pickering for such purpose as described in paragraphs 1, 2 or 3, or any other purposes connected therewith, is prohibited. (f) And this by-law shall apply to all trailers whether they were used for eating, sleeping or living prior to the date of the passing of this by-law or not. Continued ...... 2 - 2 - 4. No person shall carry on, conduct, keep or maintain a Tourist Camp without first obtaining a licence from the Township of Pickering so to do, nor shall the owner of any land permit the use of his land for such purposes unless and until such a licence has been obtained. 5. Any person desiring to obtain a licence shall make an application to the Council of the Township of Pickering in the required form. 6. (a) A licence shall be issued for the calendar year and shall not be issued to any person under the age of twenty-one (21) years. (b) Upon the approval of Council and the necessary fee having been paid to the Treasurer of the Township, a licence may be issued by (jy_{„o ?,?ro ncE ,ENy ?;""Cp 2 (c) The schedule of fees shall be as follows: Five dollars per area licenced. 7. (a) A Tourist or Trailer Camp shall comply with the regul- ations of the Department of Tourism, from whom a permit must be obtained, and with the regulations of the Medical Officer of Health. (b) A licence under this By-law does not relieve the licencee from complying with any other Pickering Township By-law and a Police Officer, Fire Chief or his representative, Medical Officer of Health, Sanitary Inspector, Building Inspector, Plumbing Inspector or By-law Enforcement Officer may at any time inspect such camp. 8. (a) Any person, firm or corporation who operates a tourist or trailer camp shall keep a register, written in English of all persons harboured, received or lodged in any cabin, building, or structure, with their name, address and licence number of their motor car or trailer, with a description of the accommodation provided, including the date of arrival and the date of departure. (b) Such record shall be made available upon request of a Police or By-law Enforcement official. 9. (a) No person licenced under this By-law shall permit his place or premises to be used for any unlawful purpose, nor shall he permit or suffer profane or abusive language to be used by any person, nor permit disorderly conduct (as defined in the Criminal Code of Canada) therein or thereon. (b) No person licenced under this By-law shall permit the renting of accommodation to anyone under the age of eighteen years. (c) No cabin, building, structure or location shall be rented for a lesser period than twelve hours and any cabin, building, structure or location so rented shall not be rented or leased to any other person or persons or permitted to be occupied during the balance of such period except by the original lessor thereof. (d) The owner of a licence for a Tourist Camp or Trailer Camp shall not rent any building, cabin, structure, tent site or location for the purposes of sleeping, eating or living therein for a longer period than thirty (30) days in any period of ten calendar months, save that during the period from July 1st to August 31st a person may rent for the whole of this period if the occupants have not previously resided in a Tourist or Trailer Camp in the Township of Pickering during the previous six months, and further that such occupants are prohibited from occupying a Tourist or Trailer Camp before May 1st of the following year. (e) For the purpose of this By-law, a trailer shall be deemed to be used every day it is located in the municipality, but shall not be deemed to be used when parked in an area for the purpose of storage or sale, provided such area is outside the defined area of a trailer camp or camp site and is in fact not in use. Every place or premises licenced under this By-law shall be kept clean, safe and in good repair and condition by the licencee and the same shall be subject to inspection at all times by the officers named in paragraph 7 (b). 12. Any person or corporation convicted of a breach of this By-law shall forfeit and pay at the discretion of the Magistrate upon conviction a penalty not exceeding Three Hundred Dollars ($300.00) for such offence, not inclusive of costs. Every such penalty shall be recoverable under the Summary Convictions Act and all of the provisions which apply thereto. 13. Continuation of a breach of this By-law shall be deemed a separate offence for each day such breach continues. 14. By-laws contrary or inconsistent with this By-law are hereby repealed. 15. Roll No. 011-121 - North half of Lot 13, Concession 3 on the West side of Sideline 13, containing 49.20 acres - owned by George and Hazel Hodgson. 2. Roll No. 39-201 - South half of Lots 33/34 on the North side of Highway # 2, containing 30.00 acres - owned by John Dallas Graham. The following locations may be used as "Tourist Camps" only: 1. Roll No. 03-359 - Part of the South half of Lot 13, Concession 5, on the North side of the 5th Concession Road Allowance containing 159.100 acres - owned by Metropolitan Toronto & Region Conservation Authority. 2. Roll No. 11-055 - Part of Lot 14, Concession 4, North side of Concession 4, containing 100.00 acres - owned by Metropolitan Toronto & Region Conservation Authority. 3. Roll No. 07-304 - Part of North half of Lots 10, 11 and 12 in Concession 7, containing 360.750 acres - owned by Metropolitan Toronto & Region Conservation Authority.
